RESOLUTION N0. R91-4
A RESOLUTION ADOPTING AMENDMENTS TO THE CAPITAL
IMPROVEMENTS PLAN APPROVED, AND THE IMPACT FEES
IMPOSED, BY RESOLUTION N0. 90-22, PASSED AND APPROVED
THE 4TH DAY OF JUNE, 1990; MAKING CERTAIN FINDINGS ;
AND PROVIDING FOR SEVERABILITY.

WHEREAS , the City Council has directed the qualified
professionals on the City' s staff to prepare an amendment to
the City' s Capital Improvements Plan and to recalculate impact
fees in accordance ther�with; and
WHEREAS, the City Council has held public hearings as
required by law to amend its Capital Improvements Plan and
adjust impact fees ; and
WHEREAS , the City Council desires to adopt such amendment ,
a true and correct copy of which is attached hereto as Exhibit
"A" and £or all things is made a part hereof; now therefor�
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSW00�,
TEXAS :
Section l. The facts and matters set forth in the
preamble of this Resolution are hereby found to be true and
correct.
Section 2. The Capital Improvements Plan and Impact Fee
Study, adopted pursuant to P.esoluti_on No. 90-22, passed and
approved the 4th day of June 1990, is hereby amended as set
forth in Exhibit "A" attached hereto, said Exhibit "A" being
entitled "City of Friendswood Amendment to C. I. P. and Impact
Fee Study Dated April 27, 1990, Amendment - August 25 , 1990. "

Section 3. In the event any section, paragraph,
subdivision, clause , phrase, provision, sentence, or part of
this Ordinance or the appZication of the same to any pers�n or
circumstance shall for any reason be adjudged invalid or held
unconstitutional by a court of competent jurisdiction, it shall
not affect, impair, or invalidate this Ordinance as a whole or
any part or provision hereof other than the part declared to be
invalid or unconstitutional ; and the City Council of the City
of Friendswood, Texas, declares that it would have passed each
and every part of the same notwithstandi.ng the omission of any
such part thus declared to be invaZid or unconstitutional , or
whether ther� be one or more parts .
PASSED, APPROVED, AND RESOLVED this 7th day

Amenc7ment to C.I.P. and Impact Fee Study
Dated April 2?, 1990
Amenc�nent - August 25, 1990
The purpose of this amenc�nent of the impact fees for the City of
Friendswood, is to consider sanitary se�er collection system costs to
serve the area knawn as Mills, Murphy and BriarmPadaw Avenue betw�en
Sunset Drive and Greenbriar Avenue, as shown on the attached "Exhibit
A".
Land use for the area is totally single family residential. The total
nLm�ber of service units available was determined by allowing the
maximLUn density to ccanply with City of FriendsHrood subdivision
regulations.
A previous plan was adopted for this area to install sanitary sewer
collection lines and assess the property avners for their pro rata
share of these facilities. Approximately 7,000 feet of sanitary sew�r
lines were installed with manholes and appurtenances in 1986. Sane
land owners elected to prepay for their connections and others were
assessed when they appl.ied for building permits. A stuimary of the
construction costs amounts collected and lot n�nbers is as follaws:
Total lots in service area = 48
Total lots that prepaid fees = 28
'Ibtal lots built after original assessment = 4
Total lots left to be assessed = 16
Total construction costs i.ncluding engineering = $121,554
Amount prepaid by landawners = 34,090
Amount assessed by City for permits = 6,900
Total amount of costs unpaid $ 80,564
Pro rata share of remaining costs per service
unit yet to be assessed = $ 5,035.25
In effort to keep this plan equitable when considering amounts
previously paid, the City of Friendswood elects to set the impact fee
for this area at an amount determined by taking the total construction
costs and dividing it by the rnunber of original lots. This will result
in an impact fee for the area of $2,532 per lot.

Friendswood City Council Chambers
to receive public canr�nt on the amench�nt of ��act fees.
At said hearing all interested citizens shall have the
right to appear at t1?e hearing and present evidence for or
against the amencim�nt of impact fees for sanitary sew�er
collection syst�n costs to serve the area krxxan as Mills,
Murphy and Briarn�eadaw A�e.>>,ae betw�n Sunset Drive and
Greenbriar Avenue.
The Amenc�nent to the Capitai Improvements Plan and Im�act
Fee Study may be reviewed de�rina reyular office hours at
the Canmun.ity Develo�nt Depart7r�ent at 1306 Deepux�od and
the City Secretary's Office at City Hall.
At said hearings all interested citizens shall have the
right and opportunity to a��ar a�rd be heard both orally
and through written c.Kxrmunication on the subject.
