R92-20 A RESOLUTION OF TSE CIT3� OF FRIENDSWOODr TBXAS, ENCOURAGING THE STATE OF TEX�S., HY AND TffitfJUGH THE TBXAS WATSR COI+IlrlISSItkT, TQ TAKS OVER ADMII�ISTR�TIQN OF THS FLDBRAL WASTEWATER DISCHARG�3 PERMIT PRQGRAM, AS S8T FORTH IN A L$TrBR TO TEXAS G�OVBRNOR ANN RICHARDS BY NEWLY APPOINTED U.S. ENVIRON1�t�1TAL PRO�EC'I.'IC�t AGENCY (SPA) REGIO� 6 ADMIIIISTRAT()R B. J. WYNNE.. WHEREAS, in order to avoid millions of dollars in potential cost to Texas taxpayers and utility ratepayers, it is urgentl�r necessary that Clean Water Act of 1972, and the discharge permit program be aclministered by the State of Texas; and WHEREAS, Mr. Wynne of the EPA has explained that it was the intent of the U. S. Congress that the Wastewatsr di.scharge permit program should be administered primarily by the. States, with the EPA playing an oversi.ght role ; and W'HEREAS, Texas is ane of only 12 states that have not assumed admini.stration of the Federal wastewater permitting program within its jurisdiction; and WHER$AS, to date, Texas has not formallg applied for the program and actively pursued program development or assumptian; and. WHEREAS, adoption af the program by the Texas Water Commission would mean that the State would have primary permitting and enforcement respansi.bility for 1997 mi.nor municipal discharges and 380 major municipal discharges as well as over 2,740 minor industrial discharges and 229 major industrial discharges; and WHEREAS, it is the desire of the EPA to make every effort ta make efficient use of taxpayer dallars by the assumption of the permit and discharge programs by the 5tate of Texas. to approve, assume and administer the above referenced prograrns; NOW, Z'HEREFORE, HS IT RESOLVED BY THE CITY CGUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS: That pursuant to the request made by B. J. Wynne, Administratar of the U. S. Enviranmental Protection Agency, Region VI, ta Governor Ann Richards of the State 4f Te.xas, in a letter dated January 16, 1992r the City Council of the City of Friendswaod,, Texas, respectfull�r requests the Governar, The Attorney General and State Legislators to implement and assume the administrati.on of the wastewater discharge programs as gr4vided in the Glean Wate� Act of 1972, PASSED. APPRQVED AND ADOPTED by the Cit� Council of the City af Friendswood, Texasf this the 6�h day of April, 1992. Mayor Paul w.
