A RESOLUTION ESTABLTSHING STANDARDS AND GUIDELINES FOR
USE OF PUBLIC STREETS FOR DISPLAY OF BANNERS.

WHEREAS, pursuant to Subparagraph "a" of Paragraph 10 of
Subsection K of Sectian 8 of City of Friendswood Ordinance No.
$4-15� passed and approved the 29th day of November, 1984 , and
being the Zoning Ordinance of the City, as amended by Ordinance
No. 91-15, passed and approved the 17th day of June, 1991, said
amendatory ordinance containing rules and regulations governing
the erection and use of signs within the City, the City Council
may authorize the placement of signs on public property; and
WHEREAS, pursuant to and in accordance with said
Subparagraph "a, " the City Council desires to allow the limited
placement of banners in public street rights-of-way subject to
certain terms and conditions as contained herein; now therefore
BE IT RESOLVED BY THE CITY COUNCTL OF THE CITY OF FRIENDSWOOD,
TEXAS:
Section 1. Banners may be erected over public street
rights-of-way within the City under the following terms and
conditions:
a. Only non-commerci.al, charitable, non-profit
organizations having a principal office located in the City
will be allowed to erect banners, and such banners shall not
contain commercial speech;

b. Any banner to be connected to any structure or
facility of a public utility company shall be of a design
and material type acceptable to said company, and evidence
of such approval and permission to use any such structure
and/or facility shall be submitted at the time application
is made for a street banner use permit;
c. Each banner shall be constructed of porous
material of at least eighty percent (80%) cotton mesh;
d. No banner shall be more than twenty-five feet
(25' ) in width nor more than four feet (4 ' ) in height, and
shall have tie-down ropes connected to each corner;
e. No banner shall be permitted to be placed for a
period in excess of seven (7) consecutive days, and banners
shall not be permitted during periods before and during
elections when City "vote" banners are in place;
f. No banner placement will be approved unless and
until a street banner permit application has been received
and the person or organization proposing to place such
banner has executed a license agreement in substantially the
form attached hereto as Exhibit "A" and made a part hereof
for all purposes;
g. No banner permitted hereby shall be erected except
at the intersection of Willowick and South Friendswood
Drive.
h. The applicant has complied with such other
conditions as City Council may from time to time deem
necessary and appropriate; and

i. The street banner use permit application has been
approved by City Council.
Section 2 . In the event any section, paragraph,
subdivision, clause, phrase, provision, sentence, or part of this
Resolution or the application of the same to any person or
circumstance shall for any reason be adjudged invalid or held
unconstitutional by a court of competent jurisdiction, it shall
not affect, impair, or invalidate this Resolution as a whole or
any part or provision hereof other than the part declared to be
invalid or unconstitutional and the City Council of the City of
Friendswood, Texas, declares that it would have passed each and
every part of the same notwithstanding the omission of any such
part thus declared to be invalid or unconstitutional, or whether
there be one or more parts.
PASSED, APPROVED, AND RESOLVED this 17th day of
