A RESOLUTION OF THE CITY OF FRIENDSWOOD,
TEXAS, AUTHORIZING ' THE CLEAR CREEK
DRAINAGE DISTRICT AND THE CITY OF
FRIENDSWOOD TO HOLD JOINT ELECTIONS.
NOW THEREFORE BE IT RESOLVED, by the City Council of the City
of Friendswood, Texas:
WHEREAS, The Clear Creek Drainage District and the City of
Friendswood desire to hold joint elections for the
benefit and convenience of the voters of the City of
Friendswood, and
WHEREAS, The State Election Code allows joint elections to be
held when governing bodies enter into an agreement
and the elections are: (a) to be held an the same
day, (b) in all or part of the same territory, and
(c) when the election precinct can be served by a
common polling place; and
WHEREAS, The Clear Creek Drainage District and the City of
Friendswood have determined it is in the best
interest of both governmental entities and the
citizens of Friendswoad to hold joint elections.
WHEREAS, The elections shall be held in accordance with State
Election Codes.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD, TEXA5:
SECTION 1. The Clear Creek Drainage District and the City
of Friendswood agree that the Cit� of Friendswood
will be responsible for coardinating and
conducting the joint elections for C1ear Creek
Drainage District and the City of Friendswood.
SECTION 2. Each governmental entity agrees to submit a
request for pre-clearance to the United States
Department of Justice in accordance to the
Federal Voting Rights Act. Said pre-clearance
shall detail the change in voting method, the
gavernmental entity responsible for conducting
the election, the change in absentee polling
place and other matters that may affect the
canduct of the election.
SECTION 3 . The Clear Creek Drainage District and the City
of Friendswood agree to use a joint ballot and
one set of election workers and Judge for each
precinct, where applicable. Said Judge to be
appointed by the City of Friendswood.
SECTION 4. The Clear Creek Drainage District and the City
of Friendswood agree that the City of Friendswood
will conduct earl� voting for both governmental
entities and the City Secretary of the City of
Friendswood will be agpointed as joint early
voting clerk for both entities. Early voting
will be conducted at City Hall, 1Q9 Willowick,
Friendswood, Texas. The regular early voting
clerk will be appointed far each entity and will
receive the applications for early ballots to be
voted by mail. Al1 applications for early
ballots will be forwarded to the joint earl�
voting clerk for processing.
SECTION 5 . One set of ballot boxes will be used at each
polling place for the deposit of all the voted
ballots for each of the participating
governmental entities.
SECTION 6. The Cit� Secretary' s Office of the City of
Friendswood shall be the custodian af the key to
the ballot bax for voted, counted ballots
deposited in a single ballot box for more than
one political subdivision participating in a
joint election and shall be the custodian of the
key ta the ballot box for voted ballots for
elections ordered by an auth�rity of any one of
the participating governmental entities.
SECTION 7. The forms and records used at a common polling
place ma� be combined in any manner convenient
and adequate to record and report the results of
the election for each of the participating
governmental entities.
SECTION 8. Clear Creek Drainage District and the City of
Friendswood agree that the general custodian of
voted election records will be the City Secretary
of the City of Friendswood.
SECTION 9. The City Secretary of the City of Friendswood
will manage the operation of the central caunting
station for tabulation of the joint voted
ballots. Each governmental entity election clerk
shall be present during the tabulation process.
Unofficial tabulation returns will be pravided to
each gavernmental entity bg the City Secretary of
the City of Friendswood upon completion af the
counting, in accordance with State Election
Codes.
SECTION 10. The canvass of the election returns will be the
responsibility of each governmental entity.
Certificates of Election shall be issued to the
candidates elected at a joint election by the
presiding officer of the canvassing authority
that regularly serves each governmental entity.
SECTION 11. The compensation paid to election officers
serving at a common polling place in a joint
election will be the same as that paid to
election officers serving at a regular polling
• place as prescribed by the Election Code.
SECTION 12. Special Elections shall be conducted in the same
manner as regular joint elections. Each
governmental entity will be responsible for costs
incurred to conduct such special elections.
SECTION 13 . Expenses shall be divided according to
proportionate shares incurred on behalf of each
governmental entity, for each joint election
conducted.
