ORDINANCE NO. 2018-32 AN ORDINANCE ADOPTING AN ORDER SETTING A PUBLIC HEARING ON JANUARY 14, 2019, AT 7:00 P.M., TO DISCUSS AND REVIEW THE UPDATED LAND USE ASSUMPTIONS AND CAPITAL IMPROVEMENTS PLAN AND AMENDMENT OF IMPACT FEES. WHEREAS, on November 5, 2018, the City Council received the update of the land use assumptions and the capital improvements plan and the amended impact fee; and WHEREAS,pursuant to Texas Local Government Code Section 395.053, the governing body shall, within 60 days after the date it receives the update of the land use assumptions and the capital improvements plan and the amended impact fee, adopt an order setting a public hearing to discuss and review the update and shall determine whether to amend the plan and amend the impact fee amount. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. That the City Council of the City of Friendswood, Texas,hereby adopts an order setting a public hearing date of January 14, 2019, at 7:00 p.m. in the City Hall City Council Chambers located at 910 South Friendswood Drive, Friendswood, Texas, to discuss and review the updated land use assumptions and capital improvements plan pursuant to Texas Local Government Code Section 395.053. Section 2. That the City shall publish notice of this hearing before the 30th day before the date set for the hearing in the Friendswood Reporter News newspaper, advising the public of the time, date and location of the hearing and notifying the public of its right to appear at the hearing and present evidence for or against the update. Section 3. That on or before the date of the publication notice of the hearing on the amendments,the land use assumptions and the capital improvements plan, including the amount of any proposed amended impact fee per service unit, shall be made available to the public. Section 4. That in the event any section, paragraph, subdivision, clause, phrase, provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional;and the City Council of the City of Friendswood,Texas,declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts. Section 5. That this ordinance shall become effective from and after its date of passage in accordance with law. PASSED AND APPROVED on first reading this 5th day of November, 2018.
