R94-37 A RESOLUTION OF THE CITY OF FRIENDSWOOD, COUNTIES OF GALVESTON/HARRIS, TEXAS, DESIGNATING A REPRESENTATIVE TO THE GULF COAST COALITION OF CITIES; AUTHORIZING EMPLOYMENT BY THE COALITION OF ATTORNEYS AND CONSULTANTS TO REPRESENT THE INTERESTS OF COALITION MEMBERS, INCLUDING THE CITY OF FRIENDSWOOD, TEXAS, IN PROCEEDINGS REGARDING THE RATES CHARGED BY HOUSTON LIGHTING AND POWER COMPANY FOR ELECTRIC UTILITY SERVICES; AUTHORIZING INTERVENTION BY THE CITIES IN TEXAS PUBLIC UTILITY COMMISSION DOCKET N0. 12065, CONSOLIDATED, AND AUTHORIZING INTERVENTION BY THE CITY IN ANY FUEL RECONCILIATION OR PRUDENCE PROCEEDING FILED DURING THE PENDENCY OF THE PROCEEDINGS INITIATED BY RESOLUTION N0. R94-36 OR TEXAS PUBLIC UTILITY COMMISSION DOCKET N0. 12065, CONSOLIDATED; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. * * * �t * * * * WHEREAS, pursuant to City of Friendswood ("City") Resolution No. R94-36, passed and approved the 12th day of September 1994, the City has directed Houston Lighting and Power Company ("HL&P") to file certain rate information with the City for the purpose of determining whether current rates charged by HL&P for electric utility services within the City are unreasonable; and WHEREAS, a proceeding is currently underway before the Texas Public Utility Commission ("PUC") regarding the reasonableness of rates currently being charged by HL&P in unincorporated areas; and WHEREAS, the City is a member of the Gulf Coast Coalition of Cities ("GCCC") , same being an organization formed for the purpose of sharing resources and jointly reviewing the reasonableness of rates charged by HL&P for electric utility services within the corporate limits of the respective member cities; and WHEREAS, representatives of the various member cities of GCCC have recommended that said cities initiate a review of the rates currently charged by HL&P pursuant to Section 42 of the Public Utility Regulatory Act, that said cities intervene in proceedings currently before the PUC under pocket No. 12065, consolidated, and that the representatives be authorized to employ legal counsel and necessary rate consultants for the purpose of representing the members of the GCCC in such proceedings; now therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS: Section 1. The facts and matters set forth in the preamble of this Resolution are hereby found to be true and correct. Section 2, The City hereby appoints Councilmember Lowe as the City's representative to the GCCC and hereby further approves, ratifies, and confirms a11 participation by representatives of the City in discussions and organizational activities of said GCCC prior to the date of adoption hereof. Section 3. The employment by GCCC of legal counsel and appropriate rate analysts and consultants to represent the interests of the City in all proceedings involving the review of rates by HL&P is hereby approved and any and all actions by the City's representative to said GCCC relating to the engagement of such professionals subsequent to August 15, 1994, is hereby in a11 things approved, ratified, and confirmed. - 2 - Section 4. The City Council hereby further authorizes the legal counsel for GCCC to take such action as is reasonable and appropriate and in accordance with directives of the representatives of the GCCC, to provide for intervention by the City in PUC Docket No. 12065, consolidated, and to provide for intervention by the City in any fuel reconciliation or prudence proceeding which may be filed or conducted during the pendency of the rate review proceedings initiated by the City pursuant to Resolution No. R94-36 or during the pendency of proceedings under PUC Docket No. 12065, consolidated.
