Sectioa 1. The formula far the calculation of actual
domestic sewage, as required by City of Friendswood Ordinance
No. 79-23, passed and approved November 5, 1979, is hereby
established and effective the first billing date in October,
1994, as provided in Exhibit "A" attached hereto.

MONTHLY SEWER RATES
SINGLE UNIT RATEB:
A1. Single Family Residential
Minimum charge: $8.50 for the first 3000 gallons
All gallons over minimum: $1.55 per 1000 gallons
A2. Single Commercial
Minimum charge: $5.70 for the first 3000 gallons
All gallons over minimum: $1.55 per 1000 qallons
MULTI-UNZT RATEB:
The winter average consumption per unit is computed by dividing the
current winter average by the number of units. The charge per unit is
then computed based on this winter average consumption per unit at the
following rates. This per unit charge is then multiplied by the number
of units for the total charge.
A3. Multi-Family Residential

All gallons over minimum per unit: $1.55 per 1000 gallona
A4. Multi-Commercial
Minimum charge per unit: $5.70 for the first 3000 gallons

Other shall include, but not be limited to, schools, churchea,
parks, subdivision recreation facilitiea and other non-residential
or non-commercial accounts.

For the purpose of this resolution, the term "gallons" shall mean the
average water metered and billed through individual meters during the
months of November through February and hereinafter referred to as "winter
average . A new winter average shall be computed each year. Customera
not receiving water or aewer aervice during the period of November through
February will be billed at the citywide winter average consumption rate.
Cuatomers with aewer service, but without water service will be billed at
the citywide winter average consumption rate.
DEFINITION OF UNIT
Residential:
For the purpose of thie resolution, the term "unit" shall mean, for
residential customers, each residential unit designed for occupancy by a
aeparate family, including each unit located within a single
multi-residential building, regardless of whether each unit is metered
separately. Example of a reaidential unit shall include, but not be
limited to, the following: a house, apartment, town house, mobile home, a
group of rooms or a single room, or any other separate or individual space
intended for occupancy as living quarters.
Commercial:
For the purpose of this resolution, the term "unit" shall mean, for
commercial customera, each commercial unit designed for occupancy by a
separate or individual business as a meana of livelihood. Example of a
commeraial unit under this section ahall include, but not be limited to
the following: ahopping centera, strip centers or individual businesses.
The term "unit", for professional buildings, shall mean the number of rest
rooms located within the atructure. Rest room shall mean one (1) unit,
unisex rest room: or, one (1) unit for each male and female rest room.
Other:
For the purpoae of this resolution, the term "unit" shall mean, for other
customers, one (1) unit per meter connection.

September 12, 1994
Resolution R94-35: Adopting a formula for determination of
sewage usage by domestic users.
As discussed in our budget work sessions, the revenues for the
Sewer Fund are less than the expenditures. During those sessions
you indicated a desire to increase the revenues sufficient to end
that trend. The attached resolution is designed to do that. We
are providing the table presented in the work session for your
review. Upon adoption, they will be implemented the first
billing in October for all customers.
Resolution R94-36: HL&P rate review process.
Assuming the Council is ready to take action, this resolution has
been prepared. The resolution authorizes the City to require
HL&P to file certain rate information with the city. The city,
through its attorney and through the Gulf Coast Coalition of
Cities (GCCC) , will review the rate information, hold a public
hearing, and determine if the existing rates are appropriate or
if lower rates should be set. This process is per Section 42 of
the Public Utility Regulatory Act (PURA) , called a "Section 42"
for short.
There are several other cities included in the Coalition. Most,
we believe, will file a Section 42 in their own city. We are now
looking into the possibility of holding joint public hearings to
save time and expense in the process. The resolution speaks to
that possibility.
We are enclosing correspondence dated August 18, 1994 and
September 1 , 1994 from Mr. Rima for your information.
Resolution R94-37: Designating representative to Gulf Coast
Coalition of Cities, authorizing employment of attorney and
consultants, etc. , regarding HL&P rate proceedings.
This resolution ratifies the hiring of Mr. Bob Rima, atCorney in
Austin, as the attorney for the Coalition. Mr. Rima is a former
General Counsel for the Public Utility Commission in Austin and
has many years experience in the regulatory affairs of utilities
in other states. We believe he will serve us well in this
effort. Enclosed is Mr. Rima's letter of understanding dated
� August 26, 1994.
This resolution also appoints Councilmember Lowe to represent the
City of Friendswood in the Gulf Coast Coalition of Cities. For
your information, the Coalition members appointed Councilmember
Lowe as Coordinator for the Coalition at a recent meeting. They
also appointed me Secretary of the Coalition.
Resolution R94-38: A resolution adopting a tolling order to
extend the thirty-day period for review of basic cable rates and
equipment charges.
As you know, we just completed adoption of an ordinance setting
rates for TCI cable for the period September 1993 to July 1994.
That ordinance was set under the provisions of FCC rules in
effect April 1, 1993, based on an FCC Form 393 originally used by
TCI.
Since then, FCC has changed their rules and developed a new Form
1200 for TCI to follow in setting rates. FCC also allowed TCI to
set rates based on the Form 1200 before the Cities could approve
them. It is now time to review the Form 1200, and in my City
Manager's report, I reported we have hired Reed-Stowe again to
review the Form 1200 series. You may asked why we should review
the Form if TCI has already adopted the rates. TCI's calculations
may not be correct, or we may disagree with the method of
calculation which could result in a different rate being set.
`"`"� That did happen in our review of the Form 393, and a rebate will
be given all customers as a result.
We received the Form 1200 on August 12, 1994. FCC requires the
cities to act within 30 days or the receipt or the rates go into
effect. Reed-Stowe has not had a chance to review the Form 1200;
therefore, we have prepared this resolution, called a "Tolling
Order" in FCC jargon, to delay action for an additional 90 days.
We recommend adoption of this resolution.
Resolution R94-39: Stating intent of council to call an election
for 1/2 cent sales tax under 4B and 1/4 cent sales tax for
property reduction.
Staff has recommended adoption of this resolution. This is, in
effect, a statement of intent. It is legally too early to
actually call the election for the sales tax options, under
Section 4B of the Industrial Corporation Act, and for the
Property Tax Reduction.
However, so many people are interested in getting started on a
campaign for its passage, we believe this resolution of Intent
will give them the signal of your intention to call the election
at the appropriate time. They, then, can proceed with their
campaign program, particularly on the sales tax for the sports
.-- complex.
