y A RESOLUTION OF THE CITY OF FRIENDSWOOD, TEXAS
GRANTING A LIMITED WAIVER OF ENCROACHMENT FOR AN
EXISTING BUILDING LOCATED ON LOT 30, 154 IMPERIAL
AVENUE, IMPERIAL ESTATES SECTION 1, A RECORDED
SUBDIVISION LOCATED IN GALVESTON COUNTY, TEXAS; AND
PROVIDING OTHER MATERIAL RELATED TO THE SUBJECT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section 1. The City Council of the City of Friendswood,
Texas, hereby waives the encroachment of a one-story frame garage
into the existing 100 foot roadway easement by that certain
building located on Lot 30, Imperial Estates Subdivision
Section 1, a recorded subdivision located in Galveston County,
Texas.
Section 2. The waiver granted hereby is limited to the
existing encroachment which is more full delineated and depicted
by that certain survey prepared by Harry E. Kain, Kain & Currie
Surveying Company, dated August 8, 1994, a copy of which is
attached hereto as Exhibit "A" and is made a part hereof for all
purposes.
Section 3. The waiver of encroachment granted hereby
does not authorize expansion of the existing encroachment. Upon
destruction of all or such portions of the building encroaching
upon said utility easement, this waiver shall be null and void
and of no continuing effect.

Section 4. The City Secretary shall cause an executed
original of this resolution to be presented to the County Clerk
of Galveston County, Texas, for filing among the deed records of
such county.
PASSED, APPROVED AND ADOPTED by the City Council of the City
of Friendswood on this the 15th day of August, 1994.
