ORDINANCE NO. 2018-23
AN ORDINANCE REPEALING ORDINANCE NO. 2017-36
AND AMENDING THE CODE OF ORDINANCES OF THE
CITY OF FRIENDSWOOD, TEXAS, BY DELETING FROM
CHAPTER 34 THEREOF ALL OF SECTION 34-24 AND
SUBSTITUTING THEREFOR A NEW SECTION 34-24;
PROVIDING FOR ADOPTION OF "THE FLOOD
INSURANCE STUDY FOR GALVESTON COUNTY, TEXAS
AND INCORPORATED AREAS," DATED FEBRUARY 28,
2018, AND "THE FLOOD INSURANCE STUDY FOR
HARRIS COUNTY, TEXAS AND INCORPORATED
AREAS," DATED JANUARY 6, 2017, AND "THE FLOOD
INSURANCE STUDY FOR HARRIS COUNTY,TEXAS AND
INCORPORATED AREAS," DATED JUNE 18, 2007;
PROVIDING A PENALTY OF AN AMOUNT NOT TO
EXCEED $2,000 FOR EACH DAY OF VIOLATION
HEREOF; AND PROVIDING FOR SEVERABILITY.

WHEREAS, the City of Friendswood is adopting the latest flood hazard mapping for
Galveston County in 2018, majority portion of Harris County in 2017, and remaining portion of
Harris County by the Federal Emergency Management Agency ("FEMA") in 2007, based in part
on the analysis of data collected during Tropical Storm Allison; and,
WHEREAS, the City understands the official FIRMette illustrates the effective maps for
Friendswood are still based on the 1999 FIRMs; and
WHEREAS, the City of Friendswood recommends adopting the 2018 Preliminary FIRM
for Galveston County, the 2017 FIRM for the majority of Friendswood in Harris County, and
remaining portion of Friendswood in Harris County on the 2007 FIRM for determining flood zone
designations; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section 1. That Ordinance No. 2017-36 is repealed in its entirety.
Section 2. That Section 34-24 of the Code of Ordinances of the City of Friendswood,
Texas, is amended to read as follows:
Section 34-24. Basis for establishing the areas of special flood hazard.
The areas of special flood hazard identified by the Federal Emergency
Management Agency in a scientific and engineering report entitled, "The Flood
Insurance Study for Galveston County, Texas and Incorporated Areas," dated
February 28, 2018 with accompanying Flood Insurance Rate Map and Flood
Boundary-Floodway Maps (FIRM and FBFM), "The Flood Insurance Study for
Harris County, Texas and Incorporated Areas," dated January 6, 2017, with
accompanying Flood Insurance Rate Maps and Flood Boundary-Floodway Maps
(FIRM and FBFM) and any revisions thereto, and "The Flood Insurance Study for
Harris County, Texas and Incorporated Areas," dated June 18, 2007, with
accompanying Flood Insurance Rate Maps and Flood Boundary-Floodway Maps
(FIRM and FBFM) and any revisions thereto, are hereby adopted by reference and
declared to be a part of this Ordinance.
Section 3. Any person who shall knowingly, willingly, or with criminal negligence
violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and upon
conviction, shall be fined in an amount not to exceed $2,000.00. Each day of violation shall
constitute a separate offense.
Section 4. In the event any section, paragraph, subdivision, clause, phrase, provision,
sentence, or part of this Ordinance or the application of the same to any person or circumstance
shall for any reason be adjudged invalid or held unconstitutional by a court of competent
jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or
provision hereof other any part or provision hereof other than the part declared to be invalid or
unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would
have passed each and every part of the same notwithstanding the omission of any and every part
of the same notwithstanding the omission of any such part thus declared to be invalid or
unconstitutional, or whether there be one or more parts.
