R96-17 A RESOLUTION OF THE CITY OF FRIEIQDSwOOD, TEXAB, SUSPENDIIQG THE EFFECTIVE DATE OF TEXAS-NEW MEICICO POWER COMPANY'8 APPLICATION FOR APPROVAL OF ITS CODII�IUNITY CHOICE TRANSITION PLAN AND STATEMENT OF INTENTf PROVIDING FOR THE GATHERING AND REVIEW OF NECESSARY INFORMATIOIQ ZN COIQNECTION THEREWITHf AUTHORIZING PARTICIPATION IN THE GULF COAST COALITION OF CITIES COMCERNING THE ELECTRIC RATES AND ACCOUNTING PRACTICES OF TEXAS-NEW MEXICO POWER COMPANY; AND AUTHORIZING PARTICIPATION IM PUBLIC UTILITY CO1rII�IZ88ION OF TEXAS DOCKET NO. 15560. * * * * * * * * * W�iEREAB, the City of Friendswood, Texas, is a regulatory authority under the Public Utility Regulatory Act and has original jurisdiction over the rates and accounting practices of Texas-New Mexico Power Company to determine if such rates and practices are fair, just, and reasonable; and WHEREAB, preliminary information indicatea that a further investigation and review of the application of Texas-New Mexico Power Company should be conducted to determine if the proposed rates and accounting orders requested are fair, just, and reasonable; and f�iiEREAB, additional information is required from the Company for analysis and review before the City can make a determination if the existing rates of Texas-New Mexico Power Company are reasonable, unreasonable, or are in any way in violation of any provision of law; if the accounting orders requested by Texas-New Mexico Power Company are reasonable; and if such rates and practices should be revised and just and reasonable rates and practices determined for Texas-New Mexico Power Company; and WHEREAB, a statement in writing has been delivered to Texas-New Mexico Power Company setting forth the reasons for suspending the utility's application and statement of intent; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF P'RIENDSWOOD, STATE OF TEXAB: Section 1. The findings and recitals set forth in the preamble hereof are hereby adopted in their entirety. Section 2. Pending hearing and decision, the proposed effective date set forth in Texas-New Mexico Power Company's Application for Approval and Statement of Intent is hereby suspended for a period of ninety (90) days after June 10, 1996, as permitted under §2.212(d) of the Public Utility Regulatory Act. Section 3. City's representatives shall have the right to obtain additional information from the Company through the filing of requests for information, which shall be responded to within ten (10) days from the receipt of such request for information. Section 4. To promote efficiency and control the costs of regulation, the City is hereby authorized to join and participate in the Gulf Coast Coalition of Cities. Section 5. The City hereby appoints Councilmember Janis Lowe and City Manager Ron Cox as its representatives to the Gulf Coast Coalition of Cities for Texas New-Mexico Power Company rate - 2 - and accounting matters. The City further ratifies the retaining of counsel, authorizes the hiring of consultants as selected by the Gulf Coast Coalition of Cities to assist the Cities in these proceedings and P.U.C. Docket No. 15560 and to take all legal and other actions on behalf of the City and its ratepayers as are deemed necessary by said Coalition in connection with this matter. Section 6. This resolution shall become effective from and after its passage. Section 7. The City Council may, from time to time, enter additional orders as may be in the public interest and necessary to the enforcement of this resolution.
