R96-8 A RESOLUTION OF TI� CITY OF FRIENDS'�YOOD, TEXAS, URGING THE HARRIS COUNTY FIAOD CONTROL DISTRICT TO I+IOVE FORWARD RAPID7�Y WITH THS RELOCATION OF Tf� MUD GULLY DRAINAGS DITCH WAICH C:URRENTLY I�'i�O�S BETfPEEN TES BRIO AND DOP SUPSRFQND SITBS. * * * * * * WHEREAS, significant portions of the Brio and DOP superfund sites are located in the city of Friendswood; and WHEREAS, the sites contain unknown quantities of buried toxic waste materials, which are known to be harmful to human health and the environment; and WHEREAS, the Mud Gully drainage ditch flows between the Brio and DOP superfund sites, and water in the ditch drains into Clear Creek, passing through Friendswood, Clear Lake and emptying into Galveston Bay; and WHEREAS, Mud Gully has served as pathway for toxic materials to escape the Brio site; and WHEREAS, ground water pumping has been instituted to halt the flow of toxic materials into Mud Gully; and WHEREAS, even though pumping has been largely successful and creek water currently complies with Texas and EPA standards, small quantities of toxic materials continue to be detected; and WHEREAS, relocation of Mud Gully around the sites would eliminate this toxic pathway; and WHEREAS, the Harris County Flood Control District has stated their intention to relocate Mud Gully; and WHEREAS, the Brio Site Task Force has agreed to contribute in excess of $2 million toward the cost of relocation; and WHEREAS, relocation of Mud Gully is in the best interests of the health and environment of Friendswood citizens because it should eliminate a leakage pathway; and WHEREAS, it is in the best interest of all parties that the project move forward as quickly as possible; R96.8/LST03 NOW, THERSFORE, BE IT RESOL�D BY THS CITY COUNCIL OF Tf� CITY OF FRIENDSWOOD, STATE OF TEXAS: That the Friendswood City Council requests that the Harris County Flood Control District take all appropriate action to move forward rapidly with the design and construction of an alternate route for Mud Gully; and FURTFIER BE IT RESOLVED: That the Harris County Flood Control District design and construct the alternate route in such a manner that no additional storm water runoff flows into Clear Creek.
