A RESOLUTION CANVASSING THE RETURNS AND DECLARING THE
RESULTS OF A SPECIAL ELECTION HELD ON JANUARY 20; 1996,
REGARDING A PROPOSITION TO AUTHORIZE THE IMPOSITION OF A
ONE-HALF OF ONE PERCENT SALES �1�iD USE TAX PURSUANT TO
SECTION 4B OF ARTICLE 5190.6, TEXAS REVISED CIVIL
STATUTES (THE "DEVELOPMENT CORPOR.ATION ACT OF 1979") FOR
THE PURCHASE, DEVELOPMENT, IMPROVEMENT, MAINTENANCE, AND
OPERATION OF THE FRIENDSWOOD CENTENNIAL PARK, AND FOR THE
MAINTENANCE AND OPERATION OF OTHER PARKS AND RECREATION
FACILITIES.

WHEREAS, a special election was held in the City of
Friendswood, Texas, on January 20, 1996, at which a proposition
was submitted to the duly qualified, resident electors of the City
for their action thereon, such proposition relating to the
imposition of a one-half of one percent sales and use tax to be
used for the purchase, development, improvement, maintenance, and
operation of the Friendswood Centennial Park, and for the
maintenance and operation of other parks and recreational
facilities; and
WHEREAS, there were cast at said apecial election 3542 votes,
of which number there were cast:
PROPOSITION NO. 1
FOR THE ADOPTION OF AN ADDITIONAL SALES
AND USE TAX WITHIN THE CITY AT THE RATE
OF ONE-HALF OF ONE PERCENT TO BE USED AS
AUTHORIZED BY SECTION 4B, ARTICLE 5190 .6,
V.T.C.S. , AS AMENDED (THE "DEVELOPMENT
CORPOR.ATION ACT OF 1979") , FOR THE
PURCHASE, DEVELOPMENT, IMPROVEMENT,
MAINTENANCE, AND OPERATION OF THE
FRIENDSWOOD CENTENNTAL PARK, AND FOR THE
MAINTENANCE AND OPERATION OF OTHER PARKS
AND RECREATION FACILITIES . . . . . . . . . . . . . 1330 votes

5190 .6, V.T.C.S. , AS AMENDED (THE
"DEVELOPMENT CORPORATION ACT OF 1979") ,
FOR THE PURCHASE, DEVELOPMENT,
IMPROVEMENT, MAINTENANCE, AND OPER.ATION
OF THE FRIENDSWOOD CENTENNIAL PARK, AND
FOR THE MAINTENANCE AND OPERATION OF
OTHER PARKS AND RECREATION FACILITIES . . . . . . . 221� votes;
and
WHEREAS, the above and foregoing totals are shown in the
official election returns of said special election heretofore
submitted to the City Council and filed with the City Secretary;
and
WHEREAS, said special election was called and held in all
respects under and in strict conformity with the Constitution and
laws of the State of Texas and of the United States; now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
TEXAS:
Section 1. The facts and matters set forth in the preamble of
this Resolution are hereby found to be true and correct.
Section 2 . The special election relating to the authority of
City Council to adopt a one-half of one percent sales and use tax
pursuant to TEx. REV. Civ. STAT. Axrr. section 4B of Article 5190 . 6, as
reflected in Proposition No. 1, has resulted as follows:

additional saZes and use tax within the City at the rate
of one-half of one percent to be used as authorized by
Section 4B, Article 5190 . 6, V.T.C.S. , as amended (the
"Development Corporation Act of 1979") , for the purchase,
development, improvement, maintenance, and operation of

the Friendswood Centennial Park, and the maintenance and
operation of other parks and recreation facilities.
Section 5. It is hereby found and determined that the NOTICE
OF MEETING relating to the regular meeting of the City Council at
which this Resolution was considered and the posting thereof, was
proper and said notice and posting are hereby authorized, approved,
resolved, ratified, and confirmed.
PASSED, APPROVED, AND RESOLVED this 22nd day of January 1996.
