A RESOLUTiON OF THE CITY OF FRIENDSWOOD, TEXAS,
SUSPENDING THE EFFECTIVE DATE OF TEXAS-NEW MEXICO
POWER COMPANY'S APPLICATION FOR APPRO�AL OF 1TS
TRANSITION PLAN AND STATEMENT OF INTENT TO DECREASE
RATES; SETTING FORTH OTHER PR4ViSIONS RELATEll
THEI2ET0; AND PROVIDING THAT THlS RESOLUTION SHALL
BECUME EFFECTIVE FROM AND AFTER I-TS PASSAGE AND
ADOPTION.
WiiEREAS, the City of Friendswood, Texas, is a regulatory authority under the
Public Urility Regulatary Act of 1495 and has original jwisdiction over the rates and
accounting practices of Texas-New Mexico Pawer Company to deternune if such rates and
practices are fair,just, and reasanable; and
WHEREAS, on Juiy 31, 1997, Texas-New Mexico Power Company filed an
Application for Approval of its Transition Plan and Statement of Intent to Decrease Rates
with the City; and
WHEREAS, Texas-New Mexico Power Company's Transition Pian and Statcment
of Intent was suspended for ninety (90) days after July 31, 1997; and
WHEREAS, further investigation and review af Texas-New Mexico Power
Company's Transition Plan and Statement of Intent to Decrease Rates should be conducted
to determine if the proposed rates, tariffs, accounting orders and other forms of relief
requested aze fair,just, and reasonable; and
WAEREAS, additiana.l information is required from the Cornpany for analysis and
review before the City can make a determination if Texas-Tiew Mexico Power Company's
rate requests are reasonable or unreasonablc; if the accounting�rders requested by Texas-
New Mexico Power Company are reasonable, unreasonable, or are in any way;in violation
of any provision of law; if the tariffs proposed are reasonable, unreasonable, ar should be
modified; and if the rates and practices of the Company should be revised and just and
reasonable rates and practices determined for Texas-New Mexico Power Cotr�pany;
NOW,THEREFORE,BE IT RES4LVED BY TAE CITY COUNCIL OF THE
CITY OF FRIENBSVVOUD, TEXAS:
�ECT[ON_l: That the findings and recitals set forth in the preamble hereof are
hereby adopted in their entirety.
�ECTiON 2: That, pending hearing and decision, the proposed effective date set
forth in Texas-New Mexico Power Company's Application for Approval of a Transition Plan
and Statement of Intent to Decrease Rates is hereby suspended for an additional periad of
thirty (30) days, as pernutted under the Public Ut�lity Regulatory Act.
SECTION 3; 'That the City Council may, from time to time, enter additional orders
as may be in the public interest and necessary to the enfarcement of this Resolution.
SE�ION 4: That this Resolurion shall be in full force and effect fram and after its
passage and adoption.
