RESOLUTION NO. 98-20 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, EXTENDING RESOLUTION NUMBER R97-38, ESTABLISHING A MORATORIUM ON THE ACCEPTANCE OF APPLICATIONS FOR AND THE ISSUANCE OF DEVELOPMENT PERMITS, BUILDING PERMITS OR CERTIFICATES OF OCCUPANCY FOR SEXUALLY ORIENTED BUSINESSES, AS ORIGINALLY PASSED ON SEPTEMBER 22, 1997, AND AS AMENDED BY RESOLUTION NUMBER R98-3 ON FEBRUARY 2, 1998, FOR AN ADDITIONAL NINETY-FIVE DAYS. * * * * * WHEREAS, the City Council of the City of Friendswood, Texas (the "City"), recognizing the right of sexually oriented businesses to have reasonable locations on which to open their businesses, and also recognizing the need to protect the balance of land uses within the City and the health, safety, and welfare of the citizens of the City; and WHEREAS, the Planning and Zoning Commission is continuing its study of the availability of locations for sexually oriented businesses within various zoning districts of the City, and within various distancing requirements from uses which should be protected from the harmful effects of such businesses operating in close proximity to one another throughout the corporate boundaries of the City; and WHEREAS, the City is finalizing its study of secondary effects of various types of sexually oriented businesses, and the likely impacts of such secondary effects on the health, safety and welfare of citizens of the City, and the final versions of ordinances to be considered for regulating such businesses; and F W D/MORATORIU M.RES/06/18/98 WHEREAS, the City Council finds that such extension is for the purposes of allowing a more complete study and is not for the purposes of delay, that no interest has been expressed to the City during the period of the moratorium by any prospective operator of any adult entertainment business, WHEREAS, the City Council finds that it is in the public interest to extend the moratorium adopted by City Council in Resolution Number R97-38, on September 22, 1997, and extended by Resolution Number R98-3, on February 2, 1998, to continue to preserve the status quo by not accepting applications for development permits, building permits and certificates of occupancy for sexually oriented businesses proposed to be located within the corporate boundaries of the City, pending full and complete public deliberation and the completion of the land use study and secondary effects study and consideration and action on all relevant ordinances; now,therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS: Section l. That the moratorium on the acceptance of development permits for sexually oriented businesses detailed in Resolution Number R97-38, as passed, approved and resolved by the City Council on September 22, 1997, as amended by Resolution Number R98-3, passed, approved and resolved by the City Council on February 2, 1998, and which moratorium is presently set to expire on June 22, 1998, is hereby extended for an additional ninety-five (95) days, and shall expire on September 18, 1998. Section 2. That the City staff and the Planning and Zoning Commission are hereby directed to complete the appropriate analyses, evaluate alternatives, and prepare recommendations as to the proper zoning districts for sexually oriented businesses based on the FWDlMORATORIUM.RESEXT2 2, City's future land use plan, adjacent land uses, the secondary effects of sexually oriented businesses, and other relevant information and report back to the City Council with their recommendations on or before August 20, 1998. Section 3. That, for purposes of this Resolution and Resolution Numbers R97-38, and R98-3, the term "adult entertainment business" shall have the same meaning as and is interchangeable with the term"sexually oriented business" as that term is defined in Texas Local Government Code, Section 243.002. Section 4. That all other provisions of Resolution Numbers R97-38 and R98-3 remain in full force and effect. Section 5. That this Resolution shall take effect immediately from and after its passage, in accordance with the provisions of the Charter of the City, and it is accordingly so resolved.
