R99-30 A RESOLUTION OF THE CITY OF FRIENDSWOOD, TEXAS, AUTHORIZING THE CITY MANAGER TO RFsQUEST UNCLAIMED FiTNDS IN THE NAME OF THE CITY FROM THE STATE COMPTROLLER. * * � * * * * * * * * * * WHSREAS, the Texas State Comptroller collects certain monies from businesses located within the City limits of the City of Friendswood; and WHEREAS, under Texas law, if those monies go unclaimed for a certain period of time they are certified property, and the City is designated as the treasury listed owner; and WHEREAS, it has come to the attention of the City that such monies presently exist at the Comptroller's Office, and the City wishes to retrieve those funds; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS: Section 1. That Ronald Cox, City Manager, be and he is hereby authorized and directed to execute and deliver to the Comptroller of Public Accounts, in the name and on behalf of the City, a claim form substantially in the form of the instrument reviewed and approved at this meeting, together with such changes as said officer may approve, such approval to be conclusively evidenced by the execution thereof. Section 2. The City Council hereby officially finds and determines that the facts and recitations in the preamble of this Resolution are true and correct and adopts the preamble as part of the operative provisions of this Resolution. Section 3. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted for the time required by law proceeding this meeting, and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by Chapter 551, Texas Government Code, as amended, and the Act. R99.30/LST03 Section 4. The Mayor of the City, or the City Manager are expressly authorized, empowered and directed from time to time to perform all acts and to execute, acknowledge, seal and deliver in the name and on behalf of the City all certificates, instruments and other documents as they may determine to be necessary or desirable to carry out the provisions of this Resolution, such determination to be conclusively evidenced by the performance of such acts and the execution of any such documents. Section 5. This Resolution shall take effect and be in full force upon and after its passage. PASSED, APPROVED, AND R$SOLVED BY CITY COUNCIL ON THIS THE 18TH DAY OF OCTOBER, 1999. Mayor Harold L.
