HomeMy WebLinkAboutOrdinance No. 93-05 ORDINANCE NO. 93-5 AM ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 84-15, AS AMENDED, ORIGINALLY ADOPTED THE 19TH DAY OF NOVEMBER, 1984, AND BEING THE ZONING ORDINANCE OF THE CITY, BY STRIKING PROVISIONS CONTAINED IN THE REGULATION MATRIX IN PARAGRAPH 2 OF SUBSECTION O OF SECTION 7 RELATING TO MINIMUM FRONT AND SIDE YARDS IN THE MFR-GHD DISTRICT (GARDEN HOME RESIDENTIAL) AND SUBSTITUTING THEREFOR NEW PROVISIONS ESTABLISHING MINIMUM FRONT AND SIDE YARDS IN SAID MFR-GHD DISTRICT, AND BY ADDING TO SAID REGULATION MATRIX IN PARAGRAPH 2 OF SUBSECTION O OF SECTION 7 A NEW FOOTNOTE KEY "F" ; PROVIDING THAT IN DISTRICT MFR-GHD THERE SHALL BE A MINIMUM FRONT YARD OF FIVE FEET (5' ) AND A MINIMUM SIDE YARD OF ZERO FEET (0� ) ; PROVIDING THAT THERE SHALL BE A MINIMUM SEPARATION OF FIVE FEET (5' ) BETWEEN BUILDINGS IN DISTRICT MFR-GHD; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2, 000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. * * * * * BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. City of Friendswood, Texas, Ordinance No. 84-15, as amended, originally adopted the 19th day of November, 1984, and being the Zoning Ordinance of the City, is hereby amended by striking from Paragraph 2 of Subsection O of Section 7 thereof (the "Regulation Matrix") the minimum front yard depth provided for District MFR-GHD (Garden Home Residential) , which provides as follows: [15B] and substituting therefor the following: 5B Section 2 . Said City of Friendswood, Texas, Ordinance No. 84- 15, as amended, is hereby further amended by striking from Paragraph 2 of Subsection O of Section 7 thereof (the "Regulation FWD\ZON AM END.ORD\32493 Matrix") the minimum side yard width for interior lots provided for District MFR-GHD (Garden Home Residential) , which provides as follows: [5] and substituting therefor the following: Section 3 . Said City of Friendswood, Texas, Ordinance No. 84- 15, as amended, is hereby further amended by adding to Paragraph 2 of Subsection O of Section 7 thereof (the "Regulation Matrix") a new footnote key "F" to provide as follows: F. A minimum of five feet (5') separation between buildings. Section 4 . Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed $2 , 000. Each day of violation shall constitute a separate offense. Section 5. In the event any clause, phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, whether there be one or more parts.
