ORDINANCE NO. 92-5 � � �� � � � � � � �
AN ORDI'NANCE OF THE CITY OF FRIENDSWOOD, TEXAS,
EXTENDING THE CITY LIMITS OF SAID CITY TO INCLUGE ALL
OF T�IE TERRTTORY WITHIN CERTAIN LIMITS AND BOUNDARIES
AND ANNEXING TO THE CITY OF FRIENDSWOOD ALL OF THE
TERRITORY WITHIN SUCH LIMITS AND BOUNDARIES; APPROVING
A SERVIGE PLAN FOR ALL OF THE TERRITORY WITHIN SUCH
LIMITS AND BOUNDARIES; CONTAINING OTHER PROVISIONS
RELATING TO THE SUBJECT; AND PROVIDING A SAVTNG AND
SEVERABILITS CLAUSE.

, THENCE S. 33° 14' W, along the West line of said Lot
63, a distance of 290.27 feet (plat call 293 .5 feet) to
the Southwest corner of said Lot 63 ;
THENCE N 88° 14' E, along the South line of Lots 63 ,
64, and 65, Slone's Second Subdivision, a distance of
708. 38 feet to a Point of Intersection of Windamere
Road at the intersection of said South line of said
Lots 63, 64, and 65 with the West line of Windamere
Road, from which intersection a stone monument was
found at N 88° 14' E, 23 .45 feet distant;
THENCE S 03° 12' 11" E, along said West line of
Windamere Road, at 0. 30 feet past a 1/2 inch iron rod
found on line, in all a distance of 69. 68 feet to a
point for corner;
THENCE N 87° 38' 21" E, crossing Windamere Road, at 47
feet past a fence corner for a Point of Intersection of
Windamere Road and continuing along a fence line
marking the Southerly right-of-way line of said
Windamere Road, in all a distance of 1140.44 feet to
the Southeast corner of the herein described tract on a
Southerly extension of the aforesaid East line of
Slone's Second Subdivision, from which corner an iron
pipe was found at a fence corner at N 87° 38' 21" E,
13 .88 feet distant;
THENCE N 34° 37' 32" E, along said Southerly extension
of the East line of Slone's Second Subdivision, a
distance of 356.83 feet to the PLACE OF BEGINNING and
containing 11.87 acres of land, more or less.
Section 2 . The plan for the extension of municipal services
into the territory annexed to and made a part of the City of
Friendswood by the provisions of this Ordinance is set forth in
the "Municipal Service Plan" attached hereto and made a part
hereof for all purposes. Such Municipal Service Plan is hereby
approved.
Section 3 . With reference to the foregoing matters, it is
the intention of the City of Friendswood and its City Council to
fully comply with all applicable provisions of the laws of the
State of Texas and the City Charter of the City of Friendswood.

Section 4. The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the
date, hour, place, and subject of this meeting of the City
Council was posted at a place convenient to the public at the
City Hall of the City for the time required by law preceding this
meeting, as required by the Open Meetings Act, Article 6252-17,
Vernon's Texas Civil Statutes, as amended; and that this meeting
has been open to the public as required by law at all times
during which this Ordinance and the subject matter thereof have
been discussed, considered, and formally acted upon. The City
Council further ratifies, approves, and confirms such written
notice and the contents and posting thereof.
Section 5. If any section or part of this Ordinance be held
unconstitutional, illegal, or invalid, or the application thereof
ineffective or inapplicable as to any territory, such
unconstitutionality, illegality, invalidity, or ineffectiveness
of such section or part shall in no wise affect, impair, or
invalidate the remaining portion or portions thereof, but as to
such remaining portion or portions, the same shall be and remain
in full force and effect; and should this Ordinance for any
reason be ineffective as to any part of the territory hereby
annexed to the City of Friendswood, such ineffectiveness of this
Ordinance as to any such part or parts of any such territory
shall not affect the effectiveness of this Ordinance as to all of
the remainder of such territory or area, and the City Council
hereby declares it to be its purpose to annex to the City of
Friendswood every part of the territory described in Section 1 of

this Ordinance, regardless of whether any other part of such
described territory is hereby effectively annexed to the City.
Provided, further, that if there is included in the general
description of territory set out in Section 1 of this Ordinance
to be hereby annexed to the City of Friendswood any territory
which is already a part of and included within the general limits
of the City of Friendswood, or which is presently part of and
included in the limits or extraterritorial jurisdiction of any
other city, town, or village, or which is not within the City of
Friendswood's jurisdiction to annex, the same is hereby excluded
and excepted from the territory to be annexed hereby as fully as
if such excluded and excepted territory were especially and
specifically described herein.

All that certain 11.87 acre tract of land being out of and a part of Sections 3 and 4 of the
I. & G. N. Railroad Company Survey, Abstract Numbers 614 and 608, respectively, Galveston
County, Texas, said 11.87 acre tract being more particularly described as follows:
BEGII3NING at a 3i4 inch iron pipe at the intersecdon of the East line of Slone's Second
Subdivision with the South line of the John Dicldnson League, Abstract No. 9, Galveston
County, Texas, which is also the North line of the aforementioned Section 3 of the I. & G. N.
Railroad Company Survey, plat of said Slone's Second Subdivision of record in Map Record 13,
Page 93 in the Office of the County Clerk of Galveston County, Texas;
THEN E S 88 deg. 29 min. 10 sec. W, along the South line of said John Dickinson
T.eague and North line of said Sections 3 and 4 of tile I. & G. N. Railroad Company Survey, a
distance of 1895.73 feet to the Northwest corner and the herein described tract on the West line
• � of Lot 63 of said Slone's Second Subdivision;
THEN E S 33 deg. 14 min. W, along the West line of said Lot 63, a distance of 290.27
feet (plat call 293.5 feet) to the Southwest corner of said Lot 63;
THEN E N 88 deg. 14 min. E,.along the South line of Lots 63, 64, and 65, Slone's
Second Subdivision, a distance of 708.38 feet to a Point of Intersection of Windamere Road at
the intersection of said South line of said Lots 63, 44, and 65 with the West line of Windamere
Road, from which intersection a stone monument was found at N 88 deg. 14 min. E, 23.45 feet
distant;
