HomeMy WebLinkAboutOrdinance No. 90-26 ORDINANCE N0. 90-26 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS , ORDINANCE N0. 87-10, PASSED AND APPROVED THE 4TH DAY OF MAY, 1987, AND BEING AN ORDINANCE PROVIDING REGULATIONS DESIGNED TO PREVENT FLOOD DAMAGES AND REDUCE THE HAZARDS OF FLOODING WITHIN THE CITY, BY ADDING TO SECTION B OF ARTICLE V A NEW SUBSECTION (4) ; PROVIDING LOWEST FLOOR ELEVATION REQUIREMENTS IN ZONES AE, A0, X SHADED, AND X UNSHADED FOR NEW CONSTRUCTION OF AND SUBSTANTIAL IMPROVEMENTS TO BUILDINGS AND STRUCTURES ; PROVIDING A PENALTY IN AMOUNT NOT TO EXCEED $1,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVER.ABILITY. �'c �'c x 4r 4c BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS : Section 1 . City of Friendswood, Texas, Ordinance 87-10, passed and approved the 4th day of r�ay, 1987, and being an ordinance providing rules and regulations designed to prevent flood damages and rer�uce the hazards of flooding , is hereby amended by adding to Section B of Article V thereof a new Subsection (4) to provide as follows : "(4) . Special Lowest Floor Elevation Requirements . a. In Zone AE, lowest floor elevations of temperature controlled areas shall be a minimum of twenty-four inches (24") above the elevation given on the latest FEMA FIRM panel for the City of Friendswood. When building location falls between elevations , interpolate to nearest one-half (1/2) foot. Lowest floor for areas not temperature controlled shall be a minimum of six inches (6") above the relevant elevation. b. In 7,one A0, lowest £loor elevations of temperature controlled areas shall be thirty-six inches (36") higher than the centerline of the road in curb and gutter streets , or high bank of roadside ditch on streets with open ditch drainage. Lowest floor of areas not temperature controlled shall be a minimum of eighteen inches (18") higher than the centerline of the road or ditch high bank as the case may be. c. In Zone X Shaded, lowest floor elevations of temperature controlled areas shall be a minimum of twenty-four inches (24") higher than the adjacent natural grade. Lowest floor of areas not temperature controlled shall be a minimum of six inches (6") higher than the adjacent natural grade. d. In Zone X Unshaded, lowest floor elevation shall be as follows : (1) On curb and gutter streets , the elevation shall be a minimum of eighteen inches (18") above the top of curb or a minimum of twelve inches (12") above the adjacent natural grade, whichever is greate.r_ . (2) On streets with open ditches , slab elevations shall be a minimum of eighteen inches (18") higher than the center of the street or a minimum of twelve inches (12") higher than the adjacent natural grade, whichever is greater. For the purposes of this Subsection (4) , the term ' adjacent natural grade ' shall mean the natural ground adjacent to the slab at its centerline paralleling the front of the structure. Natural ground is assumed to be the ground surface existing prior to placement of the building pad. " Section 2. Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction, shall be fined in an amount not to exceed $1, 000. Each day of violation sha11 constitute a separate offense. Section 3. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence, or part of -2- this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudge� invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whol� or any part or provision hereof other than the part declared to be invalid or unconstitutional ; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission o£ any such part thus declared to be invalid or unconstitutional , or whether there be one or more parts .
