BY HURRICANE GILBERT.
w�REAS, the City of Friendswood may sus�ain substantial damage
and destruction frcgn Hurricane Gi]_bext, and the general public may
suffer a severe loss af property, goods, and services; and,
WI-�REAS, indiscriminate vendors, merchants, landlords, or other
persons selling, or otfering for sale, either retail or wholesale,
l.ease, rent or otherwise providing goods or services to the general
public for co�npensation or consideration at an increased rate alx�ve and
beyond any reasonable price or rate; and,
Wf-�REAS, the increased prices or rates are, or would be�
unreasonable and would not be in the best interest;
WHg,REE�S, the City Council hereby finds and deternunes that an
emergericy exists requiring the enactznent of price control measures as
contained in this ordinance in order to preserve and protect public
health, safety, and welfare during such period of calamity caused by
Hurricane Gilbert; ar.d
NOW, TF�REI,�'ORE, BE IT ORDAINID BY TfiE CITY OOtINCIL OF THE CITY OF
FRIE�IDSWOOD, 'I'EXAS:
SECTION 1. The facts and mat�ers set forth in the preamble of
, this or.dinance are hereby found �o be txue and correct.
SDC`i'ION 2. It shall be unlawful for any vendor, merchant,
landlord and other person selli.ng or offering to sell, whether retail
or wholesale, goods or services at a rate or price in excess of those
rates or prices prevailing in City of Friendswood, Galveston County on
September 16, 1988.
SF..CTION 3. It shall be unlawful for any vendor, merchant,
landlord or other person or persons to lease as lessor, rent or
otheYwise provide real propex-ty, including but not limited to
apartn�nts, condcsninium.s, duplexes, four-plexes, or any ather dwelling,
intended for hiucian habitation, at a rate, price or term i.n excess of
those rates, prices or tezms which were in effect on Sept�nber 16, 1988.
SF,CTION 4. This ordi.nance shall be and beccm� effective upon
adoption of this ordinance. Due to emergency conditions prevailing at
this tizr�, requirc-�nent of notice and publication is hereby waived.
S�ION 5. Any person who sha11 violate any provision of this
Ordinance sha11 be de�r�ed guilty of a misdemeanor and upon conviction
shall be fine.cl in a penal sinn not to exceed $500.00 per violation.
