HomeMy WebLinkAboutOrdinance No. 88-08 ORDINANCE N0. gg_g AN ORDINANCE FINDING AND DETERMINING THAT PUBLIC CON- VENIENCE AND NECESSITY NO LONGER REQUIRE THE CONTINUED EXISTENCE OF THAT PORTION OF SAN MIGUEL DRIVE IN SAN JOAQUIN ESTATE SUBDIVISION, SOUTH OF SAN JOAQUIN PARKWAY, AS SHOWN BY MAP RECORD N0. 17, MAP NOS. 63 AND 64, OF THE DEED RECORDS OF GALVESTON COUNTY, TEXAS ; VACATING, ABANDONING, AND CLOSING SAID PORTION OF SAN MIGUEL DRIVE; AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY SECRETARY TO ATTEST A QUIT CLAIM DEED CONVEYING SAID ABANDONED ROADWAY TO DONALD C. DAWSON AND JOHN L. DAWSON, THE ABUTTING PROPERTY OWNERS OF SAID ROADWAY, FOR FAIR MARKET VALUE; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT. � � k x �c WHEREAS, Donald C. Dawson and John L. Dawson, the abutting property owners of the below described roadway, have petitioned the City of Friendswood, Texas, to vacate, abandon, and close the said below described roadway; and WHEREAS, the City Council has determined that the hereinafter described roadway should be vacated, abandoned, and closed for the reason that the same is no lon�er needed by the City; and WHEREAS , said roadway has been appraised by a qualified appraiser and the appraisal report of such appraiser has been taken into consideration by the City Council ; now, therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS : Section l . The City Council of the City of Friendswood, Texas, hereby finds and determines that public convenience and necessity no longer require the continued existence of the hereinafter described roadway. Section 2. The roadway described in Exhibit "A" attached hereto and made a part hereof is hereby vacated, abandoned, and closed. Secti.on 3. The Mayor is hereby authorized to execute and the City Secretary is hereby authorized to attest a quit claim deed, conveying the hereinabove described abandoned roadway to Donald C. Dawson and John L. Dawson, sole owners of lots adjacent to that portion of San Miguel Drive as descri�ed herein for a consideration of $11 ,000. 00, same being the fair market value of said roadway. Section 4. This ordinance shall become effective upon: (a) final approval by the City of Friendswood Planning and Zoning Commission of the proposed vacation and replat of San Joaquin Estates Sections 1 and 3 as recorded in Map Records No. 17, Map Nos . 63 and 64, of The Deed Records of Galveston County, Texas ; and b) proof of ownership by Donald C. Dawson and John L. Dawson of all lots adjacent to San Aliguel Drive as described herein, said proof to be provided within 180 days from the date of adoption of this ordinance.
