ORDINANCE NO. 2016-38
AN ORDINANCE APPROVING AN INTERLOCAL
AGREEMENT ADJUSTING THE BOUNDARIES OF THE
CITY'S TERRITORIAL LIMITS BETWEEN THE CITY OF
FRIENDSWOOD, TEXAS, AND THE CITY OF LEAGUE
CITY, TEXAS- AUTHORIZING THE MAYOR TO
EXECUTE THE AGREEMENT AND THE CITY
SECRETARY TO ATTEST; AND PROVIDING AN
EFFECTIVE DATE,
WHEREAS the City of Friendswood, Texas has received a request from the owners of
property lying within the corporate boundaries of the City of League City, Texas, to enter into an
interlocal agreement with the City of League City, Texas in order to adjust their respective
corporate boundaries, whereby such property shall be disannexed by the City of League City,
Texas and annexed into the corporate boundaries of the City of Friendswood, Texas; and
WHEREAS, the City Council of the City of Friendswood, Texas, finds and determines
that the exchange of boundaries is in the best interest of the health, safety, morals and welfare of
the citizens of the City of Friendswood, and does, by this ordinance, approve such interlocal
'agreement, a true and correct copy of which is attached hereto and incorporated as Exhibit"A."
BE IT ORDAINED BY THE*CITY COUNCIL OF THE CITY OF FRIENDSWOOD
STATE OF TEXAS:
Section 1. That the Mayor and City Secretary are hereby authorized and directed to
execute and attest, respectively, the Boundary Agreement by and between the City and the City
of League City, Texas,, a true and correct copy of which is attached hereto and incorporated as
Exhibit"A."

e do . That the City Secretary is hereby directed to effectuate an amendment of
the City's Official Map to incorporate the changes effected by the Boundary Agreement and to
file copies thereof with the County Clerks of Galveston and Harris Counties, Texas.
Section 3. That this ordinances all become effective immediately upon its passage.

BOUNDARY AGREEMENT BETWEEN THE CITY OF ,
RELEASING TEXAS AND THE CITY OF LEAGUE CITY,TEXAS
ACCEPTING CORPORATE LIMITS.

WHEREAS, the City of Friendswood, Texas ("Friendswood") is a home-rule city
situated within the Counties of Galveston and Farris, Texas; and
WHEREAS, the City of League City, Texas ("League City") is a home-rule city situated
within the Counties of Galveston and Farris, Texas; and
WHEREAS, Friendswood and League City share common boundaries; and
WHEREAS, Friendswood has received a request from Tommy David Caudill and
Lambert Clinton Titzman, whose property lies within the corporate boundaries of League City
and is immediately adjacent and contiguous to the corporate boundaries of Friendswood,
requesting the disannexation of the property by League City and annexation by Friendswood to
facilitate the development of the property; and
WHEREAS, municipalities in Texas are authorized and empowered, pursuant to Chapter
43 of the Texas Local Government Code,to exchange area with other municipalities; and
WHEREAS Friendswood and League City have each reviewed their respective
corporate boundaries and the location of the area which is the subject of this Boundary
Agreement and have determined that such tract would be better served by the municipal services
of Friendswood; and
WHEREAS, Section 43.031 of the Texas Local Government Code authorizes adjacent
municipalities to make mutually agreeable changes in their boundaries of areas that are less than
1,000 feet in width; and
WHEREAS, the tract of land subject to this Boundary Agreement and fully described in
Exhibit"A."is less than 1,000 feet in width; and
WHEREAS Friendswood and League City desire to adjust their corporate boundary
lines, whereby League City will release land from its corporate limits to be relinquished to and
become part of the corporate limits of Friendswood, and Friendswood will accept this land from
League City to become part of the corporate limits of Friendswood; and
WHEREAS, the respective governing bodies of the cities hereby determine that this
agreement is in the best interest of the health, safety, morals and welfare of the citizens of the
respective cities and hereby authorize the mayor of each city to execute this; and

WHEREAS this agreement m is made under the authority granted by and pursuant to the
Texas Interlocal Cooperation Act, Chapter 791 of the Texas Government Code, as amended,
providing for cooperation between local governmental bodies for beneficial governmental
purposes;
THEREFORE, IT IS MUTALLY AGREED BY THE CITY OF
FRIENDSWOOD AND THE CITY OF LEAGUE CITY:

SECTION 1.
Pursuant to Sections 43.021 and 43.031 of the Texas Local Government Code, the City of
Friendswood and the City of League City hereby agree that the boundaries between the cities
will be adjusted as depicted in Exhibit "A", which is attached hereto and incorporated herein for
all purposes.

SECTION 2.
E.
In accordance with the terms of this Boundary Agreement, the City of League City
hereby relinquishes approximately 4.4365 acres described in Exhibit "A" to the City of
Friendswood and disannexes and discontinues such property as p art of the City of League City.
The City of Friendswood accepts and annexes the land depicted on Exhibit"A" into its corporate
limits.
SECTION 3.
The respective governing bodies of the Cities of Friendswood and League City shall tape
appropriate action to effectuate the terms of this Boundary Agreement through the adoption of an
official map ("Official Map") showing their respective boundaries as required by Section 41.001
of the Texas Local Government Code. The official Map of each City shall be filed by each
respective City with the appropriate county clerk(s) within thirty (30) days of adoption of the
City's Official Map, and a copy of each City's ordinance adopting and authorizing the execution
of this.Boundary Agreement, after the effective date, shall be filed in the deed records of the
appropriate counties where the Cities are situated.
SECTION . 3
E
The City of Friendswood and the City of League City do hereby covenant and agree to
protect,preserve, and defend the herein depicted boundary adjustment.
SECTION 5.
The City of Friendswood and the City of League City agree and that the adoption by both
cities of this Boundary Agreement, and the boundary changes resulting there from do not
mitigate, diminish or lessen any way the rights that either party may have, at law or in equity, to
challenge or contest any other annexations, attempted annexations, or extraterritorial jurisdiction
claims made by the other party.

SECTION 6.
This Boundary Agreement shall become effective and shall become a binding agreement
upon the City of Friendswood and the City of League City by the adoption of same in regular
open city council meetings of the City of Friendswood and the City of League City.
SECTION 7.
This Boundary Agreement, upon adoption by both cities, shall be executed in duplicate-
originals by the Mayor of each city.
