AN ORDINANCE AMENDING SECTION 3-17 OF ARTICLE II OF
CHAPTER 3 OF THE CODE OF ORDINANCES OF THE CITY OF
FRIENDSWOOD, TEXAS, BY STRIKING THEREFROM THE
DEFINITION OF "RUNNING AT LARGE OR AT LARGE" AND
SUBSTITUTING THEREFORE A NEW DEFINITION OF "RUNNING
AT LARGE OR AT LARGE;" PROVIDING THAT "RUNNING AT
LARGE OR AT LARGE" SHALL MEAN ANY DOG NOT UNDER
VOICE AND SIGHT CONTROL OF ITS OWNER OR KEEPER ON
ITS OWNER' S OR KEEPER' S PRIVATE PROPERTY UNLESS
SUCH DOG IS CONFINED OR IN CONFINEMENT, OR, ANY DOG
NOT UNDER LEASH CONTROL OF ITS OWNER OR KEEPER ON
PROPERTY OTHER THAN ITS OWNER'S OR KEEPER'S PRIVATE
PROPERTY; PROVIDING FOR SEVERABILITY; PROVIDING A
PENALTY OF AN AMOUNT NOT TO EXCEED $200.00 FOR EACH
DAY OF VIOLATION OF ANY PROVISION HEREOF; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS :
Section l . Section 3-17 of Article II of Chapter 3 of
the Code of Ordinances of the City of Friendswood , Texas, is
hereby amended by striking therefrom the definition of "Running
at large or at large," which provides as follows :
["Running at large or at large shall mean any dog not
under voice and sight control of its owner or keeper on its
owner' s or keeper' s private property, or, any dog not under
leash control of its owner or keeper on property other than its
owner' s or keeper' s private property."]
and substituting therefor the following :
"Running at Iarge or at large shall mean any dog not
under voice and sight control of its owner or keeper on its
owner' s or keeper' s private property unless such dog is
confined or in confinement , or, any dog not under leash control
of its owner or keeper on property other than its owner' s or
keeper' s private property."
Section 2. In the event any section, paragraph,
subdivision, clause, phrase, provision, sentence, or part of
this Ordinance or the application of the same to any person or
circumstance shall for any reason be adjudged invalid or held
unconstitutional by a court of competent jurisdiction, it shall
not affect , impair, or invalidate this Ordinance as a whole or
any part or provision hereof other than the part declared to be
invalid or unconstitutional ; and the City Council of the City
of Friendswood, Texas, declares that it would have passed each
and every part of the same notwithstanding the omission of any
such part thus declared to be invalid or unconstitutional, or
whether there be one or more parts.
Section 3. Any person who shall violate any provision
of this Ordinance shall be deemed guilty of a misdemeanor and
upon conviction, shall be fined in an amount not to exceed
$200.00. Each day of violation shall cons titute a separate
offense.
Section 4. Emergency. The City Council of the City of
Friendswood hereby finds and determines that an emergency and
urgent public necessity exists which requires consideration of
this Ordinance on one reading for the reason that recent
attacks by dogs within the City have and continue to endanger
persons and other animals of bodily injury; failure to
specifically require that dogs be confined unless under the
control of their owners or keepers is necessary to insure
public health and safety.
PASSED, APPROVED, AND ADDOPTED on this 6th day
of July , 1987.
