HomeMy WebLinkAboutOrdinance No. 86-11 ORDINANCE N0. 86-11 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE N0. 84-15, PASSED AND APPROVED NOVEMBER 19, 1984, AND BEING THE ZONING ORDINANCE OF THE CITY, BY STRIKING THEREFROM ALL OF SUBSECTION y OF PARAGRAPH 1 OF SUBSECTION K OF SECTION 8 AND SUBSTITUTING THEREFOR A NEW SUBSECTION y; PROVIDING A DEFINITION FOR "NEW BUSINESS" ; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $1 ,000 FOR EACH DAY OF VIOLATION FOR ANY PROVISION HEREOF. � � � � � BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS : Section l . City of Friendswood, Texas , Ordinance No. 84-15, passed and approved the 19th day of November, 1984, and being the Zoning Ordinance of the City, is hereby amended by striking therefrom all of Subsection y af Paragraph 1 of Subsection K of Section 8, which provides as follows : ["y. New Business . A project or undertaking which involves t e use of any property, building, or structure, permanent or temporary, for the primary purpose of conducting in said building or structure or on said property a legitimate commercial enterprise, or other non-residential use, in compliance with all ordinances and regulations of the City of Friendswood, and when the primary use of said property, building, or structure at such geographical location has not existed for a period exceeding sixty (60) days . For the purposes of this subsection, expansion of an existing building or structure shall constitute a new business unless such expansion increases the size of the area devoted to the primary use, in building floor square footage, by not less than fifty percent (SO%) . Section 2. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence, or part of . ' . , this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional ; and the City Council of the City of Friendswood, Texas , declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, or whether there be one or more parts . Section 3. Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction, shall be fined in an amount not to exceed $1,000.00. Each day of violation shall constitute a separate offense. PASSED AND APPROVED on first reading this 21st day of July , 1986. PASSED AND APPROVED on second reading this 4th day of August , 1986.
