AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS,
ORDINANCE N0. 84-15, PASSED AND APPROVED THE 19TH DAY
OF NOVEMBER, 1984, AND BEING THE ZONING ORDINANCE OF
THE CITY, BY STRIKING THEREFROM ALL OF THE FIRST
PAR.AGRAPH OF SUBSECTION c OF PARAGRAPH 2 OF
SUBDIVISION I OF SECTION 8 AND SUBSTITUTING THEREFOR A
NEW FIRST PARAGRAPH THEREOF; PROVIDING THAT
LANDSCAPING REQUIREMENTS FOR OFF-STREET PARKING SHALL
NOT APPLY IN THE INDUSTRIAL DISTRICT; PROVIDING FOR
SEVERABILITY; AND PROVIDING A PENALTY OF AN AMOUNT NOT
TO EXCEED $1,000 FOR EACH DAY OF VIOLATION OF ANY
PROVISION HEREOF.

BE IT ORDAINED BY THE CITY COUNCIL BY THE CITY OF FRIENDSWOOD,
STATE OF TEXAS :
Section l . City of Friendswood, Texas , Ordinance No.
84-15, passed and approved the 19th day of November, 1984, is
hereby amended by striking therefrom all of the first paragraph
of Subsection c of Paragraph 2 of Subdivision I of Section 8,
which provides as follows :
["c. Off-Street Parkin Landsca in : Al1 areas that
are used or par ing or disp ay o vehicles , boats,
construction equipment or production equipment shall
conform to the minimum landscaping requirements in
this section. Areas that are of a drive-in nature
such as filling stations , grocery and dairy stores,
banks , and restaurants also shall conform to the
minimum landscape requirements in this section." ]
and substituting therefor the following :

Section 2. In the event any section, paragraph,
subdivision, clause, phrase, provision, sentence, or part of
this Ordinance or the application of the same to any person or
circumstance shall for any reason be adjudged invalid or held
unconstitutional by a court of competent jurisdiction, it shall
not affect, impair, or invalidate this Ordinance as a whole or
any part or provision hereof other than the part declared to be
invalid or unconstitutional ; and the City Council of the City
of Friendswood, Texas , declares that it would have passed each
and every part of the same notwithstanding the omission of any
such part thus declared to be invalid or unconstitutional, or
whether there be one or more parts .
Section 3. Any person who shall violate any provision of
this Ordinance shall be deemed guilty of a misdemeanor and upon
conviction, shall be fined in an amount not to exceed
$1 ,000.00. Each day of violation shall constitute a separate
offense.
