HomeMy WebLinkAboutOrdinance No. 86-04 ORDINANCE N0. g6-4 AN ORDINANCE ADOPTING THE STANDARD FIRE PREVENTION CODE, 1985 EDITION, INCLUDING APPENDICES, AS PUBLISHED BY THE SOUTHERN BUILDING CODE CONGRESS INTERNATIONAL, INC. , SAVE AND EXCEPT SECTION 105 THEREOF; ESTABLISHING RULES AND REGULATIONS DESIGNED TO PROTECT PERSONS AND PROPERTY FROM HAZARDS OF FIRE; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $1,000.00 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; REPEALING ALL ORDI- NANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR SEVERABILITY. � � � � � , , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, • ` STATE OF TEXAS : Section 1 . The 1985 Edition of the Standard Fire Prevention Code, including appendices , as published by the Southern Build- ing Code Congress International , Inc. , a copy of which is attached hereto and made a part hereof for all purposes , an authentic copy of which has been filed with the City Secretary, is hereby adopted and made a part of this Ordinance, save and except section 105 thereof. Section 2. Penalty. Any person, firm, corporation or agent who shall violate or cause to be violated any provision of this Ordinance, or who shall fail to comply 'herewith or with any of the requirements hereof, shall be deemed guilty of a misdemeanor and, upon conviction thereof, sk�all be fined in an amount not to exceed $1,000.00. Each such person, firm, corpo- ration or agent shall be deemed guilty of a separate offense for each day during which any violation of any of the provi- sions of this Ordinance is committed or continued. Section 3. All ordinances or parts of ordinances incon- sistent or in conflict herewith are, to the extent of such inconsistency or conflict, hereby repealed. Section 4. In the event any section, paragraph, subdivi- sion, clause, phrase, provision, sentence or part of this Ordinance or the application of the same to any person or cir- cumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be A ' invalid or unconstitutional ; and the City Council of the City of Friendswood, Texas , declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, or whether there be one or more parts .
