AN ORDINANCE AMENDING THE FRIENDSWOOD CITY CODE BY
STRIKING THEREFROM PARAGRAPH (a) OF SECTION 3-35 AND
ALL OF SECTION 3-36 OF ARTICLE II OF CHAPTER 3 AND
SUBSTITUTING THEREFOR A NEW PA.R.AGRAPH (a) OF SECTION
3-35 AND A NEW SECTION 3-36; PROVIDING THAT LICENSED
DOGS WHICH HAVE BEEN IMPOUNDED SHALL BE HELD AT LEAST
FIVE (5) DAYS PRIOR TO SALE OR DESTRUCTION; PROVIDING
FOR IMPOUNDMENT FEES FOR ANIMALS CAUGHT RUNNING AT
LARGE IN THE AMOUNT OF $7. 50 PER DAY OR PART THEREOF
PLUS $10.00 FOR THE FIRST IMPOUNDMENT, $20.00 FOR THE
SECOND IMPOUNDMENT, AND $30.00 FOR THE THIRD AND
SUBSEQUENT IMPOUNDMENTS; PROVIDING A PICK-UP CHARGE OF
$26.00 FOR COLLECTION OF ANIMALS RUNNING AT LARGE
REQUIRED TO BE IMPOUNDED BETWEEN THE HOURS OF 5 :00
P.M. AND 8:00 A.M. MONDAYS THRU FRIDAYS AND ANY TIME
ON SATURDAYS AND SUNDAYS ; PROVIDING OTHER NIATTERS
RELATED TO THE SUBJECT; PROVIDING FOR SEVERABILITY;
PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $200.00
FOR VIOLATION OF ANY PROVISION HEREOF.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS :
Section 1 . The Frienc�swood City Code is hereby amended by
striking therefrom all of paragraph (a) of Section 3-35 of
Article II of Chaptsr 3, which provides as follows :
[Section 3-35 Impoundment
(a) Licensed dogs which have been impounded shall be
held for a period o£ at least seven (7) days after capture
before such dogs are disposed of by sale or destruction. ]
and substituting therefore the following :
Section 3-35 Impoundment
� Licensed do�;s which have been impounded shall be
held for a period of at least five (S) days after capture
before such dogs are disposed of by sale or destruction.
Section 2. The Friendswood City Code is hereby a.mended by
striking therefrom all of Sectian 3-36 of Article II of Chapter
3, which provides as follows :
[Sec . 3-36. Release of quarantined and impounded animals .
If a quarantined or impounded animal is found to be freP
from rabies or other infectious or contagious deseases , the
humane officer or his designee shall release it to the owner
following the quarantine or i.mpoundment period as specified in
this article if:
(a) The owner pays the pound fee for each dog or cat so
redeemed as follows :
(1) First impoundment. . . . . . . . . . . . . . . . . . . . . . . . . . .$10.00
(2) Second impoundment. . . . . . . . . . . . . . . . . . . . . . . . . .$20.00
(3) Third and subsequent impoundments . . . . . . . . . . .$30.00
These fees shall be in addition to any applicable tax or
fine, if any, and in addition to the pound fee, the owner shall
pay three dollars ($3.00) for each dog or cat for each day ar
part vf a day after the first day which such dog or cat may be
i.mpounded.
(b) The owner has an unexpired rabies vaccination
certificate and license for the animal or the ani�ual is
vaccinated against rabies by a licensed veterinarian at the
owner' s expense and a city or county license for the animal is
obtained;
(c) The owner presents proper identification and proof of
ownership ; and
(d) All fees , costs or charges incurred have been paid by
the owner of the ani�nal. ]
and substituting therefor the following :
Sec . 3-36. Release of quarantined and impounded animals.
If a quarantined or impounded animal is found to be free
from rabies or other infectious or contagious deseases , the
humane officer or his designee shall release it to the owner
followin� the quarantine or impoundznent period as specified in
this article if:
(� The owner pays a pound fee for each animal so redeemed
as follows :
(� First impoundment . .$10.00
(2) Second impoundmPnt for same animal . . . . . . . . . .$20.00

� Third and subsequent impoundments for
same animal . . . . .$30. 00
These fees shall be in addition to any applicable tax or
fine, if any, and in addition to the pound fee, the owner shall
pay Seven and 50/100 Dollars ($7. 50) for each do� or cat for
each day or part of a day after the first day which such dog or
cat may be impounded.
(� The owner pays the after hours pick-up fee of $26.00
for each do� or cat so redeemed if such do� or cat was
impounded between the hours of 5 :00 p .m. and 8 :00 a.m. Monday
thru Friday or at any time on a Saturdav or Sunda .
� The owner has an unexpired rabies vaccination
certificate and license for the animal or the animal is
vaccinated against rabies by a licensed veterinarian at the
owner' s expense and a city or countv license for the animal is
obtained ;
� The owner presents proper identification and proof of
ownership ; and
� All fees , costs or char�es incurred have been paid b
the owner of the animal .
Section 3. Severability. Should any section or
provision of this Ordinance be adjudged invalid or
unconstitutional , such decision shall not affect the validity
of this Ordinance as a whole or any part thereof other than the
part so declared to be invalid or unconstitutional .
Section 4. Penalty. Any person violating any provision
of this Ordinance, or any person failing to remit to the City
the fees provided herein for any animal impounded when owned by
such person, shall be deemed guilty of a misdemeanor and, upon
conviction thereof, shall be fined in an amount not to exceed
$200.00.
