AN ORDINANCE AMENDING THE FRIENDSWOOD CITY CODE BY
STRIKING THEREFROM ALL OF SECTION 3-36 OF ARTICLE II
OF CHAPTER 3 AND SUBSTITUTING THEREFOR A NEW SECTION
3-36; PROVIDING FOR IMPOUNDMENT FEES FOR ANIMALS
CAUGHT RUNNING AT LARGE IN THE AMOUNT OF $7 . 50 PER DAY
OR PART THEREOF PLUS $10.00 FOR THE FIRST IMPOUNDMENT,
$20.00 FOR THE SECOND IMPOUNDMENT, AND $30.00 FOR THE
THIRD AND SUBSEQUENT IMPOUNDMENTS ; PROVIDING A PICK-UP
CHARGE OF $26.00 FOR COLLECTION OF ANIMALS RUNNZNG AT
LARGE REQUIRED TO BE IMPOUNDED BETWEEN THE HOURS OF
5:00 P.M. AND 8: 00 A.M. MONDAYS THRU FRIDAYS AND ANY
TIME ON SATURDAYS AND SUNDAYS ; PROVIDING OTHER MATTERS
RELATED TO THE SUBJECT; PROVIDING FOR SEVERABILITY;
PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $200.00
FOR VIOLATION OF ANY PROVISION HEREOF; AND DECLARING
AN EMERGENCY.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS :
Section 1 . The Friendswood City Code is hereby amended by
striking therefrom all of Section 3-36 of Article II of Chapter
3, which provides as follows :
[Sec. 3-36. Release of quarantined and impounded animals .
If a quarantined or impounded animal is found to be free
from rabies or other infectious or contagious diseases, the
humane officer or his desi.gnee shall release it to the owner
following the quarantine or impoundment period as specified in
this article if:
(a) The owner pays the pound fee for each dog or cat so
redeemed as follows :
(1) First impoundment. . . . . . . . . . . . . . . . . . . . . . . . . . .$10.00
(2) Second impoundment. . . . . . . . . . . . . . . . . . . . . . . . . .$20. 00
(3) Third and subsequent impoundments . . . . . . . . . . .$30.00
These fees shall be in addition to any applicable tax or
fine, if any, and in addition to the pound fee, the owner shall
pay three dollars ($3.00) for each dog or cat for each day or
part of a day after the first day which such dog or cat may be
impounded.
(b) The owner has an unexpired rabies vaccination
certificate and license for the animal or the animal is
vaccinated against rabies by a licensed veterinarian at the
owner' s expense and a city or county license for the animal is
obtained ;
(c) The owner presents proper identification and proof of
ownership ; and
(d) Al1 fees , costs or charges incurred have been paid by
the owner of the animal. ]
and substituting therefor the following :
Sec. 3-36. Release of quarantined and impounded animals.
If a quarantined or impounded animal is found to be free
from rabies or other infectious or conta�ious deseases , the
humane officer or his designee shall release it to the owner
following the quarantine or impoundment period as specified in
this article if:
(a� The owner pays the pound fee for each dog or cat so
redeemed as follows :
(1) First impoundment. . $10.00
(2 Second impoundment. . $20.00
� Third and subsequent impoundments . . . . . . . . . . .$30.00
These fees shall be in addition to any applicable tax or
fine, if any, and in addition to the pound fee, the owner shall
pay Seven and 50/100 Dollars ($7. 50) for each dog or cat for
each day or part of a day after the first day which such dog or
cat may be impounded.
� The owner pays th� after hours pick-up fee of $26.00
for each do� or cat so redeemed if such do� or cat was
impounded between the hours of 5:00 p .m. and 8 :00 a.m. Monday
thru Friday or at any time on a Saturday or Sunday.
(� The owner has an unexpired rabies vaccination
certificate and license for the animal or the animal is
vaccinated a�ainst rabies by a licensed veterinarian at the
owner' s expense and a city or county license for the animal is
obtained ;
� The owner presents proper identification and proof of
ownership ; and

� All fees , costs or charges incurred have been paid b
the owner of the animal .
Section 2. Severability. Should any section or
provision of this Ordinance be adjudged invalid or
unconstitutional, such dec�sion shall not affect the validi.ty
of this Ordinance as a whole or any part thereof other than the
part so declared to be invalid or unconstitutional .
Section 3. Penalty. Any person violating any provision
of this Ordinance, or any person failing to remit to the City
the fees provided herein for any animal impounded when owned by
such person, shall be deemed gui.lty of a misdemeanor and, upon
conviction thereof, shall be fined in an amount not to exceed
$200.00.
Section 4. Emergency. The City Council of the City of
Friendswood, Texas , hereby finds and determi.nes that an
emergency exists r�quiring consideration of this Ordinance on
one reading for the reason that the City has been required to
locate an alternate impoundment facility for animals found
running at large and, because it has not appropriated funds for
additional operating expenses for a pound, the establishment of
the foregoing is necessary to meet the expense of housing such
animals at thP alternate facility.
