AN ORDINANCE EXTENDING THE CITY LIMITS OF THE CITY OF FRIENDSWOOD, TEXAS , TO INCLUDE ALL LAND AREA WITHIN CERTAIN LIMITS AND BOUNDARIES AND ANNEXING TO THE CITY OF FRIENDSWOOD ALL OF THE AREA WITHIN SUCH LIMITS AND BOUNDARIES ; APPROVING A SERVICE PLAN FOR ALL OF THE AREA WITHIN SUCH LIMITS AND BOUNDARIES ; AND PROVIDING A SAVING AND SEVERABILITY CLAUSE . , WHEREAS , the City Council of the City of Friendswood, Texas has , following due notice and publication in accor.dance with the requirements of State law, Article 970a V .A.T. S . , conducted two ( 2) public hearings regarding the City ' s intended annexation of certain land and properties located contiguous to the City and within the City ' s Extraterritorial Jurisdiction; and WHEREAS , public hearings were conducted before the City Council on October 17 , 1983 , at 7 : 00 o ' clock p .m. and on October 24 , 1983 , at 7 : 00 o' clock p.m. , at Friendswood City Hall , 109 Willowick Avenue , Friendswood , Texas ; and WHEREAS , the City of Friendswood has , in accordance with State law, Article 970a V.A.T. S . , complied with all procedural requirements regarding the annexation of territory , including the preparation of a plan for extension of municipal services into the area annexed to the City; and WHEREAS , the City intends to fulfill those obligations imposed upon it by State law rega.rding newly annexed areas , including timely provision of municipal s�rvices as required by law; and WHEREAS , the City Council finds and determines that the annexation intended by this Ordinance is in the best interests of the City of Friendswood and berlefits the health , safety , and welfare of the citizens of said City; NOW, THERFFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE C1TY OF FRIENDSWOOD, TEXtiS : Secticn ]_. That the boundarie,� and limi�s of th.e City of Friendswo�d are hereby extended to embrace and include the fo]_1�w- ing described ar�ea of lar�d , and the following described land is hereby annexed to and made a p`rt of -the City of Frienasuraod, to �a�.t : FIELD NOTES ON APPROXIMATELY 750 ACRES OF LAND, Situated in the Thomas Choate Survey, Abstract 12, John Dickinson Survey, Abstract 15, and Sarah McKissick Survey, Abstract 151, all situated in Harris County, Texas, and Being More Particularly Described by Metes & Bounds as Follows: BEGINNING at a point which is a common point for Thomas Choate Survey, Abstract 12, John Dickinson Survey, Abstract 15, and Sarah McKissick Survey, Abtract 151; THENCE in a southeasterly direction along a line that intersects the common line between the Fred J. Heyne tract and the Webster Ranch Corp. tract at the northeast right-of-way line of Park Road, Said point also being the most west- erly point of the Webster Ranch Corp. tract and the most northerly point of the Fred J. Heyne tract; THENCE in a southeasterly direction along the northeast right-of-way line of Park Road to a point which intersects the extension of a line between Fred J. Heyne tract and J. 0. Webb tract; THENCE in a southeasterly direction along the common line between Fred J. Heyne tract and J. 0. Webb tract to the centerline of Clear Creek; THENCE in a southwesterly direction along the centerline of Clear Creek to a point that intersects a line 500 feet south of the north right-of-way line of F.M. 528, said line parallels F.M. 528; THENCE in a northeasterly direction along said parallel line which is 500 feet from the north right-of-way line of F.M. 528 to a point where said parallel line intersects the most easterly line of the Thomas Choate Survey, Abstract 12, said line also being the most northwesterly line of the August Whitlock Survey, Ab- stract 794; THENCE in a southerly direction along the common boundary line of the Thomas Choate Survey, Abstract 12 and the August Whitlock Survey, Abstract 794 to a point that intersects the most northerly line of the John Dickinson Survey, Ab- stract 15; THENCE in a westerly direction along the most northerly line of the John Dickinson Survey, Abstract 15 to the PLACE OF BEGINNING, and containing approximately 750 Acres of Land. Prepared by COENCO, Inc. Consulting Engineers Date: 26 September 1983 Section 2 . The plan for extension of municipal services into the area annexed to the City of Friendswood by the provi- sions of this Ordinance is set forth in the Municipal Service Plan" attached hereto and made a part hereof for all purposes . Such Municipal Service Plan is hereby approved. , ' Section 3 . If any section or part of this Ordinance be held unconstitutional , illegal or invalid, or the application thereof ineffective or inapplicable as to any territory , such unconstitu- tionality, illegality , invalidity , or ineffectiveness of such section or part shall in no wise affect , impair or invalidate the remaining portions , the same shall be and remain in full force and effect; and should this Ordinance for any reason be ineffective as to any part of the area hereby annexed to the City of Friendswood, such ineffectiveness of this Ordinance as to any such part or parts of any such area shall not affect the effectiveness of this Ordi- nance as to all of the remainder of such area, and the City Council hereby declares it to be its purpose to annex to the City of Friendswood every part of the area described in Section 1 of this Ordinance , regardless of whether any other part of such described area is hereby effectively annexed to the City. Provided, further, that if there is included in the general description of territory • set out in Section 1 of this Ordinance any land ar area which is already a part of and included within the general limits of the City of Friendswood , or which is presently part of and included in the limits of any other city , town or village , or which is not within the City of Friendswood ' s jurisdiction to annex, the same is hereby excluded and excepted frorn the territory to be annexed as fully as if such excluded and excepted area was specifically described herein. FAi-52$ area ' " � f , . ^ , h1UNICIPAL SERVICE PLAN The following is a summary of the municipal services wrich will be provided in the annexed area within sixty (60) days after the effective date of the annexation: Police Protection. The Friendswood Police Department will expand. its patrol function to include the annexed area. On average , a �� vehicle will patrol the area three ti�es every 24-hour period . The "normal distribution of police patrol vehicles should result �in a response time of approximately four minutes . rire Protection. Fire protection will be provided primarily from Fire Station Number One located on South Friendswood Drive in Stevenson Park. Residents of the annexed area will be provided the same fire service that is being provided. for all other resi- dents of the City. Solid Waste Collection. The City will provide solid waste collection equal to that � being provided to a11 other areas of the City , either by private comnanies or by City-operated garbage collection service . Charges for these services will be the same as charged all other .residents of the City . Maintenance of '�Vater and VJastewater Facilities . The City will provide maintenance of water and wastewater facilities for the annexed area at the same rates that are now being provided for all other residents of tl-,e City . Charges for services provided by the �Vater and Sewer Department will be of the same rate as charged all other City residents . and will be billed on a bi-rnonthly basis . D;aintenance of Roads and Streets . All City roads and streets in the annexed area will be maintained by the City department of Public tidorks in accord- ance with its regular maintenance pro�ram. The street lighting prc�grar� for the a�nexed area will be in accordance with the City street lighting policy as it now exists or r.iay !-�ereafter be amended. 1�laintenance of Parks , Play rounds , and Swimming Pools �nd the Maintenance o any Pu llcly Owr,e Facility , Buil ing or Service . No public facilities of this nature exist in the annexed area. Library Facilities . Residents of the annexecl area will be �r�ovided library service. at the City of Friendswood Library located at i��orningsid� and Spreading Oaks on tha same basis as is provi�led all other City residents . CAPIT�L IMPROVF.MENTS PLAN No capital i�npravements are �lanned for the annexed area tor the - reasan that none are nece�sar.y to e�.�tend munir_ipal services t� �uch area. �ny utilities exLensions rec�uired will be extende� o:� the same basis as axe extended in the other areas of the City .
