AN ORDINANCE AMENDING SECTION 7, SUBSECTION R-3 RESI-
DENTIAL, PARAGRAPH 1 OF THE ZONING ORDINANCE OF THE
CITY OF FRIENDSWOOD, TEXAS TO PROVIDE NEW SETBACKS FOR
STRUCTURES LOCATED WITHIN THE R-3 RESIDENTIAL DIS-
TRICT; REPEALING PRIOR SETBACK PROVISIONS FOR THE R-3
RESIDENTIAL DISTRICT; REPEALING A "NOTE" THEREIN
RELATED TO APPROVAL OF NON-CONFORMING LOTS; AND MAKING
OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT.

WHEREAS, the intent of Ordinance No. 291, as amended, of
the City of Friendswood, Texas, hereinafter referred to as the
City of Friendswood Zoning Ordinance, is to regulate the use of
property wi thin the ci ty limi ts of the Ci ty of Friends\'iood to
protect the health, safety, and welfare of the citizens of the
City of Friendswood in accordance with Vernon's Annotated Texas
Statutes, Article lalla et seq.; and
WHEREAS, the Ci ty of Friendswood caused due not ice to be
published on November 17, 1982 in accordance wi th Section 15,
Subsec t i on 4 of the Zoni ng Ord inance concerni ng certa in pro-
posed changes to the Zoning Ordinance of the Ci ty of Friends-
wood with regard to setbacks in the R-3 Residential District;
and
WHEREAS, the PI anning and Zoni ng Commi s s i on and the Ci ty
Counc i 1 of the Ci ty of Fri endswood , pursuant to Sec t i on 15,
Subsection 4 of the Zoning Ordinance and Vernon's Annotated
Texas Statutes Article 1011f, conducted a joint public hearing
at which all citizens desiring to be heard on such proposed
changes to the setback requirements for the R-3 Residential
District were given the opportunity to be heard; and
WHEREAS, the Planning and Zoning Commission submitted its
final report to City Council by memo dated December 3,1982
recommending detailed changes to the setback provisions for the
R-3 Residential District; and
WHEREAS, the City Council of the City of Friendswood finds
and determines that such changes to the set'nack requirements
for the R-3 Residential District would provide greater flexi -
bility of development in such areas and is consistent with the
stated purpose of development found in the Zoning Ordinance for
R-3 Residential District development ;
NOW, THEREFORE,
BE IT ORBAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSW40I�,
STATE OF TEXAS :

is hereby repealed in its entirety and a new paragraph 1 st�h-

Section 2 . In the event any section, paragraph, subdivi-
sion, clause , phrase , provision, sentence , or part of this
Ordinance or the application of the same to any person or cir-
cumstance shall for any reason �e adjtadged invalid or held
unconstitutional by a court of competent jurisdiction, it shall
not affect , impair, or invalidate this Ordinan�e as a whQle or
any part or provision hereof other than the part declared to be
invalid. or unconstitutior.al ; and the City Council of_ the City
of Friendswood , Texas , declares that it would. have passed each
and every part of the same notwithstanc?ing the or�ission of any
such part thus declared to be inval.id or unconstitutional , or
whether there be one or more parts .
