That the bounda.ries and lir�its of the City of Friendswood are herel�y extenc�ed to embrace and include the following described area of_ 1and , and the follo�aing described land is hereby annexed to and. made a part of ttie City of Friendswood , to-wit : FIELD NOTES ON A 876.62 ACRE TRACT OF LAND in the Perry and Austin League, pbstract 55, Harris County, Texas, and Being More Particularly Describe� by Metes and Bounds as Follows: BEGINNING at the intersection of the northwesterly right-of-way line of F.M. Road 2351, based on 120 feet in width, and the southwesterly line of Beamer Road (formerly known as Choate Road) , based on 60 feet in width; THENCE in a northwesterly direction and along the southwesterly line of Beamer Road a distance of 8,153.59 feet more or less to a point that is 120.00 feet at right angles to the narthwesterly line of the Perry and Austin League, Abstract 55; THENCE in a southwesterl.y direction and 120.00 feet at right angles and parallel to the northwasterly line of the Perry and Austin League a distance of 7,200.00 feet, more or less to a point in the centerline of Clear Creek; THE NCE in a southeasterly direction and along the centerline of Clear Creek to a point being the intersection of the centerline of Clear Creek with a line parallel with and 300 feet northeasterly of the common Zine between Lots 61 and 62 in "The Subdivision of 2069 acres of land out of the upper end of the Perry and Austin League" as shown on plat recorded in Volume 3, Page 6 of the Map Records in Harris County, Texas; THENCE S. 44° 21' 00" E. : parrallel with and 300 feet northeasterly ot the common line b�tween Lots 61 and 62, 1,933.80 feet to a 5/8" iron rod for corner; THENCE S. 20° 57' LO" W. , 185.36 feet to a 5/8" iron rod set for corner; THE NCE S. 24° 29' 24" W. , passing at 141.1Q feet the division line between Lots 61 and 62, in all 308.18 feet to a 5/8" iron rod for corner; THENCE S. 22° 47' 34" W. , z56.48 feet to a 5/8" iron r.od for corner; THENCE S. 44° 21' 00" E. , y06.87 feet to a 5/8" iron rod for corner; THE NCE S. 45° 39' 00" W. , 750.2I feet to a 5/8" iron rod for corner; THENCE S. 37° 59' 25" E. s 200.00 fe�t to a concrete monument in the north- westerly right-of-way line of F.M. 2351; THENCE N. 61° 44' 00" E. a]_ong said right-of-way 591.30 feet to the P.(;. of a curve to ths left; THENCE northeasterly along said right-of-way and with said curve to the left having a radiu.s of 1850.0$ feet$ an arc length of 518.79 feet to the P.T. of said curve; THENCE N. 4S° 40' 00" E. a�ong said right-of-way 2105.9� feet to the P.C. of a curve to the left; �L� THENCE northeasterly along said right-of-way and with said curve to �the left having a radius of 5669.65 feet� an arc length of 197.36 feet to the P.T. of said c ur ve; THENCE N. 43° 40' 20" E. a�.ong said right-of-�way 663.32 feet to the P.C. of a curve to the right; THENCE northeasterly along said right-of-w�:y and with said curve to the right having a radius of 5789.65 feet, an arc leng,th of 201.54 feet Co the P.T. of said curve; THENCE N. 45° 40' 00" E. along said right-of-way line of F.M. 2351, a distance of 2081.20 feet to tlie PLAC� OF BEGINNI:NG, and containing 876.62 Acres of Land, more or less. Section 2 . The plan for extension of municipal services into the area annexed to the City of Friendswood by the provisions of this Ordinance is set .forth in the "Municipal Service I'lan" attached hereto and made a part hereof for all purposes . Such T4unicipal Service Plan is hereby aPproved. Section 3 . If any section or part of this Ordinance be held unconstitutional , illegal or invalid , or the application thereof ineffective or inapplicable as to any territory, such uncanstitutionality, illegality, i.nvalidity, or ine£fectiveness of such section or part shall in no �vise affect , impair or invalidate the remaining portion or partions hereof , but as to such remaining portiori or portions , the same shall be and remain in �u11 force and effect ; and should this Ordinance f.or any reason be i.neffective as to any part of the area hereby annexed to the City of Friendswood , such ineffectiveness of this Ordinance as to any such part or parts of any such area shall not affect the e.ffectiveness of this Ord9.nance as to all. of the rernainder of such area, and the City Council hereby declares it to be its purpose to annex to tlle City of FriendsVaood every part of the area descri.bed in Section 1 0£ this Ordinance , regardless of u�hether any other part of. such described area is rereby effectively annexed to the City. Provic�ed , further, that if_ there is incliaded in the general description of territory set out in Section 1 of_ this Ordinanc.e any land or area whiclz is already a part of and zncluded within t17e �eneral limits of the City of Friendswood , or Ea��ich is presently part of and inc.luded in the limits of any other city, -3- town or village , or tahich is not within the City of. Friendswood ' s jurisdiction to annex , the same is hereby excluded and excepted from the territory to be annexed as £ul].y as if such exclu�ed and excepted area was specificaZly described herein. On average , a vehicle hi11 patro� �he zrea three tirnes every 24-hour �eriou. ihe nor�:al distribution oF police patrol vehicles shoulc result in a response time cf a�p'"oxi:.�ately four r.:inutes. Fire Protection. Fire protection will be provided primarily from Fire Station Number 1 located on South Friendswood Drive in Stevenson Park. Since tne annexation will result in the provision of �he s�� -ire service that is being provided at the present time , th� response time should not be difrerent from the response �ime to the annexed area at the present time. Solid Waste Collection. 1he City will provide solid waste collection equal to that being :.^cvided to all other areas of the City, either by private cor�panies or by City-operated garbage collection service_ Charges fcr these services will be the same as chargee �?� other residen�s of the City. Maintenace of Water and Waste Water tacilities. The C��y y:ill provide maintenance of water and waste water faci�ities for the annexed area at the same rates that are now beino provided for all other residents of the City. Charges -or services provided by the Water and Sewer Department will be o� the same rate as charged all other City residents and 4:�1� be billed on a bi-monthly basis. Maintenance of Roads and Streets. . Al1 City roads and streets in the annexed area will be r,zin��inee by the City department of Public Works in accord- . ance wi�� its regular maintenance program. The street lightin� �rogran for the annexed area will be in accordance with the City street lighting policy as it now exists or may here�=te�^ be amended. Maintenance of Parks, Playgrounds and Swimming Pools and the mainenance of any Publicly-Owned Facility, Building or Service. No public facilities of this nature exist in the annexed area. Library facilities. . Residents of the annexed area will be provided library service z� the City or Friendswood Library located at Morningside and Spreading Oak on the sa.'ne basis as is providec all other City residents CAPITAL IMPROVEMENTS PLAN t:o ca��t�l impz'ovements are planned for the annexed area for the reason th�� n�ne are necessary to extend municipal services to such zrea. An�• •s�ilities extensions required will be extended on the same basis as z^e extendec in rthe other areas of the City. EXHIBIT A
