AN ORDINANCE AMENDING ORDINANCE N0. 256 , PASSED AND
APPROVED ON DECEMBER 15 , �.975 , AND ENTITLED "AN ORDI-

BE IT ORDAINED BY THE CITY COUNCIL OF THE C�TY OF FRIENDSWOOD,
STATE OF TEXAS :
Section l . City of Friendswood, Texas , Ordinance No . 256 ,
passed and approved on December 15 , 1975 , and entitled "AN OR-
DINANCE REGULATING THE DISCHARGE OF INDiJSTRIAL WASTES INTO THE
SANITARY SEWERS OF THE CITY OF FRIENDSWODD, TEXAS ; ESTABLISHING
A PERMIT SYSTEM; ESTABLISHING A SYSTEM OF CHARGES FOR SERVICES
RENDERED; REGULATING UNSEWERED AND MISCELLANEOUS DISCHARGES ;
PROVIDING FOR ENFORCEMENT; CONTAINING OTHER PROVISIONS RELATING
TO THE SUBJECT; PROVIDING A PENALTY; AND PROVIDING FOR SEVER-
ABILITY" is hereby amended as follows :
A. By striking all of Paragraph 9 of Section 1 , which
reads as follows :
[" (9) ' INDUSTRIAL WASTE' means waste resulting from any
process of industry manufacturing, trade, or business
from the development of any natural resource , or any
rnixture of the waste with water or normal wastewater , or
distinct from normal wastewater; "]
and substituting therefor a new Paragraph 9 to read as follows :
" (9) "INDUSTRIAL WASTE" means waste resulting from any
�rocess of industry, manufacturin� , trade , or business
from the development of a� natural resource, or any
�
mixture of the waste with water or normal waste-
water, or distinct from normal wastewater, or in
which the average concentrat�on of total suspended
solids exceeds 350 mg/1 and the BOD exceeds 250 m�/1 . " ;
B . By adding to Section 18 a new subsection G and a new
subsection H to read as follows :
" (G) The user charges to be determined for Persons
producing only normal domestic was�tewater wi11 be '
computed by the use of the following formula :
UC = VX
Formula Values are :
UC = User charge (in dollars)
V = Volume in millions of allons dis-
char e to t e District sewer s stem
during the bi ing perio
X = Cost per million gallons of waste-
water treated
" (H) The costs of operation and maintenance for all
flow not directly attributable ta industrial users
shall be distributed among all domestic users in the
same manner that the cost of operation and maintenance
is distributed among industrial users for actual use . "
C. By striking all of subsection D of Sec�ion 19 , which
reads as follows :
[ " (D) The City shall bill the discharger by the month
and shall show industrial waste charges as a separate
item on the regular bill for water and sewer charges .
The discharger shall pay monthly in accord�nce with
practices existing for payment of sewer charges . "]
and substituting therefor the following :
" (D) The_ City shall bill dischargers of industrial
wastes_ by the month and shall show industrial waste
charges as a separate item on the regular bill for
water and_sewer_ charges . The discharger shall pay

payment of sewer charges . "

Section 2 . An emergency exists which requires the passage
of this ordinance on one reading for the reason that federal
participation in the Blackhawk regional sewer plant requires the
establishment of cost recovery for domestic sewage collection and
treatment. Due to the mandate of the Environmental Protection
Agency, federal funds will be withheld for such sewer plant until
passage of an ordinance establishing such cost recovery. Because
timely completion of the Blackhawk plant is of critical importance
to the health, safety and convenience of the people of Friendswood,
the risk of having federal funds withheld for such project consti-
tutes a public urgency which requires passage of this ordinance.
