ORDINANCE NO. �9.-/,3 � BY THE CITY COUNCIL OF THE CI7Y OF FRIENDSWOOD, TEXAS, CANVASSING THE RETURNS AND DECLARING T'HE RESULTS OF A BOND ELECTION HELD IN SAID CITY ON APRIL 7, 1979 � � � * � � � � * � � � � � * WHEREAS, there came on to be considered the returns of a bond election duly and legally held in the City of Friendswood, Texas, on April 7, 1979, at which election there were submitted to all resident qualified electors of said City for their action thereupon the following propositions, to-wit: . � , • ORD. #79/13E THE STATE OF TEXAS COUNTY OF GALVESTON CITY OF FRIENDSWOOD On this, the 16tl�ay of Apri1�979, at � � 30 o'clock P.M., the City Council of the City of Friendswood, Texas, convened for a regular meeting in the City Hail within said City, which meetin� was at all times open to the public, and the roll was called of the duly consituted officers and members of said City � Council, namely: Ralph L. Lowe Mayor Thomas F. Lay Councilman Paul E. Maaz Counciiman Vickie Black Councilman Loren Wood Councilman Dale Whittenburg Councilman Edward 0. Zeitler Councilman Bobbie C. Henry City Secretary and all of said persons were present with the exception of the following: none , thus constituting a quorum. Whereupon, among other business, the foilowing was transacted at said meeting: A written ordinance CANVASSING 'THE RETURNS AND DECLARING THE RESULTS OF A BOND ELECTION was introduced for the consideration of the Council and read in full. It was then duly moved and seconded that said resolution be adopted; � and after due discussion, said motion, carrying with it the adoption of said ordinance prevailed and carried by the following vote: AYES: All members of said City Council shown present above "AY E" NOES: None . � , . • . PROPOSITION NO. 1 "5ha11 the City Council of the City of Friendswood, Texas, be authorized to issue bonds in the principal amount of $100, 000, for the purpose of constructing permanent additions, extensions, and improvements to the City' s existing, Waterworks System; said bonds to mature serially or otherwise, as may be determined by the City Council of said City, the maximum maturity being not more than ' twenty (20) years from their date; and any issue or series of bonds to bear interest per annum (payable annually or semi-annually) at any rate or rates to be determined with- in the discretion of the City Council of said City, provided that sucli rate or rates shall not exceed the maximum rate per annum authorized by law at the tim� of the issuance of any issue or series of said bonds; and shall the City Council be authorized to levy an annual ad valorem tax on all taxable property in said City sufficient to pay the interest on said bonds as the same accrues and to create a sinking fund suffi- cient to pay the principal thereof as the same matures, as authorized by the Constitution and laws of the State of Texas?" PROPOSTTION NO. 2 "Shall the City Council of the City of Friendswood, Texas, be authorized to issue bonds in the principal amount of $100, 000, for the purpose of purchasing land to be used as a site to construct a municipal complex for said City; said bonds to mature serially or otherwise, as may be determined by the City Council of said City, the maximum maturity being not more than twenty (20) years from their date; and any issue or series of bonds to bear interest per annum (payable annually or semi-annually) at any rate or rates to be determined within the discretion of the City Council of said City, provided that such rate or rates shall not exceed the maximum rate per annum authorized by law at the time of the issu- ance of any issue or series of said bonds; and shall the City Council be authorized to levy an annual ad valorem tax on all taxable property in said City sufficien� to pay the interest on said bonds as the same accru es and to create a sinking fund sufficient to pay the principal thereof as the same matures, as authorized by the Cons�itution and laws of the State of Texas?" PROPOSITZON NO. 3 "Shall the City Council of the City of Friendswood, Texas, be authorized to issue bonds in the principal amount of $50,000, for the purpose of purchasing land to be used as public parks in said City; said bonds to mature seriaLly or otherwise, as may be determined by the City CounciL of said City, the maximum maturity being not more than twenty (20) years from their date; and any issue 'or series of bonds to bear interest per annum (payable annually or semi-annually) at any rate or rates to be determined within• the discretion of the City Council of said City, provided that such rate or rates shall not exceed the maximum rate per annum authorized by law at the time of the issuance of any issue or series of said bonds; and shall the City Council be authorized to levy an annual ad valorem tax on all taxable property in said City sufficient tn pay the interest on said bonds as the same accrues and to create a sinking fund sufficient to pay the principal thereof as �the same matures, as authorized by the Co stitution and laws of the State of Texas?" , ,, PROPOSITION NO. 4 "Shall the City Council of the City of Friendswood, Texas, be authorized to issue bonds in the principal amount of $50, 000, for the purpose of constructing permanent improvements to public parks in said City; said bonds to mature serially or otherwise, as may be determined by the City Council of said City, the maximum maturity being not more than twenty (20) years from their date; and any issue or series of bonds to bear interest per annum (payable annually or semi-annually) at any rate or rates to be determined within the discretion of the City Council of said City, provided that such rate or rates shall not exceed the maxi- mum rate per annum authorized by law at the time of the issuance of any issue or series of said bonds; and shall the City Council be authorized to levy an annual ad valorem tax on all taxable property in said City sufficient to pay the interest on said bonds as the same accrues and to create a sinking fund sufficient to pay the �:�r.incipal thereof as the same matures, as authorized by the Constitution and laws of the State of Texas?" PROPOSITION NO. 5 "Shall the City Council of the City of Friendswood, Texas, be authorized to issue bonds in the principal amount of $250, 000, for the purpose of constructing permanent park improvements, to-wit: A swimming pool, for said City; said bonds to mature serially or otherwise, as may be deter- mined by the City Council of said City, the maximum maturity being not more than twenty (20) years from their date; and any issue or series of bonds to bear interest per annum (payable annually or semi-annually) at any rate or rates to be determined within the discretion of the City , Council of said City, provided that such rate or rates shall not exceed the maximum rate per annum authorized by law at the time of the issu- ance of any issue or series of said bonds; and shall the City Council be authorized to levy an annual ad valorem tax on all taxable property in said City sufficient to pay the interest on said bonds as the same accrues and to create a sinking fund sufficient to pay the principal thereof as the same matures, as authorized by the Constitution and laws of the State of Texas?" '��'; ��.>. .,X;,,_ , •1 ' � Nti._ _v.... riun< ..+�.� PROPOSITION NO. 6 "Shall the City Council of the City of Friendswood, Texas, be authorized to issue bonds in the principal amount of $75, 000, for the purpose of constructing a permanent public building to be used as a fire station in said City; said bond s to mature serially or otherwise, as may be determined by the City Council of said City, the maximum maturity being not more than twenty (20) years from their date; and any issue or series of bonds to bear interest per annum (payable annually or semi-annually) at any rate or rates to be determined within the dis- cretion of the City Council of said City, provided that such rate or rates shall not exceed the maximum rate per annum authorized by law at the time of the issuance of any issue or series of said bonds; and shall the City Council be authorized to levy an annual ad valorem tax on all taxable property in said City sufficient to pay the interest on . said bonds as the same accrues and to create a sinking fund sufficient to pay the principal thereof as the same matures, as authorized by the Constitution and laws of the State of Tex�s?" PROPOSITION NO. 7 "Shall the City Council of the City of Friendswood, Texas, be authorized to issue bonds in the principal amount of $30, 000, for the purpose of constructing permanent street improvements in said City; said bonds to mature serially or otherwise, as may be determined by the City �ouncil of said City, the maximum maturity being not more than twenty (20) years from their date; and any issue or series of bonds to bear interest per annum (payable annually or semi-annually) at any rate or rates to be determined within the discretion of the City Council of said City, provided that such rate or rates shall not exceed the maximum rate per annum authorized by law at the time of the issuance of any issue or series of said bonds; and shall the City Council be authorized to levy an annual ad valorem tax on all taxable property in said City sufficient to pay the interest on said bonds as the same accrues and to create a sink- ing fund sufficient to pay the principal thereof as the same matures, as authorized by the Constitution and laws of the State of Texas?" PROPOSITION NO. 8 "Shall the City Council of the City of Friendswood, Texas, be authorized to issue bonds in the principal amount of $180, 000, for the purpose of constructing improvements and additions to the present public Library; said bonds to mature serially or otherwise, as may be determined by the City Council of said City, the maximum maturity being not more than twenty (20) years from their date; and any issue or series of bonds to bear interest per annum (payable annually or semi-annually) at any rate or rates to be determined within the discretion of the City Council of said City, provided that such rate or rates shall not exceed the maximum rate per annum authorized by law at the time of the issuance of any issue or series of said bonds; and shall the City Council be authorized to levy an annual ad valorem tax on all taxable property in said City sufficient to pay the interest on said bonds as the same accrues and to create a sinking fund sufficient to pay the principal thereof as the same matures, as authorized by the Constitution and laws of the State r���: of Texas?" , � �•. WHEREAS, this City Council has diligently inquired into the poll lists and the official election returns which were duly and lawfully made to this City Council by the judges and clerks holding and conducting said eiection; and WHEREAS, from said returns, this City Counci! hereby affirmatively finds that the following.votes "FOR" and "AGAINST" said propositions were cast in said election, to-wit: PROPOSITION NO. 1 The issuance of $100,000 General Obligation . Bonds to construct permanent additions, exten- sions and improvements to the City's existing Waterworks System and the levy and pledge of the tax in payment thereof as submitted in Proposition No. 1. FOR: 10 9 5 votes AG AINST 6 4 8 votes PROPOSITION NO. 2 The issuance of $100,000 General Obligation Bonds to purchase land to be used as a site to construct a municipal complex for said City and the levy and pledge of the tax in payment thereof as submitted in Proposition No. 2. FOR: 6$1 votes AGAINST: 10 2'�otes PROPOSITION NO. 3 The issuance of $50,000 General Obligation Bonds to purchase land to be used as public parks in said City and the levy and Qledge of the tax in payment thereof as submitted in Proposition No. 3. FOR: 7 3� votes AGAINST: g�� votes PROPOSITION NO. 4 The issuance of $SO,QOQ to construct permanent improvements to public parks in said City and the levy and pledge of the tax in payment thereof as submitted in Proposition No. 4. FOR: �8� votes AGAINST: 9 2 6 votes PROPOSITION NO. 5 The issuance of $250,000 General Obligation Bondsfor the purpose of constructing permanent park improvements, to-wit: A swimming pool for said City and the levy and pledge of the tax in payment thereof as submitted in Proposition No. 5. PROPOSITION NO. 6 The issuance of $75 , 000 General Obligation Bonds to construct a permanent public building to be used as a fire station in said City and the levy and pledge of the tax in payment thereof as sub- mitted in Proposition No. 6 . FOR: L066 AGAINST: 656 votes PROPOSITION N0. 7 The issuance of $30,000 to construct permanent street improvements in said City and the levy and pledge of the tax in payment thereof as submitted in Proposition No. 7. , FOR: � � p� AGAINST: 631 votes PROPOSITION N0. 8 The issuance of $180 ,000 General Obligation Bonds to construct improvements and additions to the present public Library in said City and the levy and pledge of the tax in payment thereof as sub- mitted in Proposition No. 8. FOR: qj� AGAINST: 776 votes NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS I . That a majority of the resident qualified electors of the City of Friendswood, Texas, voting in said elections, having voted "FOR" the authorization and issuance of $100 , 000 of General Obligation Bonds and the levy and pledge of the tax in payment thereof as sub- mitted in Proposition No. 1, the City Council hereby determines that said proposition is carried and that said City Council is accordingly authorized to issue and sell said bonds in accordance with the auth- ority granted in said proposition and with law. II . That a majority of the resident qualified electors of the City of Friendswood, Texas , voting in said election, having voted "AGAINST" the authorization and issuance of $100 ,00 of General Obligation Bonds and the levy and pledge of the tax in payment thereof as submitted in Proposition No. 2, the City Council hereby determines that said proposition has failed. III . That a majority of the resident qualified electors of the City of Friendswood, Texas, voting said election, having voted "AGAINST" the authorization and issuance of $50 ,000 General Obligation Bonds and the levy and pledge of the tax in payment thereof as submitted in Proposition No. 3, the City Council hereby determines that said proposition has failed. IV. That a majority of the resident qualified electors of the City of Friendswood, Texas, voting said election, having voted "AGAINST" the authorization and issuance of $50 , 000 General Obligation Bonds and the levy and pledge of the tax in payment thereof as submitted in Proposition No. 4, the City Council hereby determines that said proposition has failed. V. That a majority of the resident qualified electors of the City of Friendswood, Texas, voting said election, having voted "AGAINST" the authorization and issuance of $250 ,000 General Obliga- tion Bonds and the levy and pledge of the tax in payment thereof as submitted in Proposition No. 5, the City Council hereby determines that said proposition has failed. VI . That a majority of the resident qualified electors of the City of Friendswood, Texas, voting said election, having voted "FOR" the authorization and issuance of $75, 000 General Obligation Bonds and the levy and pledge of the tax in payment thereof as submitted in Proposition No. 6 , the City Council is accordingly authorized to issue and sell said bonds in accordance with the authority granted in said proposition and with law. VII. That a majority of the resident qualified electors of the City of Friendswood, Texas , voting said election, having voted "FOR" the authorization and issuance of $30 ,000 General Obligation Bonds and the levy and pledge of the tax in payment th�reof as submitted � , , . _ W.. �, �. in Proposition No. 7, the City Council is accordingly authorized to issue and sell said bonds in accordance with the authority granted in said proposition and with law. VIII. That a majority of the resident qualified electors of the City of Friendswood, Texas, voting said election, having voted "FOR" the authorization and issuance of $180 , 000 General Bonds and the levy and pledge of the tax in payment thereof as submitted in Proposition No. 8, the City Council is accordingly authorized to issue and sell � said bonds in accordance with the authority granted in said proposi- tion and with law.
