AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEYAS ,
ORDINANCE N0. 210 , PASSED AND APPROVED ON FE$RUARY
18 , 1974, AS AP'IENDED, AND ENTITLED "AN ORDIi1ANCE
OF THE CITY OF FRIENDSWOOD, TEXAS , SETTING FORTH
REGULATIONS FOR SUBDIVISION DEVELOPMENT, OUTLINING
PROCEDURES OF SUBMISSION OF PLATS ; COPITAINING RE-
QUIREMENTS OF MINItNM DESIGN STANDARDS ; STATING THE
REQUIRED IMPROVEMENTS ; PROVIDING FOR THE CHARGING
OF FEES BY THE CITY FOR CERTAIN PROCEDURAL STEPS ;
PROVIDING A SAVINGS CLAUSE" , AND KNOWN AS THE SUB-
DIVISION ORDINANCE OF THE CITY, BY ADDING TO SEC-
TION 1 THEREOF A NEW SUBSECTION E; PR�VIDING FOR AN
ALTERNATE I�THOD OF PLAT SUBP4ISSION FOR SUBDIVISIONS
OF FIVE (5) LOTS OR LESS UNDER LIMITED CIRCUMSTANCES ;
PROVIDING FOR A SCHEDULE OF FEES ; CONTAINING FINDIPJGS
THAT SUCH ORDINAPICE IS NECESSARY TO PP.OMOTE THE
HEALTH, SAFETY AND WELFARE OF THE COMMUNITY; AND PRO-
VIDING FOR SEVERABILITY.

BE IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS :
Section l . City of Friendswood, Texas , Ordinance No . 210 ,
passed and approved on February 18 , 1974, .as amended, and en-
titled "AN ORDINANCE OF THE CITY OF FRIENDSWOOD, TEXAS , SETTING
FORTH REGULATIONS FOR SUBDIVISION DEVELOPMENT, OUTLINING PRO-
CEDURES OF SUBMISSION OF PLATS ; CONTAINING REQUIREMENTS OF MINI-
MUM DESIGN STANDARDS ; STATING THE REQUIRED IMPROVEMENTS ; PRO-
VIDING FOR THE CHARGING OF FEES BY THE CITY FOR CERTAIN PRO-
CEDURAL STEPS ; PROVIDING A SAVINGS CLAUSE" is hereby amended by
adding to Section 1 thereof a new Subsection E to provide as
follows :
"E . Alternate Method of Plat Submission �
"1 . An abbreviated procedure for plat sub-
mission may be used if the proposed sub-
division satisfies the following require-
ments .
"a. The proposed subdivision is for
single family residential development
containing five (5) lots or less .
"b . All lots in the proposed subdivision
front on a previously dedicated street of
adequate width and are so situated that no
additional street , alley, easement or public
property is required to meet the regulations
of this ordinance or any other ordinance of
the City.
"c . All utilities and drainage facilities ,
as required by this ordinance or any other

ordinance of the city, are in place to
serve each lot in the proposed subdivi-
sion and require no alterations or, if
alterations are required, satisfactory
arrangements have been made to effect
such necessary alterations .
"d. The proposed subdivision abutts a
subdivision of record.
"2 . If a proposed subdivision satisfies the
requirements of paragraph 1 next above , the
subdivider may seek final plat approval with-
out necessity of submitting a preliminary plat.
Such final plat shall contain the following :
"a. Proposed name of the subdivision;
"b. Proof that the subdivision satisfies
all requirements set forth in paragraph 1
next above;
"c. An accurate description of such sub-
division by metes and bounds and the location
of same with respect to an original corner of
the original survey of which it is a part
giving the dimensions thereof of said sub-
division; and
"d. Proof that lots within such subdivision
do not violate minimum square footage require-
ments of the City.
"3 . Schedule of Fees - Subdivision plats submitted
to th� Planning Commission for approval under the
alternate method provided for herein shall be
accompanied by a check payable to the City of
Friendswood. The amount of such check shall be
calculated based upon the fee schedule for pre-
liminary plats as provided in Section l , Subsec-
tion B of this Ordinance .
"4. Time and Manner of A roval - Upon the filing
of a plat un er the alternate method of subdivi-
sion approval as provided in this subsection, the
Planning Commission shall render a decision within
thirty (30) days of receipt thereof. Said decisian
may consist of approval , disapproval , or conditional
approval as may be deemed appropriate by such Com-
mission for alterations of utility or drainage facil-
ities under paragraph 1 of this subsection.
"5 . Final approval will expire one (1) year after
Planning Commission action granting approval of such
plat unless the plat has been filed of record, ex-
cept that if the subdivider shall apply in writing
prior to the end of such one (1) year period stating
reasons for needing the extension, this period may,
at the discretion of the Planning Commission, be
extended for another year but not beyond that period. "

Section 2 . The City Council of the City of Friendswood,
Texas , hereby finds and determines that the foregoing amendments
to the City of Friendswood Ordinance No . 210 are necessary to
protect and promote the health, safety and welfare of the inhabit-
ants of the City of Friendswood and the public generally.
Section 3 . In the event any section, paragraph, subsection ,
clause, phrase , provision, sentence , or part of this Ordinance or
the application of the same to any person or circumstances shall
for any reason be adjudged invalid or held unconstitutional by any
Court of competent jurisdiction, the same shall not affect, impair,
or invalidate this Ordinance as a whole or any part or provision
thereof other than the part so declared to be invalid or unconsti-
tutional ; and the City Council of the City of Friendswood, Texas ,
hereby declares they would have passed each and every part of the
same notwithstanding the omission of any such parts so declared to
be invalid or unconstitutional, or whether they be one or more
such parts .
