HomeMy WebLinkAboutOrdinance No. 321 ORDINANCE N0. �o�� AN ORDINANCE AMENDING ARTICLE II OF CHAPTER 8 OF THE FRIENDSWOOD CITY CODE, RELATING TO THE ABATE- MENT OF JUNK VEHICLES AS A PUBLIC NUISANCE, BY STRIKING SECTION 8-27 THEREOF AND SUBSTITUTING THEREFOR A NEW SECTION 8-27 , AND BY ADDING TO SECTION 8-31 THEREOF A NEW PARAGRAPH (c) ; PROVID- ING FOR THE AUTHORITY OF THE CHIEF OF POLICE OR ANY CITY POLICEMAN UNDER HIS DIRECTION TO ADMINISTER THE PROCEDURES FOR ABATING JUNK VEHICLES UNDER ARTICLE II; PROVIDING FOR THE OPPORTUNITY TO FILE A COMPLAINT IN THE MUNICIPAL COURT OF THE CITY AND AUTHORIZING THE MUNICIPAL COURT TO ORDER THE REMOVAL AND ABATEMENT OF SUCH PUBLIC NUISANCE AND TO LEVY A FINE OF UP TO TWO HUNDRED DOLLARS ($200) FOR THE VIOLATION OF MAINTAINING A PUBLIC NUISANCE; PROVIDING THAT THE PROCEDURES FOR ABATING A JUNK VEHICLE AS A PUBLIC NUISANCE SHALL NOT APPLY TO ANTIQUE AND SPECIAL INTEREST VEHICLES IN CERTAIN SITUATIONS . * * * * BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS : Section 1. Article II of Chapter 8 of the Friendswood City Code is hereby amended by striking all of Section 8-27 thereof and substituting therefor a new Section 8-27 to pro- vide as follows : "Sec. 8-27 Enforcement (a) The Chief of Police or any City policeman under his direction, who must be regular salaried full-time employees of the city, shall administer the provisions of this Article, except that removal of vehicles or parts thereof from property may be by any other person duly authorized by the chief of police. The chief of police and city policeman under his direction shall have authority to enter upon pri- vate property for the purposes specified by this Arti- cle to examine vehicles or parts thereof, obtain in- formation as to the identity of vehicles and to remove or cause the removal of a vehicle or parts thereof declared to be a public nuisance pursuant to Section $-28 of this Article. (b) In addition to the procedure provided for in paragraph (a) above , the chief of police or city police- man under his direction may, pursuant to Article 6687-9 , the Abandon�d Motor Vehicle Act, Texas Revised Civil Statutes , file a complaint in the Municipal Court of the city for the violation of maintaining a public nuisance , if the nuisance is not removed and abated and a hearing is not requested within the ten (10) day period provided >—' / for in Section 8-28 of this Article. If a person is found guilty of maintaining a public nuisance as de- fined in Section 8-26 of this Ordinance, the person shall be punished by a fine not to exceed two hundred dollars ($200. 00) and the Court shall order removal and abatement of the nuisance. " Section 2. Article II of Chapter 8 is further amended by adding to Section 8-31 thereof a new paragraph (c) to provide as follows : " (c) Unlicensed, operable or inoperable antique and special interest vehicles stored by a collector on his property, provided that the vehicles and the out- door storage areas are maintained in such a manner that they do not constitute a health hazard and are screened from ordinary public view by means of a fence, rapidl� growing trees , shrubbery, or other appropriate means .
