HomeMy WebLinkAboutOrdinance No. 292 ORDINANCE N0 . 2 � AN ORDINANCE PRESCRIBING RULES AND REGULATIONS GOVERNING THE USE OF AND CO�AUCT IN PUBLIC PARKS , DEFINING A TERM; CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT; PROVIDING A PENALTY; REPEAL- ING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, , STATE OF TEXAS . Section l . Definition "Park" - Any property now dedicated or used as a park or for public park purposes or that may hereafter be dedicated or used as a park or for public park purposes withir the City of Friendswood, Texas , and which park or parks inclu 'e land , the title to which is in the City of Friendswood , Tex� , Section 2 . Injuring , defacing , removing , etc. property in general . It shall be unlawful for any person to remove , destroy, mutilate , mark, disfigure , injure or deface any structure , monument , statue , fountain, wall , fence , railing , vehicle , bench or other property in any park. It shall likewise be unlawful for any person to destroy, damage , mark , cut , break or disfigure any tree , shrubbery, flower , or. any other plant in or on any park. Section 3 . Climbing trees , walking , standing or sitting on fountains , railing, etc. It shall be unlawful for any person to climb any tree in a park� or to walk , stand or sit upon any fountain, railing , flower bed , monument , vase , fence or upon any other property in a park which is not designated for or customarily used for such purposes . Section 4 . Littering It shall be unlawful for any person to litter any park or park waters . Littering, as used in this Ordinance , means the discarding of glass , paper, box, can, dirt , rubbish, waste , garbage , and other forms of refuse in any place other � than officially designated receptacles. Where receptacles are not so provided, all such rubbish or refuse shall be carried away from the park by the person responsible for its presence. Section 5. Hunting, molesting, etc. , animals, reptiles, or birds; using or carrying weapons or traps. It shall be unlawful for any person to hunt, molest, harm, frighten, kill, trap, chase, tease, shoot, injure or throw any stone, object or missile of ar�y kind at any animal, reptile, or bird in a park; nor shall any person use, carry, or possess a firearm of any descr�ption, air-rifle, spring gun, bow-anc��- arrow, sling, or any c�ther form of weapon potentiall.y inimical to wild life and dangerous to human safety, or any instrument that can be loaded with and fire blank cartridges or any kind of trapping devise within a park; provided however, per_mits � for certain types of hunting or for using or carrying a w�apon or traps may be obtained from the Director of Parks and Recreation. Forms of permits and reasonable regulatians concerning their acquisition will .be hereafter determined by the Director of Parks and Recreation, subject to approval by the City Council. Shooting into park areas. from beyond park boundaries constitutes a violation of this Section. Section 6 . Boats It shall be unlawful to place or operate any boat, raft or .other watercraft, whether motor-powered or non motor-powered, upon any waters in 'any park unless specifically designated otherwise. 5ection 7. Swimming, bathing, or wading. No person shall swim, bathe, or wade in any body of water � located on park property unless specifically designated otherwise. Section 8 . Picnicking Picnicking is allowed on park property except where speci- ' fically designated otherwise. � -2- Section 9. Camping � Camping is allowed on park property except where speci- fically designated otherwise. , Section 10. Park hours It shall be unlawful for any peraon to remain in a park after posted hours of use; provided however, permits for the use of parks after posted hours may be obtained from the Dir- ector of Parks and Recreation. Forms of permits and reasonable regulations concerning their acquisition will be hereafter determined by the Director of Parks and Recreation, subject to approval by the City Council. Section 11. Fires . It shall be unlawful for any person to build or attempt � to build a fire in a park in anything other than a specifically designated receptacle; provided however, permits for the bu'ild- � ing of fires in areas not herein provided may be obtained from the Director of Parks and Recreation. Forms of permits and reasonable regulations .concerning their acquisition will be hereafter determined by the Director of Parks and Recreation, subject to approval by the City Council. Nor shall any person drop, throw, or otherwise scatter lighted matches, burning cigarettes, or cigars within any park. Section 12 . Signs. and solicitatiori � It shall be unlawful for any person to place or cause to be placed any sign, whether portable or temporary, within any park nor shall any �person be, or act as, or ply the vocation of, a solicitor, agent, peddler, medicant, begger, strolling musician, organ grinder, exhorter, showman or bootblack in any park; provided however, permits for the erection of signs and � certain types of solicitation may be obtained fra� the Director of Parks and Recreation. Forms of permits and reasonable regu- lations concerning their acquisition will be hereafter deter- � mined by the Director of Parks and Recreation, subject to approval by the City Council. -3- 5ection 13. Motorized vehicles It shall be unlawful tor any person to operate or cause to be operated a motorized vehicle on park property except. on roadways and other specifically designated areas. This section does not apply to vehicles used for emergency and police purposes. Section 14. Horses and other large animals It shall be unlawful for any person to ride, lead, or otherwise allow a horse, whether by action or inaction, upon any area of a park, except alo.ng and t�pon areas specifically designated. Other large animals are also prohibited. Dogs and cats, if household pets and appropriatel.y licensed � and supervised, are permitted on park property, except in areas specifically designated otherwise. Section 15. Possession or consumption of alcoholic beverages It shall be unlawful for any person to possess or consume \ alcoholic beverages in a park while attending any athletic event or practice session specifically organized for the par- ticipation of minors. Section 16. , Glass contained beverages Beverages of any kind in glass containers are prohibited on park property. , Section 17 . Policies of specific park area The Director of Parks and Recreation shall keep and main- tain a listing of specific rules and regulations that apply to specific parks. Section 18. Rules and regulations of Director The Director of Parks and Recreation shall have the power, subject to the approval of the City Manager and the City Council, to prescribe rul.es and regulations for the orderly government � and use of all parks and for the administration of the affairs of the Department of Parks and Recreation, provided such rules � -4- . are not in conflict with existing laws or ordinances. Section 19 . Compliance with Urdinance is condition of use of parks. � Compliance with the provisions of this Ordinance is a condition of the use of the parks of the City. Section 20 . Exemptions from Ordinance The provisions of this Ordinance shall not be construed to apply to personnel engaged in authorized maintenance or construction upon park property. Section 21. Penalties Any person violating any of the provisions of this � Ordinance shall be deemed guilty of a misdemeanor and, upon . conviction thereof, shall be fined not less than ten dollars ($10. 00) nor more than two hundred dollars ($200. 00) , and in addition to the penalty herein provided for such violations, � any neglect or refusal to comply with any of the provisions of this Ordinance shall be deemed a nuisance, and may be abated in the manner provided by the laws and ordinances of the City � for the abatement of nuisances. Section 22` Severability In the event any section, paragraph, subdivision, clause, phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstances shall for any reason be adjudged invalid or held unconstitutional by any Court of competent jurisdiction, the same shall not affect, impair, or •invalidate this Ordinance as a whole or any part or provision hereof other than the part so declared • to be invalid or unconstitutional; and the City Council of the . City of Friendswood, Texas, declares that it would have � passed each and every part the same notwithstand•ing the omis- sion of any such part so declared to be invalid or unconsti- tutional, or whether there be one or more parts. , -5- � . _ , _. . Section 23. Repeal of conflicting ordinances Al1 ordinances and parts of ordinances in conflict here- with are, to the extent of such conflict, hereby repealed.
