HomeMy WebLinkAboutOrdinance No. 281 ORDINANCE NO.� AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF ARTICLE 6701D, VERNON''S TEXAS CIVIL STATUTES , UPON THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION, UPON CERTAIN STREETS AND HIGHWAYS , OR PARTS THEREOF , WITHIN THE CORPORATE LIMITS OF THE CITY OF FRIENDSWOOD AS SET OUT IN THIS ORDINANCE ; AND PROVIDING A PENALTY OF A FINE NOT TO EXCEED $200 FOR THE VIOLATION OF THIS ORDINANCE. WHEREAS, Article 6701D, Vernon' s Texas Civil Statutes , provides that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investi- gation that any prima facie speed therein set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of a street or highway within the City , taking into considera- tion the width and condition of the pavement and other circumstances on such portion of said street or highway , as well as the usual traffic thereon, said governing � �y may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway , now, therefore , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDS- WOOD, STATE OF TEXAS : Section l. Upon the basis of an engineering and traffic investigation heretofore made as authorized by the provisions of Article 6701D, Vernon' s Texas Civil Statutes , the following prima facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe ; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named streets and highways , or parts thereof, described as follows : (a) Along FM 518 from the North City Limits of Friendswood to a point 450 feet North of Brandywine , a distance of approximately 0 . 290 mile , 50 MPH; (b) Along FM 518 from a point 450 feet North of Brandywine to a point 60 feet North of Lottie Lane , a distance of approximately 0 . 370 mile , 45 MPH; (c) Along FM 518 from a point 60 feet North of Lottie Lane to a point 158 feet North of FM 2351 , a distance of approximately 0 . 270 mile , 40 MPH; (d) Along FM 518 from a point 158 feet North of FM 2351 to a point 174 feet North of Echo Avenue , a distance of approximately 0 . 850 mile , 30 MPH ; (e) Along FM 518 from a point 174 feet North of Echo Avenue to a point 420 feet South of Whispering Pines , a distance of approximately 0 . 525 mile, 35 MPH; (f) Along FM 518 from a point 420 feet South of Whispering Pines to a point 900 feet South of Winding Way , a distance of approximately 0 . 500 miles , 45 MPH; (g) Along FM 518 from a point 900 feet South of Winding Way to the South City Limits of Friendswood, a distance of approximately 2 . 200 miles , 55 MPH; (h) Along FM 518 from a point 132 feet North of Shadowbend to a point 264 feet South of Spreading Oaks , a distance of approximately 0 . 330 mile , a school speed zone, 20 MPH when flashing and 30 MPH at all other times ; (i) Along FM 528 from the southwest city limits at Galveston- Brazoria County Line to a point 480 feet West of Greenbriar, a distance of approximately 3 . 350 miles , 55 MPH ; (j ) Along FM 528 from a point 480 feet West of Greenbriar to a point 306 feet East of Winding Way , a distance of approximately 1. 250 miles , 45 MPH; (k) Along FM 528 from a point 306 feet East of Winding Way to the northeast city limits of Friendswood at the Galveston-Harris County Line , a distance of approximately 0 . 539 mile , 50 MPH ; ( 1) Along FM 2351 from the West City Limits of Friendswood to a point 48 feet West of Sunset Street , a distance of approximately 0 . 762 mile , 55 MPH; (m) Along FM 2351 from a point 48 feet west of Sunset Street to the East City Limits of Friendswood , a distance of approximately 1. 490 miles , 40 MPH; (n) Along FM 2351 from a point 106 feet West of Brigadoon Lane to a point 264 feet East of Garden Drive , a distance of approximately 0 . 200 mile , a school speed zone, 20 MPH when so signed; Section 2 . Any person violating of of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not more than TWO HUNDRED DOLLARS ( $200 ) .
