HomeMy WebLinkAboutOrdinance No. 274-E ORDINANCE NO. � '/�,L� AN ORDINANCE DENYING THE APPLICATION AND REQUEST OF COMMUNITY PUBLIC SERVIC� COMPANY r OR AN INCREASE IN THE RATES IT IS AUTHORIZED TO CHAR.GE F+OR ELECTRi�ITY FURNISHED BY IT TO RESID�NTIAL AND COMMERCIAL US�RS IN TH� CITY OF FRIENDSWOOD, TEXAS; AND PP�OVIDING THAT THIS ORDINANCE SHALL BE ENACTED AS AN EMERGENCY OR- DINANCE. .,, WHEREAS, on September 13, 1976, Community Public Service Company submitted to the City Council of the City of Friendswood, Texas, a schedule of rates ior electricity p:ovided by such Company �o residential and comrnercial users in the City of Friendswood and requested such City Council to adopt such schedule of rates by ordinance; and WHEREAS, in response to such request, such schedule of rates was duly adopted by City of Friendswood Ordinance No. 262, finally passed on October 4, 1976; and WHEREAS, on December 16, 1976, Cornmunity Public Service Company filed with the City Council another request for an increase in its rates and charges for electricity furnished by it to residential and com- mercial users in the City of Fri.endswood; and WHEREAS, after investigation and hearing, i� is the opinion of �he City Council that the increased rates last requested by Community Public Service Company are not justified and that its present rates are sufficient to provide it with a fair return on the adjusted value of its invested capital used and useful in providing its service; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Sec�ion l. The reques� of Community Public Service Company for an increase in its rates for electricity provided by it to residen�ial and com- mercial users in the City of Friendswood, Texas, as evidenced by the rate package filed by such Company with the City Council on December 16, 1976, � is denied. � Section 2. The fact that Community Public Service Company has indicated its intention to place into effect the increased rates denied herein creates an emergency and an urgent public necessity requiring that this ordinance denying such request for increase rates be enacted as an emergency ordinance, as authorized by Section 3. 12 of the Charter of the City of Friendswood, Texas.
