AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED
FOR VEHICLES UNDER THE PROVISIONS OF ARTICI�E 6701D, VERNON"S
TEXAS CIVIL STATUT�S, UPON THE BASIS OF AN ENGIN�ERING AND
TRAFFIC INIIESTIGATION, UPON CERTAIN STREETS AND HIGHWAYS, OR
PARTS THEREOF, l�JITHIN THE GORPORATE LIMITS OF THE CITY OF
FREINDSWOOD, AS SET OUT IN THIS ORDINANCE; AND PROVIAING A
PENALTY OF A FIN� NOT TO EXCEED $200 FOR THE VIOLATION OF THIS
ORDINANCE.
!�1NEREAS, Article 6701d, Vernon's Texas Civil Statutes , provides that
whenever the governing body of the City sha11 determine upon the basis of
an engineering and traffic investigation that any prima facie speed therein
set forth is greater or less than is reasonable or safe under the condi-
tions found to exist at any intersection or other place or upon any part
of a street or highway within the City, taking into consideration the
width and condition of the pavement and other circumstances on such portion
of said street or highway, as well as the usual traffic thereon , said
governing body may determine and dec1are a reasonable and safe prima facie
speed limit thereat or thereon by the passage of an ordinance, which
shall be effective when appropriate signs giving notice thereof are erected
at suah intersection or other place or part of the street or highway, now
therefore,
BE IT ORDAINED BY THE CTTY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE
OF TEXAS:
Section 1 . Upon the basis of an engineering and traffic investi-
gation heretofore made as authorized by the provisions of Article 6701d,
Vernon's Texas Civil Statutes, the following prima facie speed limits here-
after indicated for vehicles are hereby determined and declared to be
reasonable and safe; and such speed limits are hereby fixed at the rate
of speed indicated for vehicles traveling upon the3named streets and highways,
or parts thereof, described as follows:
(a) Along FM 528 from the South City Limits at the Galveston-
Brazoria County Line to a point 132 feet West of Sunset
Drive, a distance of approximately 4.036 miles, 55 MPH.
(b) A1ong FM 528 from a point 132 feet West of Sunset Drive to
a point 306 feet East of !��inding Way, a distance of approxi-
mately 0.564 mile, 45 MPH.
(c) Along FM 528 from a noint 306 feet East of Winding Way to the
East City Limits of Friendswood at the Galveston-Harris
County Line, a distance of approximately 0.539 mile, 50 P�PH.
Section 2. Any person violating any of the provisions of this
ordinance shall be deemed gui�ty of a misdemeanor and upon conviction
thereof shall be fined in any sum not more than Two Hundred pollars ($200).
Section 3. If any section, sentence, clause, phrase ar word in
this ordinance shall be held invalid for any reason, such invalidity shall
not reduce or affect the validity of the remaining sections or portions
thereof, it being the intention of the City Council in adopting this
ordinance to give full force and effect to all provisions of this ordinance,
independent of those declared invalid.
