AN ORDINANCE ESTABLISHING RULES AND REGULATIONS FOR
THE DESIGN AND CONSTRUCTION OF DRIVEWAYS, SIDEWALKS, PARKING
LOTS, CURBS, GUTTERS, AND ALLEYS; CONTAINING OTHER PROVISIONS
RELATING TO THE SUBJECT; PROVIDING A PENALTY; AND PROVIDING
FOR SE VERABILITY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD, TEXAS:
Section 1. Definitions. The following words and phrases, when used in
this ordinance, have the meanings respectively ascribed to them in this section.
(a) Al1ey• Any street as herein defined of twenty (20) feet or
less width having no legal or offical name other than
"Alley".
(b) Driveway. Entrances to and exits from private premises
where it is possible to park completely off the street and
which are not open for vehicular traffic except by permission
of the owner of such private premises.
(c) Highway, Street or Road. A general term denoting a public
way for the purpose of vehicular travel including the entire
area within the right-of-way.
(d) Local Street or Road. A street or road primarily for access
to residence, business or other abutting property.
(e) Major Thorou�hfares. A public street which is designated on
the most recent "Major Thoroughfare Plan" approved by the
City Planning and Zoning Commission, and those streets
that carry high traffic volumes and on which traffic control
measures are used to expedite the safe movement of through
traffic.
(f) Pedestrian. Any person afoot.
(g) Sidewalk. That portion of a street between the curb lines,
or the lateral lines of a roadway, and the adjacent
property lines intended for the use of pedestrians.
(h) Loading Dock. A raised platform for loading or
unloading of materials.
Section 2. City Approval of Plans and Specifications. No person shall
construct, or cause to be constructed, driveways, sidewalks, private streets,
parking lots or alleys connecting private property with a public street without
prior approval of the City Manager of the City of Friendswood.
Section 3. Driveway Approval. Upon receipt of an application for a
driveway permit, the City Manager shall make or cause to be made a determi-
nation as to whether the driveway applied for is necessary to provide reasonable
access to the private property consistent with the safety and convenience of the
public, taking into account the following matters:
(a) The nature and volume of traffic on the street on which
the private property abuts.
(b) The dimensions and type ofoonstruction of the street on
which the private property abuts.
(c) The effect that the passage of vehicles to and from the
private property will have upon the safety of the public
and on movement of traffic on the street to which the
driveway connects.
(d) The use to be made of the private property.
(e) The dimension of the private property, and the type and
location of improvements thereon or to be placed thereon.
(f) The extent of the access which the private property has or
will have to other public streets, if any.
Section 4. Restrictions on Driveway Approval. After making, or causing
to be made, such determination, the City Manager shall grant or refuse the
application in accordance with the following rules:

(a) He shall refuse to issue a permit for a single driveway
opening unless it shall be found to be necessary for
reasonable access.
(b) If the application is for more than one driveway opening
into the same premises, he shall allow no more such
openings than the minimum number found to be necessary
to provide reasonable access.
(c) He shall refuse to issue a permit for any driveway
opening where it has been found that the proposed use
of the driveway would create an extraordinary traffic
hazard or would excessively interfere with the normal
use of the right-of-way.
(d) Every permit issued shall specify the maximum width
of the driveway opening for which the permit is granted
and such width shall be no greater than the minimum
necessary to provide reasonable access.
(e) If a permit is granted for more than one driveway opening
into the same premises, it shall specify that each such
opening shall be separated from the others by a distance
of no less than twenty (20) feet, and that an upright curb
must be constructed along the edge of the area of separa-
tion next to the improved portion of the street.
Section 5. State Review of Plans and Specifications. The Texas Highway
Department will review plans for the proposed construction of driveways, side-
walks, parking lots and alleys into or abutting all State highways. Evidence of
this review and approval must be submitted with plans prior to obtaining the
City's approval. The State's concurrence to proposed construction is insuffi-
cient alone since it is conditioned upon the City's granting final approval.

Section 6. Standards for Design and Construction. There are hereby
approved and adopted the following drawings, which have been approved by
the City Engineer, setting forth in detail the standards for design and construc-
tion of driveways, sidewalks, curbs, gutters, parking lots and alleys.
(a) Driveway Geometric Design Standards (Drawing No. 74-1).
(b) Off-street Parkin� Lots (Drawing No. 74-2).
(c) Change of Type "B" Inlets for Construction of Drive-
ways (Drawing No. 74-3).
(d) Type "D" Inlets (Drawing No. 74-4).
(e) Standard Curb and Gutter Section (Drawing No. 74-5).
(f) Construction Notes for Sidewalks, Driveways, Curbs
and Gutters (Drawing No. 74-6 for curbed-type streets
Drawing No. 74-7 for open ditch-type streets).
(g) Standard Requirements for Paving Public Alleys (Drawing
No. 74-8).
(h) Island Construction for Continuous Culvert Pipe (Drawing
No. 74-9).
Section 7. Plot Plan Required. A plot plan shall be prepared to scale
and presented to the City Manager showing the following information:
(a) All proposed driveways and sidewalks shall be shown
in detail and shall conform to the standards for design
and construction set forth in Section 6 of this ordinance.
(b) All existing driveways and sidewalks shall be shown as they
exist on the ground, showing the driveway width and design.
(c) Existing conditions between the right-of-way line and the
traveled roadway, including,but not limited to, curbs,
ditches, storm sewer inlets, manholes, utility poles,
fire hydrants, traffic control and directional signs,
and trees.

(d) When private property being developed fronts a "T"
intersection street, the complete intersection must
be shown on the plot plan.
(e) When private property is being improved with add-on
construction, remodeling, accessories, repairs,
erection of building parking lots or any other improve-
ments, all existing on-site conditions shall be shown
on the plot plan.
(f) Cross-sections, as applicable, of proposed driveways
and sidewalks, either or both, shall be shown on the
plot plan. When such cross-sections are shown else-
where in a set of drawings, reference to the sheet
number shall be noted on the plot plan.
Section 8. Sidewalks Required. Sidewalks shall be required to be
constructed within all districts zoned C-1 and along an existing curb-type
major thoroughfare abutting the property being developed. State hi�hways
within the City, where curbecl,will also fall within the scope of this require-
ment, subject to State review of plans and specifications as set forth in
Section 5 of this ordinance. Sidewalks will be required in districts zoned
R-1 on those streets shown as major thoroughfares on the "Major Thorough-
fare Plan".
Section 9. Off-street Truck Loading Docks. In no case shall a
"back-in" type loading dock be constructed on major thoroughfares where the
vehicle is using the major thoroughfare for maneuvering purposes. Where
off-street "back-in" loading docks are constructed, the loading area shall be
sufficiently designed and constructed to store the commercial motor vehicle,
truck-tractor, tr.actor, trailer or semi-trailer, or combination of such
vehicles, within private property and no part of the above described commer-
cial vehicles shall protrude over the property line or obstruct in any manner
any public street or sidewalk area. The depth of the loading dock from the

right-of-way and property line extending into private property shall be
determined by the type of commercial vehicle using the facility. All other
type loading areas other than the loading dock shall require a twenty (20)
foot minimum depth from the property line.
Section 10. Extensive Street Curb and Gutter Removal and Replacement.
Where construction of driveways and sidewalks will require the removal and
replacement of curb and gutter over a continuous run in excess of 25% of any
one block, a plan shall be submitted to the City Manager with the following
information, which shall be in addition to the information required by Section 7.
(a) A continuous profile plotted to scale of 1"= 2' vertically
and 1"= 20' horizontally, containing all the existing and
proposed profiles necessary for reviewing. The proposed
gutter grade should meet the following minimum design
criteria:
(1) Minimum gutter grade, except at corner curb
returns, shall be 0. 25% (3" fall per 100').
(2) Minimum gutter grade around corner curb
returns shall be 1. 00% (example: 0. 22' fall
around 14' radius).
(3) A vertical curve with elevations given every 10'
will be required where the algebraic difference
of the proposed gutter grades exceed 1. 00%,
excluding corner curb radius grades.
(b) Construction details for replacing curbs and gutters and
base, any or all, when necessary to remove same for
realignment of curbs and gutters horizontally or vertically.
The method of tie of proposed curbs and gutters and base,
any or all, to existing pavement, with or without reinforc-
ing steel, shall be given in detail. For asphalt surfaced

streets "feathering" of Type "F" asphalt toward crown
a sufficient distance to insure adequate cross-slope
drainage. Minimum 1/4" per foot will be required
when raising proposed gutter above existing gutter
line. Contact the City Engineer for clarification of
these requirements where necessary.
Section 11. Alley Paving. The requirements for paving a public alley
are identical to public street paving, requiring plan-profile type of drawings
prepared by a registered professional engineer and approved by the City
Engineer. Drawing No. 74-8 (Standard Requirements for Paving Alleys) will
govern the design and construction of alleys. A separate paving permit issued
by the City and a separate paving bond will be required prior to any construction.
Section 12. Driveway Drainage Requirements. In the event an existing
curb-type storm sewer inlet falls within the proposed driveway area, a new
curb-type storm sewer inlet will be required to be constructed on the nearest
remaining straight curb line. The existing inlet will be converted to a flat
grate-type inlet and connected to the new inlet by a concrete pipe lead of a
diameter not less than the existing lead. Failure to show the existing inlets
on the plot plan in no way releases the developer from the above requirements,
even though the permit may have been issued. Refer to Drawing No. 74-3
(Change of Type "B" Inlet). Drainage of surface water through the curb will
be limited to the use of a pipe of a minimum 4-inch inside diameter and a
maximum distance of 1-foot center to center.
Section 13. Driveway Culvert Pipe. No culvert pipe of less than the
inside diameter of the nearest up-stream culvert pipe shall be installed. In
no case will a culvert pipe of less than 15 inches inside diameter be permitted.
Proposed driveways over culvert pipes shall not be constructed of concrete.
Proposed culvert pipe sizes may be verified by contacting the City Engineer.

(a) In the event a request is made for runs of culvert
pipe i.n excess of the normal maximum thirty-five
(35) foot wide driveway culvert, the City Engineer
will conduct a field investigation of the feasibility
and practicability of the culvert pipe installation.
If the request must be denied, the petitioner will be
advised why his request cannot be granted.
(b) When the request for a long run of culvert pipe is
approved, in excess of the thirty-five (35) foot
maximum driveway width required, concrete curbed
islands shall be constructed in accordance with
Drawing No. 74 -9 (Island Construction for Continuous
Culvert Pipe).
(c) Whenever a building permit is sought on abutting
property having existing culvert pipe in excess of
thirty-five (35) feet without concrete curbed islands
required by this section, such building permit shall
not be issued without the construction of concrete
curbed islands in compliance with this Section.
(d) The plot plan to accompany a request for extra length
culvert pipe shall include:
(1) Location of proposed culvert pipe by street address.
(2) Size and leng�th of culvert pipe approval requested.
(3) Construction and spacing of Type "D" inlets.
(4) Conformity with Driveway Geometric Design
Standards regarding spacing of driveways for
the construction of the concrete curbed island.
Section 14. Parking Lots. It shall be unlawful for any person, firm,
corporation, partnership or association who operates, keeps or maintains, or
causes to be operated, kept or maintained, a parking lot where automobiles or
other vehicles are parked on private property adjacent to public streets or

sidewalks, to permit any automobile or vehicle parked thereon to be parked
in such a manner as to protrude over the property line of such parking lot or
to obstruct in any manner any public street or sidewalk adjacent to such
private property.
(a) When an area is being developed for parking, a plan
shall be prepared and submitted to the City Manager
showing the boundaries, entrances and exits, geometric
layout of stalls and aisles, operating plan, drainage,
and surfacing or paving. The space being developed
for parking shall be surfaced with asphalt or better and
parking spaces or stalls shall be identified by striping
with paint or other method approved by the City Manager.
(b) When the parking lot is designed to create a one-way
aisle operation, an exit shall be provided to enable the
vehicle exiting to enter the street in a head-out position.
(c) A three (3) inch mountable concrete curb shall be constructed
whenever the area between the property line and the curb
is paved. The curb shall be placed adjacent to the property
line except when used as a vehicle wheel stop; in which case,
it shall be a six (6) inch concrete curb or similar permanent
type wheel stop placed a minimum of two and one-half (2-1/2)
feet inside the property line.
(d) A three (3) inch mountable concrete curb shall be
constructed whenever an area adjacent to the right-
of-way is to be paved or used for parking. The curb
shall be placed adjacent to the property line except
when used as a vehicle wheel stop; in which case, it
shall be a six (6) inch concrete curb or similar
permanent type wheel stop placed a minimum of two
and one-half (2-1/2) feet inside the property line.

(e) Paved areas, parking lots, yards, courts and court-
yards, shall be drained into a storm sewer system
where such systems are available; otherwise, they
shall be drained to a place of disposal approved by
the City Manager. Storm water drainage shall not
discharge or flow over any public sidewalk or
adjoining property.
Section 15. Driveways Prohibited. Driveways are prohibited within
the following areas:
(a) Within the areas set forth by the Texas Highway
Department as "Access Denied".
(b) Within the areas designated "access denied" on
recorded subdivision plats or any other plat required
to be approved by the City of Friendswood Planning
and Zonin� Commission.
(c) At the end of any dead-end street not terminating in
a cul-de-sac or permanent turn-around and intended
to be extended in the future.
(d) Within the limits of any intersection, with the exception
that special consideration will be given to major thorough-
fares with existing esplanades and to streets primarily
used for residential purposes.
(e) Within any area with less than twenty (20) feet of unob-
structed depth from the right-of-way line to any obstruc-
tion.
(f) Within an area abutting major thoroughfares where the
general design of the parking does not provide the
necessary depth to allow a vehicle when exiting to enter
the thoroughfare in a head-out position.
(g) Any existing driveway that may fall within an area where

the twenty (20) foot minimum unobstructed depth is
shortened by the construction of a structure of any
type. Such driveway shall be removed and the area
restored to its original state.
(h) Within any area where the City Manager finds that it
would not provide reasonable access to private property
consistent with the safety and convenience of the
traveling public.
Section 16. Permit Required by Bonded Contractor. It shall be unlawful
to construct, reconstruct, repair or regrade any driveway, sidewalk, culvert
pipe, curb or gutter within the City without obtaining a permit from the City
Manager, which permit shall be kept conspicuously displayed within twenty
(20) feet of the construction area during the prosecution thereof. The applica-
tion for a permit shall be made to the City Manager, stating the nature and
extent of the proposed improvements, location by lot, block and street number,
together with the plans and specifi cations provided for in Section 7. The
applicant shall furnish evidence that he has secured a bond in accordance with
the provisions of Section 18.
Section 17. Home Owners Permit. A home owners permit will be
issued to install culvert pipe or construct a driveway where no curb cut is
required, in accordance with City specifications, without the bond required
in Section 16.
Section 18. Contractor's Bond. No person, except a person laying
permanent street paving under contract with the City shall be entitled to
construct, reconstruct, repair or regrade any driveway, culvert pipe, side-
walk, curb or gutter within the City unless he shall first execute to the City
a yearly bond in the sum of two thousand ($2, 000) dollars, payable to the City,
with two or more sureties, or with a corporate surety authorized to do business
in Texas, conditioned that the principal therein will construct, reconstruct,

repair or regrade all driveways, culvert pipes, sidewalks, curbs or
gutters in accordance with this ordinance and on the line and grade as
established by the City Engineer and further conditioned that such person
will save the City harmless from all loss or damage to any person, of what-
ever character, arising by reason of negligence on the part of the contractor
in performing such work, or in leaving the same ungraded, or from any
other cause. The bond shall further recite that all work done by the contractor
during the year for which such bond shall hold good, shall be performed to
the satisfaction of the Building Official.
Section 19. Effect of Acceptance. Any person to whom a permit is
issued pursuant to any of the provisions of this Ordinance will, by his accept-
ance of such permit (which acceptance shall be conclusively presumed, if
after the permit is issued he does any of the work contemplated or provided
for in the application), undertake or promise that the work covered by the
permit and application will be done in full and exact accordance with the
provisions of the application and of the plans and specifications therefor, and
that no other work than that covered by permit will be undertaken pursuant
thereto. He will further thereby agree that, during the course of the work,
every instruction and order of the City Engineer or Building Official for
stopping any work which is being done in a manner contrary to the plans and
specifications or the application, correcting and replacing any work not in
compliance therewith or completing any work necessary to accomplish
compliance therewith, will be promptly and immediately observed. Without
limiting the obligation of the applicant to faithfully adhere to the plans,
drawings and all of the specifications, he will, by the acceptance of a permit,
particularly undertake that no materials will be used in the work except those
which, under.the appropriate provisions of the City's minimum sta.ndards and
specifications, have been tested and approved by an approved testing laboratory
as therein provided; and that if any materials not so tested and approved are
used, he will, upon such violation being discovered, replace the same by

work of proper tested and approved materials.
Section 20. Construction in City Right-Of-Way. It shall be unlawful
for any person, on behalf of himself or on behalf of any other person, to perform
or cause to be performed or to permit the construction, reconstruction, repair,
or regrading of any driveway, sidewalk, curb and gutter or culvert pipe within
the right-of-way, without obtaining a permit from the City Manager. Provided,
however, this prohibition shall not apply to any person performing any work
under contract with the City of Friendswood or to public utility companies
having a franchise from the City.
Section 21. Duties of Abutting Property Owners; Failure of Property
Owners to Have Work Done. It shall be the duty of every owner of real estate
in the City, abutting on any public street or alley in the City, in front of which
real estate or along which street the City Engineer may order the construction,
reconstruction or repair, or bring to grade of driveways, sidewalks, culvert
pipes, curbs or gutters, or any of them, to cause the same to be constructed,
reconstructed or repaired or bring the same to grade, as the case may be,in
accordance with the terms of such order, the specifications set out in this
Ordinance and on the line and grade as established by the City Engineer for
the particular block, street or community in which the real estate may be
situated. Such property owners shall cause to be constructed such improve-
ments in front of their respective property after the giving of written notice
by the Building Official, which notice shall fix the time for completion of
such work. After the expiration of the time indicated in the notice to construct,
reconstruct, repair or regrade, if the abutting owner shall not have built such
improvements as ordered and indicated in the notice, then the City shall have
the right to construct the same in accordance with the order for the same,
and the standard specifications hereinafter set out, under the supervision of
the Building Official, and may advertise for bids or may itself construct such
improvements, at the expense of the abutting property owner, and may recover

a personal judgment in any court having jurisdiction of the amount for the
cost and expense in constructing, reconstructing, repairing or regrading
such driveways, sidewalks, culvert pipes, curbs and gutters, with ten
percent (10%) additional for attorney's fees, and may by ordinance fix a
lien on the property improved.
Section 22. Altering Lines or Grades When Putting Down Permanent
Street Pavement. The City hereby expressly reserves the right, when putting
down a permanent street pavement, either by the original construction or
reconstruction, to change or alter the lines and grades of such permanent
pavement of the driveway, sidewalks, culvert pipes, curb or gutters, on the
street, when in the opinion of the Building Official such change is necessary
for the proper paving or drainage of the street, and without liability on the
part of the City by reason of such change. In the event that a driveway or
sidewalk, the line or grade of which is changed, is in good condition and
does not, in the opinion of the Building Official, require entire reconstruction
the owner thereof shall be given written notice by the Building Official to break
such driveway or sidewalk back to a point fixed by the Building Official and to
remove the broken portion and reconstruct such portion on the line and grade
determined by the City Engineer, at the cost of such abutting owner. Such
notice shall fix the time for the completion of such work. In the event such
owner shall fail or refuse to obey the order of the Building Official within
the time fixed in such notice, he shall be subject to all the penalties of this
Ordinance, and the Building �fficial shall have the right to have such breaking
and reconstructing to grade of such driveway or sidewalk done by a paving
contractor, or other person, at the expense of the abutting owner.
Section 23. Penalty. Any person constructing, reconstructing, repair-
ing or regrading any driveway, sidewalk, culvert pipe, curb or gutter who
shall fail first to give the bond required by this Ordinance, or who shall
construct, reconstruct or repair any driveway, sidewalk, culvert pipe, curb
or gutter without obtaining from the City Engineer the line and grade therefor,

or who shall construct any driveway, sidewalk, culvert pipe, curb or gutter
or any other line and grade than that given by the City Engineer or without
obtaining a permit therefor, or who shall fail to construct, reconstruct,
repair or regrade any driveway, sidewalk, culvert pipe, curb or gutter after
notice so to do, or who shall violate any other provision of this Ordinance,
shall be deemed guilty of a misdemeanor and,upon conviction, shall be fined
not more than two hundred ($200) dollars and each day of violation shall
constitute a separate offense,
Section 24. Severability. If any provision, section, subsection,
sentence, clause or phrase of this ordinance, or the application of same to
any person or set of circumstances is for any reason held to be unconstitutional,
void or invalid, or for any reason unenforceable, the validity of the remaining
portions of this ordinance or their application to other persons or sets of
circumstances shall not be affected thereby, it being the intent of the City
Council of the City of Friendswood in adopting this Ordinance that no portion
hereof or provision or regulation contained herein shall become inoperative
or fail by reason of any unconstitutionality or invalidity of any other portion,
provision or regulation, and to this end all provisions of this ordinance are
declared to be severable.

SIDEWALKS AND DRIVEWAYS ON CURBED-TYPE STREETS
1 . Sidewalk, driveway, curb & gutter line and grade shall be set by City Engineer.
2. Sidewalks shall be constructed with Portland Cement Concrete, 5 sack cement per
cubic yard, 4-1/2" thick, 4' minimum width.
3. Driveways shail be constructed with Portland Cement Concrete, 5 sack cement per
cubic yard, 6" thick, from curb to property line and be reinforced with minimum
3/8" � def. stee� bars @ 24" c-c each way with 10" laps , or equivalent steel area.
4. Curb & gutter shall be constructed with Portland Cement Concrete.
5. One-inch board expansion or 1/2" non-extruding preformed joint, at interval of
36' (maximum) throughout entire length of sidewalks , where new waik meets old
��alk and/or netiN drive��ay. -
6. One-inch board expansion or 1/2" non-extruding pr�formed joint, between sidewalk
and curb, around fire hydrants and utility poles.
7. If more than one driveway is constructed on the same property, such driveways
shall be separated by a minimum distance of at least 20 ft.
8. 8etween driveways , from top of curb to sidewalk and from sidewalk to property
line, this may be concrete or dirt.
