HomeMy WebLinkAboutOrdinance No. 223 ORDINANCE N0. 223 AN ORDINAfVCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF ARTICLE 6701D, VERNON'S TEXAS CIVIL STATUTES, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC IfdVESTIGATION, UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF, AS SET OUT IN THIS ORDINANCE: AND PROVIDING A PENALTY OF A FINE NOT TO EXCEED $200.00 FOR Tf�E VIOLATIOfJ OF THIS ORDINANCE: _ ' ' ��'� 1 � _°%�� � �"�;��' W���reas, Article 6701D, Vernon's Texas Civil Statutes, provides that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investigation that any prima facie speed therein found to exist at any intersection or other place or upon any part of a street or highway within the City, taking into consideration the width and conditior� of the pavement and traffic thereon, said governing body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1 . Upon the basis of an engineering and traffic investigation heretofore made as authorized by the provisions of Article 6701D, Vernon's Texas Civil Statutes, the following prima facie speed limit hereafter indicated for vehicles is hereby determined and declared to be reasonable and safe: 1 . Along Wilderness Trail , from Greenbriar to its end, a distance of approximately 1 .3 miles, 30 miles per hour. 2. Along Moore Road from West Parkwood Avenue (FM 528) to the Galves- ton County line, a distance of approximately .74 of a mile, 30 miles per hour. 3. Along Chester Drive from West Parkwood Avenue nor.thwest to the County line, a distance of approximately .40 of a mile, 30 miles per hour. 4. Along Mills Lane from Sunset Drive to Greenbriar Drive, a distance of approximately .35 of a mile, 30 miles per hour. 5. Along Murphy Lane from Sunset Drive to Greenbriar Drive, a dis- tance of approximately .35 of a mile, 30 miles per hour. 6. Along Briarmeadow Avenue from Sunset to West Parkwood Avenue, a distance of approximately .90 of a mile, 30 miles per hour. 7. Along Greenbriar Drive from Briarmeado�r Avenue to 400 feet north- west of Falling Leaf, a distance of approxin2ately .85 of a miley 30 miles per hour. 8. Along Leisure Lane from South Friendswood Drive (FM 518) to its ' end, a distance of approximately .72 of a mile, 30 miles per hour. 9. Along Lunday Lane from West Parkwood Avenue (FM 528) to its end, a distance of approximately 2.0 miles, 30 miles per hour. 10. Along Coward 's Creek Drive from Sunset Drive to its end, a dis- tance of approximately .75 of a mile, 20 miles per hour. 11 . Along Coward's Creek Court from Greenbriar Drive to its end in a cul de sac, a distance of approximately .15 of a mile, 20 miles per hour. 12. Along Cedar Oaks Lane from Cedarwood Drive to its end, a distance of approximately .10 of a mile, 20 miles per hour. 13. Along Queen's Lane, from Cedarwood Drive to its end, a distance of approximately .20 of a mile, 20 miles per hour. TOWER ESTATES 14. Along Mandale Road from the city limits to Moore Road, a distance of approximately .70 of a mile, 20 miles per hour. 15. Along Tower Drive from West Parkwood ��venue (FM 528) to Mandale Road a distance of approximately .22 of a mile, 20 miles per hour. 16. Along Estate Drive from West Parkwood Avenue (FM 528) to Mandale Road, a distance of approximately .20 of a mile, 20 miles per hour. WINDSONG ADDITION 17. Along Windsong Drive from West Parkwood Avenue (FM 528) to its end, a distance of approximately 1 .3 miles, 30 miles per hour. 18. Along Wind Creek Drive from Windsong Drive to its end, a distance of approximately .13 of a mile, 30 miles per hour. WEST FRIENDSWOOD ADDITION 19. Along Clover Ridge Avenue from Rustic Lane to Westfield Lane, a distance of approximately .25 of a mile, 30 miles per hour. 20. A�ong Meadow Lark Avenue from the City Limits to its northeast end, a distance of approximately .20 of a mile, 30 miles per hour. 21 . Along Rustic Lane from West Edgewood Avenue (FM 2351 � to 500 feet northwest of Meadowlark Avenue, a distance of approximately .45 of a mile, 30 miles per hour. 22. Along Westfield Lane from West Edgewood Avenue (FM 2351 ) to 225 feet northwest of Clover Ridge Avenue, a distance of approximately .20 of a mile, 30 miles per hour. QUAKER'S LANDING 23. Along Penn Drive from a point .05 of a mile southeast of Echo Avenue to a point .10 of a mile northwest of Echo Avenue, a dis- tance of approximately .15 of a mile, 20 miles per hour. SUNMEADOW ADDITION 24. Along Sunmeadow Blvd. , from West Parkwood (FM 528) to East Castle Harbour Drive, a distance of approximately .10 of a mile, 20 miles per hour. Along St. Andrews Drive from Dorado Drive to its end in a cul de sac, a distance of approximately .20 of a mile, 20 miles per hour. 30. Along Dorado Drive from East Castle Harbour Drive to a point .10 of a mile south of St. Cloud Drive, a distance of approximately .20 of a mile, 20 miles per hour. 31 . The Chief of Police is hereby directed to erect appropriate signs at the above mentioned intersections designating the sneed limit as set forth in this ordinance. Section 3. Any person violating any of the provisions of any section of thi s ordi nance shal l be deemed gui 1 tY of a mi sdemeanor and, upon convi cti on, shall be fined not 1ess than TEN ($10.00) DOLLARS nor more than TWO HUNDRED ($200.00) DOLLARS. Section 4. If any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held inva1id or unconstitutional by an,y court of competent jurisdiction, such section, subsection, sentence, clause, phrase, or portion sha11 be deemed se�arate, distinct and an independent pro- vision, and such holding shall not affect the validity of the remaining portion hereof Section 5. There is hereby declared to exit a public emergency affecting the safety and welfare of the ci ti zens of Friendswood and other �er- sons using the street aforsaid, and in according there��vith, this ordinance is oassed as an emergency measure.
