HomeMy WebLinkAboutOrdinance No. 213-E ORDINANCE N0. 213 - E AN ORDINANCE EXTENDING THE APPLICATION OF THE CITY OF FRIENDSWOOD ORDINANCE NUMBER 210 & 212E ESTABLISNING RULES AND REGULATIONS GOVERNING PLATS AND THE SUBDIVISION OF LAND TO ALL OF THE AREA UNDER THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF FRIENDSWOOD, TEXAS; PROVIDING THAT A VIOLATION OF THE ORDINANCE IN SUCH AREA OF EXTRATERRITORIAL JURISDICTION SHALL NOT BE A MISDEMEANOR NOR SHALL ANY FINE BE APPLICABLE: PROVIDING FOR ENFORCEMENT OF SUCH ORDINANCE BY INJUNCTION IN THE DISTRICT COURT: AND DECLARING AN EMERGENCY. WHEREAS, the municipal Annexation Act (Chapter 160, Acts of the 58th Legislature, R�gular Session , 1963; compiled as Article 970a, Vernon's Texas Civil Statues) authorizes any city to extend the application of its ordinance establishing rules and regulations governing plats and the subdivision of land to all of the area under its extraterritorial jurisdiction as defined in such Act; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS: Section 1 . Ordinance Number 210, passed and approved on the 18th day of February, 1974, establishing rules and regulations governing plats and the subdivision of land and entitled, ORDINANCE NUMBER 210, SUBDIVISIONS ORDINANCE and ORDINANCE N0. 212-E passed and approved on P�arch 11 , 1974, amending ORDINANCE N0. 210 are hereby extended in their application to include all of the area within the extraterritorial jurisdiction of the City of Friendswood, Texas. The provisions of such ordinance shall have the same force and effect within said area of extraterritorial jurisdiction as within the corporate limits of the City of Friendswood, Texas, except as provided in Section 2 and 3 of this ordinance. Section 2. No violation of any provision of such Ordinance Number 210 and 212E outside the corporate limits of the city, but within such city's area of extraterritorial jurisdiction, shall constitute a misdemeanor under such ordinance, nor shall any fine provided for in such Ordinance be applicable to a violation within such area of extraterritorial jurisdiction. Section 3. In the event any provision of Ordinance Number 210 and 212E are violated within the area extraterritorial jurisdiction of the City of Friendswood, Texas, and outside its corporate limits, the City may institute any appropriate action or proceedings in the District Court to enjoin the violation of such ordinance. Section 4. If any portion, paragraph or part of this Ordinance shall be held to be illegal or unconstitutional then such holding shall in no wise affect the remainder of such Ordinance and the same shall remain in full force and effects as if such portion so held unconstitutional had never been questioned. Section 5. It has come to the attention of the City Council that ORDINANCE N0. 47 extending the SUBDIVISION ORDINANCE of the City of Friendswood to its extraterritorial jurisdiction may have been inadverdently rendered ineffective by the passage of ORDINANCE N0. 210. There is hereby declared to exist a public emergency as set out above, property, safety, and welfare of the citizens of Friendswood and other persons owning land in subdivisions within the city and its extraterritorial jurisdiction and because of the rapidly growing area and influx of people, there exists an imperative public necessity and in accordance therewith, this ordinance is passed in an emergency manner and shall take effect immediately after its passage and approval .
