HomeMy WebLinkAboutOrdinance No. 212-E ORDINANCE N0. 212E AN ORDINANCE AMENDING A PART OF FRIENDSWOOD ORDINANCE N0. 210, SUBDIVISION OR�INANCE, AMENDING THE SAME TO REQUIRE A SUBMISSION OF ANY RE-PLAT TO THE PLANNING AND ZONING COMMISSION FOR APPROVAL, AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section I . Subsequent to final approval of a plat or replat by the Planning and Zoning Commission, no lot shall be conveyed, developed, divided, sub-divided, or used in any manner other than as shown on said plat. Section II. Any such conveyance, development, division, sub-division, or use of said lots in any manner other than as set out on said plat shall first be submitted to and approved by the Planning and Zoning Cor�nission as in the case of any other plat or replat. Section III . Said replat shall not be approved by the Planning and Zoning Commission if the sale of lots as replatted would either (1 ) increase the population density of said subdivision; (2) result in the decrease in the size of a lot to a size smaller than the average size of lots in the original plat; (3) result in a lot smaller than the minimum lot size required by the present subdivision ordinance. Section IV. It has come to the attention of the City Council that the Subdivision Ordinance presently in effect contains no specific provision requiring re-submission of plats to the Planning and Zoning Commission in the event lots are conveyed, developed, divided, sub-divided or used in any manner nat in compliance with the original plat and Section 5. It has also come to the attention of the City Council that certain person are conveying, developing, dividing, sub-dividing, or using lots in a manner other than that shown on tne plats approved by the Planning and Zoning Commission under the old Subdivision Ordinance No. 23A. There is hereby declared to exist a public emergency as set out above, property, safety, and welfare of the citizens of Friendswood and other persons owning land in subdivisions within the city and its extraterritorial jurisdiction and because of the rapidly growing area and influx of people, there exists an imperative public necessity and in accordance therewith, this ordinance is passed in an emergency manner and shall take effect immediately after its passage and approval . Provided furtheri that in the event one or more 1ots have been sold and all property owners in said subdivision join in the application to vacate said plat and approve the rep7at as submitted to the Planning and Zoning Commission, it may approve said replat without regard to (1 ) the increase in population density or (2) the fact that said replat results in the decrease in the size of a lot to a size smaller than the average size of lots in the original plat� provided it complies with the subdivision ordinance in effect at the time the replat is submitted for approval .
