FOR VEHICLES UNDER THE PROVISIOPJS OF qRTICLE 6701D, VERNON'S
TEXAS CIVIL STATUTES, UPON THE BASIS OF AN ENGINEERING AND
TRAFFIC INVESTIGATION, UPON CERTAIN STREETS AND HIGI�WAYS, OR
PARTS THEREOF, aS SET OUT IN THIS ORDINANGE; PROUIDING A PENALTY
OF A FINE N�T TO EXGEED $2�O.Q0 F�R THE VIOLATT�N OF THIS
ORDINA�dCC.
�1HEREAS, Article 6701D, Vernon's Texas Civil Statutes, provides
that whenever the governing body of the City shall determine upon the basis
of an engineerinq and traffic investigation that any prima facie speed
therein found to exist at any intersection or other place or upon any part
of a street or highway within the City, taking into consideration the width
and condition of the pavement and traffic thereon, said governing body may
determine and declare a reasonable and safe prima facie speed limit thereat
or thereon by the passage of an ordinance, which shall be effective when
appropriate signs giving notice thereof are erected at such intersection or
other place or part of the street or highv�a��, now, therefore,
BE "IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE
OF TEXAS:
Section 1 . lJpon the basis of an engineering and traffic investiga-
tion heretofore made as authorized by the provisions of Article 6701D,
Vernon`s Texas Civil Statutes, the folloa�ing nrima facie speed limit hereafter
indicated for vehicles is hereby determined and declared to be reasonable
and safe; and such rate of speed is hereby fixed at forty-five (45) miles
per hour for vehicles traveling along Sunset Drive between its intersection
with FM 528 (Parkwood Avenue) and Briarmeadow Avenue, a distance of approxi-
matel,y one-half (1/2) mile; a speed of thirty-five (35) miles per hour for
vehicles traveling on Sunset Drive between its intersection and Briarmeadow
Avenue to its intersection with Falling Leaf, a distance of approximately
three-quarters (3/4) of a mile; a speed of thirty-five miles (35) per hour
for vehicles traveling along Sunset Drive between its intersection with
Spreading Oaks Avenue and its intersection with Fh1 2351 (West Edgewood
Avenue)w a distance of annroximately one-half (1/2) mi1e.
Section 2. The Chief of Police is hereby directed to erect
appropriate signs at the above mentioned intersectians designating the
speed limit as set forth in this ordinance.
Section 3. Any person violating any of the provisions of any
section of this ordinance shall be deemed guilty of a misdemeanor and,
upon conviction, shall be fined not less than TEN ($1Q,00) DOLLARS nor
more than TUJO HUNDRED ($200.00) DOLLARS.
Section 4. If any section, subsection, sentence, clause, phrase,
or portion of this ordinance is for any reason held invalid or unconstitu-
tional by any court of competent jurisdiction, such section, subsection,
sentence, clause, phrase of portion shall be deemed separate, distinct
and an independent orovision, and such holding shall not affect the validity
of the remaining portion hereof.
