AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED
FOR VEHICLES UNDER THE PROVISIONS �F ARTICLE 6701D, VERNON'S TEXAS
CIVIL STATUTES, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC
INVESTIGATION, UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF,
AS SET OUT IN THIS ORDINANCE; AND PROVIDING A PENALTY OF A FINE
NOT TO EXCEED $200 FOR THE VIOLATION OF THIS ORDINANeE; APJD
DECLARING AN EMERGENCY.
WHEREAS, Article 6701D, Vernon's Texas Civil Statutes, provides that
whenever the governing body of the City shall determine upon the basis of
an engineering and traffic investigation that any prima facie spe�d therein
found to exist at any intersection or other place or upon any part of a street
or highway within the City„ taking into consideration the width and condition
of the pavement and traffic thereon, said governing body may determine and
declare a reasonable and safe prima facie speed limit thereat or thereon by
the passage of an ordinance, which shall be effective N�hen �ppropriate signs
giving notice thereof are erected at such intersection or other place or
part of the street or highway, now therefore,
BE IT ORDAI�ED BY THE CITY COUNCIL OF THE CITY �F FRIEP�DSWOOR, STATE OF
TEXAS:
Section 1 . Upon the basis of an engineering and traffic investigation
heretofore made as authorized by the provis�ons of Article 6701D, Vernon's
Texas Civil Statutes� the following prima facie speed limit hereafter indicated
for vehicles is hereby determined and declared to be reasonable and safe;
and such rate of speed is hereby fixed at 20 (twenty) miles per hour for
vehicles traveling upon the named portion of Sunset Drive described as follows:
Along Sunset Drive between its intersection with Falling Leaf,
and its intersection with West Spreading Oaks avenue; a distance
of approximately 0.2 mi7e.
Section 2. The Chief of Po1ice is hereby directed to erect appropriate
signs at the abo�e mentioned intersections designating the speed limit as set
forth in this ordinance.
Section 3. Any person violating any of the provisions of any section of
this ordinance sha11 be deemed guilty of a misdemeanor and, upon convictionp
sha11 be fined not less than TEN ($10.00) DOLLARS nor more than TWO HUNDRED
($200.00) DOLLARS.
Section 4. If any section, subsection� sentence, clause� phrase or
portion of this ordinance is for any reason he�d invalid or unconstitutional
by any court of competent jurisdiction, such section, subsectionb sentence,
clause, phrase or portion shall be deemed separate, distinct and an independent
provision, and such holding shall not effect the validity of the remaining
portion hereof.
Section 5. There is hereby declared to exist a public emergency
affecting the safety and welfare of the citizens of Friendswood and other
persons using the street aforesaid, and in accordance therewithr this
ordinance is passed as an emergency measure.
PASSED AS AN EMERGENCY ORDINANCE this 12th day of November ' 1973.
