AN ORDINANCE PROHIBITING TRAFFIC OF TRUCKS ON WINDING ROAD
IN TH� CITY OF FRIENDSWOOD; PROVIDING A PENALTY; DECLARING
AN EMERGENCY.
BE IT ORDAINED BY 7HE CITY COUNCIL OF TH� CITY OF FRIENDSWOOD, STATE OF
TEXAS:
WHEREAS, heavy truck traffic has recently occurred on Winding
Road in the City of Friendswood, Texas; and
WHEREAS, such traffic has caused and is causing excessive
damage to said road; now, therefore,
SECTION I
It shall be unlawful to operate any vehicle on Winding Road
in the City of Friendswood when the gross weight of such vehicle exceeds
ten thousand pounds, except for the purpose of making delivery or pickup
on such street or road for not more than the minimum distance necessary
for such purpose.
SECTION II
The registered owner of a vahicle found in violation of this
section shall be prima facie responsible for any such violation.
SECTION III
Any person, firm or corporation violating any of the provisions
of this ordinance sha17 be fined not less than FIVE nor more than TWO
HUNDRED dollars for each offense; and a separate offense sha71 be deemed
committed on each day during which a violation occurs or continues.
SECTION IV
A public emergency is hereby declared to exist due to the con-
tinuing and severe damage being caused to public property to wit: Winding
Road in the City of Friendswood being damaged by heavy truck traffic; there-
fore this ordinance is hereby adopted as an emergency measure on first reading
in accordance with Section 3.12 of the City Charter.
PASSED, APPROVED and ADOPTED as an emergency ordinance this
29th day of May, 1973,
