ORDINANCE NUMBER 177 AN ORDINANCE OF TNE CITY OF FRIENDSWOOD, TEXAS MAKING CERTAIN FINDINGS; SETTING FORTH RESULTS OF A PUBLIC HEARING; EXTENDING THE CITY LIMITS OF THE CITY OF FRIENDSWOOD, TEXAS TO INCLUDE ALL LANDS AND AREA WITHIN CERTAIN LIMITS AND BOUNDARIES AND ANNEXING TO THE CITY OF FRIENDSWOOD ALL OF THE AREA WITHIN SUCH LIMITS AND BOUNDARIES; PROVIDING THE PASSAGE OF THIS ORDINANCE SHALL NOT IMPAIR OR AFFECT ANY OTHER ANNEXATION ORDINANCE WHETHER PASSED ON ONE OR MORE READINGS AND NOT YET PASSED ON FINAL READING; PROVIDING A SAVING AND SEVERABILITY CLAUSE. WHEREAS, in accordance with Article 970a, Section 6, publication of a Notice of Public Hearing was duly caused to be published in the Friendswood News on Thursday, October 26, 1972, the Friendswood News being a newspaper of general circulation in the City of Friendswood, Texas, and a copy of an Affidavit of such publication is attached hereto as follows: � -_ - AND WHEREAS, on the 6th day of November, 1972, at 7:30 p.m. in the City Hall of the City of Friendswood, Texas, a public hearing was duly held, according to the published notice, affording the opportunity for several interested persons to appear before the City Council of Friendswood� Texas to present evidence in regard to the feasibility and practicability of the annexation of such territory to the City; and, WHEREAS, the hearing was completed and every person who desired to be heard was given a full opportunity to present evidence on the advantages or disadvantages of such annexation; and WHEREAS, the necessary Ordinance or Ordinances have been prepared to complete the annexation proceedings, now therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section l . That the boundaries and limits of the City of Friendswood are hereby extended so as to embrace and include the following described area of land, and the following described area of land is hereby annexed to and made a part of the City of Friendswood, to-wit: BEING 128 Acres tract of land more or less located wholly within Galveston County, Texas, which lies adjacent to the City of Friendswood, Texas, said 128 Acre tract of land being more particularly described by metes and bounds as follows to wit: BEGINNING at a point in the Galveston-Brazoria County line, said point being in Southeasterly line of F,M. Road 2351 ; THENCE N 10° 42' E and along the Brazoria County and Galveston County line a distance of 4865.20 feet more or less to a point in the Southwesterly City Limit line of the City of Friendswood, Texas, as established by Ordinance Number 102, said point also being a point where the Northwesterly extension of the Northeasterly line of Central Park Subdivision and the Southwesterly extension of the Friendswood Subdivision intersects the Brazoria County and Galveston County line; THENCE S 45° E and along the Northwesterly extension of the Northeasterly line of Central Park Subdivision,and the Southwesterly extension of the Friendswood Subdivision a distance of 2508.40 feet more or less to a point for cornerb said point being S 45° E 50.00 feet from the Southeasterly liae of the James F. Perry and Emily Austin League Abstract 20, and the Northwesterly line of the Sarah McKissick or J. R. Williams League Abstract 151 ; THENCE S 45° W along the Southeasterly line of F.M. Road 2351 and a Northeasterly extension thereof to the place of beginning; CONTAINING 128 Acres more or less BEING 0.20 square Miles. Section 2. This ordinance shall not repeal , impair, modify or in anywise affect any other ordinance annexing territory to the City of -5- Friendswood, or any other ordinance heretofore passed on one or more readings and not yet passed on final reading annexing any territory to the City of Friendswood, but such other ordinance or ordinances shall remain and continue to be effective to their intent and purpose as therein stated wholly unaffected in any way or manner by the passage of this ordinance. This ordinance shall not in anywise be impaired or affected by any other ordinance heretofore introduced or passed on any reading� whether final or not; nor shall it be affected by any other ordinance �hic� may there- after be introduced or passed on one or more readings, pending the final passage of this ordinance; and this ordinance shall be effective to its intent and purpose as hereinabove stated, wholly unaffected by any other annexation ordinance introduced and passed or hereafter introduced and passed on any reading, whether final or not final , annexing territory to the City of Friendswood� and wholly unaffected by any ordinance heretofore or hereafter passed calling arhearing and giving notice relative to the institution of any annexation proceeding. The procedure initiated hereby and the annexation proceedings instituted hereunder shall be independent of any other proposed and pending annexation of such territory and such other proceedings shall not be affected hereby. Section 3. If any section, or part of this ordinance shall be held unconstitutionals illegal or invalid, or the application thereof ineffective or inapplicable as to any territory, such unconstitutionality, illegality� invalidity or ineffectiveness of such section or part shall in no wise affecty impair or invalidate the remaining portion or portions thereof, but as to such remaining portion or portions, the same shall be and remain in full force and effect; and shall this ordinance for any reason be ineffec- tive as to any part of the area hereby annexed to the City of Friendswood, such ineffectiveness of this ordinance as to any such part or parts, of any such area shall not affect the effectiveness of this ordinance as to all of the remainder of such area, and the City Council hereby declares it to be its purpose to annex to the City of �iendswood every part af the area -6- described in Section 1 of this ordinance, regardless of whether any other part of such described area is hereby effectively annexed to the City. Provided further, that if there is included in the general description of territory set out in Section 1 of this ordinance to be hereby annexed to the City of Friendswood any lands or area which are already a part of and included within the general limits of the City of Friendswood� or which are presently part of and included in the limits of any other city, town or village, or which are not within the City of Friendswood jurisdiction to annex, the same is hereby excluded and excepted from the territory to be annexed hereby as fully as if such excluded and excepted area were especially described herein.
