AN ORDINANCE CHANGTNG THE ZONING OF
CERTAIN PROPERTY FROM R-2 TO C-l;
CHANGING THE ZONING MAP ACCORDINGLY;
COMPLYZNG WITH SECTION 15 OF ORDINANCE
NUMBER 132 OF THE CITY OF FRIENDSWQOD
KNOWN AS THE ZONING ORDINANCE; MAKING
CERTAIN FINDINGS; RESTRICTING ISSUANCE
OF BUILDING PERMITS
BE ZT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FRIENDSWOOD, STATE OF TEXAS:
That, WHEREAS the City Council finds that the
Friendswood Zoning Commission conducted a public hearing on
the 13th day of April , 1972 to consider the question
of rezoning the hereinafter described tract of land from
R-2 to C-1; and,
WHEREAS, the hearing was duly called, as provided
by the law� of the State of Texas and Section 15 of Ord�.nance
132 of the City of Friendswood, and at such hearing, a11 persons
attending were allowed to be heard as to the question of
whether or not the rezoning of the tract from R-2 to C-1
would affect the public health, safety, morals , convenience
or general welfare and whether or not such rezoning would
violate the rights of any interested persons ; and ,
WHEREAS, as a result of the said public hearing
and several conferences at open council meetings with proponents
of the rezoning and previous correspondence between the
proponents for the rezoning and the city, a11 of which is
incorporated herein as part of the Council 's findings, the
Council further finds :
A. That the rezoning of said property from R-2
to C-1 would complement the adjoining C-1
district and permit development of a larger,
more commodious shopping center �han is presently
po�sible on the adjoining, existing C-1 tracts ,
thereby being of substantial benefit to public
health, safety, morals , convenience and
general welfare.
B . The rezoning of said property from R-2
to C-1 has not been opposed during any of
the m�etings or at the public hearing
af orementioned ,
C . That drainage of the tract and areas
surrounding it is presently inadequate for
the purpo�e of any substantial development
of the said tract .
D. That any construction or development on
the tract must be preceded by completion
of adequate drainage as prescribed by the
City ` s Engineer and subject to approval by
the Planning and Zoning Commission prior
to issuance of any building permits on any
portion of the rezoned tract .
NOw, THEREFORE, BE IT FURTHER ORDAINED BY THE
CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS :
Section 1 . That the zoning of the foll�wing
described property be and the same is hereby
changed from R-2 to C-1 within the meaning of
the Zoning Ordinance (Ordinanee 132) :
BEGINNZNG at the North Corner of a tract
of land containing 50,000 square feet of land
deeded to the Southwestern Bell Telephone Company
by Sarah Viola Pearson;
THENCE N ��° 32 ' 0�" a distance of 683 . 0�
feet to a 1/2 inch iron pipe for corner; said
point being a corner of a � . 8�9 acre tract formerly
belonging to the Methodist Church;
THENCE N ��° �� ' 21" West along a boundary
line of said �. 8�0 acre tract of land and a N�rth-
westerly extension thereof a distance of 3�2 .70
feet more or less �o a point in the East line
of Annalea Subdivision Section I;
THENCE S �5° W and along the Southea�� line
of Annalea Subdivision �ection I a distanc� of
5�3 . 65 fee� more or less to a poin� for corner;
THENCE S �44° �}�4 ' �Il" E a distance of 1021. 80
feet to a point for corner;
THENCE N �15° 16 ' 19" E a distance o�' ��}3 . 65
feet more or l��s to the place of beginning.
Section 2. That the official zoning map of
the City be revised to show the tract rezoned
from R-2 to C-1 and the date of final passage
of this ordinance.
Section 3 . That the provision for ade�uate
drainage surrounding and on the tract described
in Section l, subject to approval as set forth
under the Council' s findings herein, sha11 not
be a condition precedent to rez�ning the tract
but a condition precedent to issuance of any
building permits for future construction on
th� tract .
Section � . This ordinance shall in no wise
reduce, amend, supplement or change any provision
of any ordinance of the City of Friendswood
other than to accomplish the rezoning of the
tract described in Section 1 herein from R-2
�o C-1 and impose the findings and limita�ions
ordained herein.
