HomeMy WebLinkAboutOrdinance No. 165 ORDINANCE N0, 165 AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF ARTICLE 6701 D VERNON'S TEXAS CIVIL STATUTES, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION, UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF FRIENDSWOOD, AS SET OUT IN THIS ORDINANCE; AND PROVIDING A PENALTY OF A FINE NOT TO EXCEED $200.00 FOR THE VIOLATION OF THIS ORDINANCE- WHEREAS, Article 6701 D, of Vernon's Texas Civil Statutes, provides that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investigation that any prima facie speed therein set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of a street or highway within the City, taking into consideration the width and condition of the pavement and other circumstances on such portion of said street or highway, as well as the usual traffic thereon, said governing body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway, now therefore, STATEa OF BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,I TEXAS: SECTION 1., Upon the basis of an engineering and trafic investigation heretofore made as authorized by the provisions of Article 6701 D Vernon's Texas Civil Statutes, the followin� prima facie speed limits hereafter indi- cated for vehicles are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named streets and highways, or parts thereof, such streets being public streets and within the corporate limits of the City of Friendswood, Texas, named and described as follows: TWENTY (2� MILES PER HOUR (a) Along Echo Avenue extending from its intersection with Quaker Drive in a southwesterly direction to its end: ,1 of a mile (b) Along Penn Drive extending from its southeast end to its northwest end, from cul-de-sac to cul-de-sac: .1 of a mile (c) Along Greenbriar Drive extending from its intersection with Castlewood Avenue to its intersection with Falling Leaf; .35 of a mile (d) Along Lexington extending from its intersection with Castlewood Avenue to its end in a cul-de-sac: . 1 of a mile (e) Along Castlewood Avenue from Coward Creek to FM 518, a distance of approxi- mately .4 of a mile THIRTY (30� MILES PER HOUR (a) Along Castlewood Avenue extending from its intersection with Sunset Drive to its intersection with Greenbriar Drive: .4 of a mile (b) Along Falling Leaf extending from its intersection with Greenbriar Drive to its intersection with Sunset Drive: .35 of a mile (c) Along Melody Lane extending from its intersection with Edgewood Avenue (FM 2351 ) to the Friendswood City Limits at the Brazoria County Line: 1 .2 miles (d) Along John Drive extending from the Friendswood City Limits to its intersection with Myrtlewood Drive: .3 of a mile (e) Along Myrtlewood Drive extending from its intersection with John Drive to its end in a cul-de-sac: .2 of a mile (f) Along Steele Drive extending from its intersection with Judy Avenue to its end in a cul-de-sac: .2 of a mile (g) Along Judy Avenue extending from its intersection with Steele Drive to its intersection with Thomas Drive: .3 of a mile (h) Along Thomas Drive extending from its intersection with Judy Avenue to its intersection with John Avenue: .2 of a mile (i ) Along Crawford Drive extending from its intersection with John Avenue to its intersection with Judy Avenue: .2 of a mile SECTION 2. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof sha11 be fined in any sum not more than Two Hundred Dollars ($200.00) . SECTION 3. Any person violating the terms of this ordinance may be arrested by officers or auxiliary officers of the Police Department of the City of Friendswood without issuance of a warrant of arrest from a magistrate. SECTION 4. Severability. If any provision of this ordinance, or the application thereof to any person or circumstances, is held invalid, the remainder of the ordinance, and the application of such provision to the other persons or circumstances, shall not be affected thereby.
