HomeMy WebLinkAboutOrdinance No. 147 z. ,. `r ' � • .. 0 R D I N A N C E N O. 147 AN ORDINANCE AMENDING ORDINANCE NO. 93, (PERSONNEL POLICIES ORDINANCE) ; AMEND- ING SECTION I, (E) ENTITLED MEMBERS OF FAMILY RESTRICTION; AMENDING SECTION VI (D) ENTITLED PROCEDURE FOR INVOLUNTARY SEPARATION FOR A CAUSE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, DULY ASSEMBLED: SECTION I The entire portion of Section I, (E) of Friendswood City Ordinance Number Ninety-three (93) , which in present form, reads as follows: ["Section I, (E) Members of Family Restriction: No more than one member of a family shall be employed by the city. This restriction applies to both permanent and temporary employment. Members of a family are defined as ; father, wife, husband, mother, sister, brother, uncle, aunt, first cousin, or in-laws of any of the aforementioned relatives. Current employees are exempt from this provision. "] , is hereby amended as follows : Section I, (E) Members of Family Restriction; Exception: No more than one member of a family shall be employed by the city. SECTION II The entire portion of Section VI (D) of Friendswood City Ordinance Number Ninety-three (93) , which in present form reads as follows: ["Section VI , (D) Procedure for Involuntary Separation for Cause: The employee recommended for separation for cause will be advised in writing of the nature of the complaint against him. This written notice shall be signed by the Mayor, with concurrence of City Council. The employee will be afforded the opportunity of making a written reply in his behalf. If employee elects to make a written reply, due consideration will be given his reply by Council, and upon Employee ' s request he will be granted a closed hearing. The Mayor or Department Head may suspend employees without pay until a decision is made upon his case. " ] is hereby amended to read as follows: Section VI, (D) Procedure for Involuntary Separation for Cause: The Mayor and Department Head may complain against, and suspend any non-supervisory employee with or without pay after due consideration of a written complaint initiated by . either the Mayor or the Department Head. If the Mayor and � � Department Head reach a decision that is mutual, the Employee may then be suspended immediately. If either the Mayor or Department Head act to suspend on the completed written com� plaint, the Employee is suspended immediately, with pay, until the City Council reviews the matter and ta�kes official action. The suspended city employee may protest the decision or action of the Mayor and/or Department Head by a written request to City Council asking a review of such decision or action in a closed personnel hearing. Such written request must be submitted to the City Secretary not 7ater than seven days after the employee has been notified of the action or decision to involuntarily su�end such emplo,yee from employment by the City of Friendswood. If no such request is submitted� the suspension shall be considered final termination from the ori,�inal da te. Supervisory personnel and/or department heads employed by the City of Friendswood may be discharqed for cause only by the City Council after due consideration of such person's case in a closed personnel hearing. A� such employee, upon written re�uest to the City Council may obtain a public hearin� before Council at which time he m� offer his case for continued empl�ment.
