AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED
FOR VEHICLES UNDER THE PROVISIONS OF ARTICLE 6701 D VERNON'S
TEXAS CIVIL STATUTES, UPON THE BASIS OF AN ENGINEERING AND
TRAFFIC INVESTIGATION, UPON CERTAIN STREETS AND HIGHWAYS, OR
PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF
FRIENDSWOOD, AS SET OUT IN THIS ORDINANCE; AND PROVIDING A
PENALTY OF A FINE NOT TO EXCEED $200.00 FOR THE VIOLATION OF

WHEREAS, Article 6701 D, of Vernon's Texas Civil Statutes, provides
that whenever the governing body of the City shall determine upon the basis
of an engineering and traffic investigation that any prima facie speed
therein set forth is greater or less than is reasonable or safe under the
conditions found to exist at any intersection or other place or upon any
part of a street or highway within the City, taking into consideration
the width and condition of the pavement and other circumstances on such
portion of said street or highway, as well as the usual traffic thereon,
said governing body may determine and declare a reasonable and safe prima
facie speed limit thereat or thereon by the passage of an ordinance, which
shall be effective when appropriate signs giving notice thereof are erected
at such intersection or other place or part of the street or highway, now
therefore,
BE IT ORDAIhED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
TEXAS:
Section 1 . Upon the basis of an engineering and traffic investi-
gation heretofore made as authorized by the provisions of Article 6701 D
Vernon's Texas Civil Statutes, the following prima facie speed limits
hereafter indicated for vehicles are hereby determined and declared to
be reasonable and safe; and such speed limits are hereby fixed at the
rate of speed indicated for vehicles traveling upon the named streets and
highways, or parts thereof, such streets being public streets and within
the corporate limits of the City of Friendswood, Texas, named and described
as follows:
TWENTY (20) MILES PER HOUR
(a) Along Quaker Drive extending from its intersection with
Clearview Avenue to its end: .25 miles
(b) Along Echo Avenue extending from 200' southwest of its
intersection with Quaker Drive to its ending in a cul-de-sac
directly northeast of the intersection with Haverford Lane:
.25 miles
(c) Along Haverford Lane extending from its intersection with Echo
Avenue to its end in a cul-de-sac: .15 miles
(d) Along Earlham Drive extending from its intersection with Echo
Avenue to its ending in a cul-de-sac: .15 mi7es
(e) Along Whittier Drive extending from a cul-de-sac northwest of
its intersection with Echo Avenue to a cul-de-sac southeast
of its intersection with Echo Avenue: .15 miles
(f) Along Penn Circle extending from its intersection with Echo Avenue
around the circle to its other intersection with Echo Avenue,
a distance of approximately: 135'

Section 2. Any person violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof
shall be fined in any sum not more than Two Hundred Do1lars. ($200.00)
Section 3. Any person violating the terms of this ordinance may be
arrested by officers or auxiliary officers of the Police Department of the
City of Friendswood without issuance of a warrant of arrest from a
magistrate.
Section 4. Severability. If any provision of this ordinance, or the
application thereof to any person or circumstances, is held invalid, the
remainder of the ordinance, and the application of such provision to the
other persons or circumstances, shall not be affected thereby.
PASSED AND APPROVED as an emergency ordinance on this the lst day
of October 1970.
